LOT 50 OF TRACT NO. 4979, IN THE CITY OF FRESNO, COUNTY OF FRESNO, STATE OF CALIFORNIA, ACCORDING TO THE MAP THEREOF RECORDED IN BOOK 65 PAGES 50 AND 51 OF PLATS, FRESNO COUNTY RECORDS.
The Estate owns 100% fee simple interest in the Matus Property.
The Matus Property will be sold subject to current taxes, covenants, conditions, restrictions, reservations, rights, rights of way, and easements of record, with any encumbrances of record to be satisfied from the purchase price.
The Matus Property is to be sold on an “as is” basis, except for title.

The Construction Allocation for this project is $377,000.

This Contract will be used primarily by the Department of Transportation. The Contract term is for 2 year(s), with provisions for two (2) one (1) year extensions
Bid Proposals must be filed electronically using Planet Bids, by mail, or in person with the Purchasing Manager prior to the bid opening at 3:00 p.m. on Monday August 7th, 2018, when the bids will be publicly opened and recorded. The Purchasing clock is the official clock for determining 3:00 p.m. for the purposes of this bid. Electronically file is defined as by means of electronic equipment or devices.
The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code. The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City. A copy of the resolution is on file at the Office of the City Clerk. Actual wage schedules are available at Construction Management Office, 1721 Van Ness Avenue, Fresno, California 93721, (559) 621-5600.
Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.
All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager and must be accompanied by a Bid Deposit in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount. All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected.
The City of Fresno hereby notifies all Bidders that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation, ethnicity, status as a disabled veteran or veteran of the Vietnam era or on any other basis prohibited by law.
Furthermore, the City of Fresno hereby notifies all Bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex, national origin, religion, age, or disability in consideration for an award.
This project is funded in part with financial assistance from the U.S. Department of Transportation, Federal Transit Administration (FTA). The successful proposer shall be knowledgeable of and in compliance with all applicable Federal Third -Party Contract Clauses.
DISADVANTAGED BUSINESS ENTERPRISE (DBE)
It is the policy of the Department of Transportation and the City of Fresno that Disadvantaged Business Enterprises (“DBE”) as defined in 49 CFR Part 26, shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds. The national goal for participation of Disadvantaged Business Enterprises (DBE) is 10%. The City’s overall goal for DBE participation is 13%.
No specific goals are set on a contract by contract basis.
The goal is accomplished through the use of race-neutral measures in accordance with 49 CFR Part 26. The City shall take all necessary steps to ensure nondiscrimination in the award of all contracts to meet the objectives of the above cited regulation. When listing sub-contractors on page 1.8 Bidder shall identify them as DBE with the approximate value of their sub-contract.
Bidders are advised that any award of the Contract will be conditioned on the successful Bidder meeting the good faith efforts to meet the established goal for this project pursuant to 49 CFR 26.53.
In accordance with provisions of section 22300 of the California Public Contract Code, Contractor may substitute securities for any monies withheld by City to ensure performance under the Contract.
A 100 percent Payment Bond and 100 percent Performance Bond for all public works contracts must be filed with the Contract Documents and approved by the City before the Contractor enters upon performance of the Work.
No bid will be considered for award unless the Bidder at the time of bid opening is licensed with a valid Class “C”-46 Contractor’s License issued by the State of California.
The City reserves the right to reject any and all bids.

MITIGATED NEGATIVE DECLARATION
Notice is hereby given that the County of Fresno has prepared Initial Study Application (IS) No. 7384 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:
INITIAL STUDY APPLICATION NO. 7384, DIRECTOR REVIEW AND APPROVAL APPLICATION NO. 4522 and VARIANCE APPLICATION NO. 4050 filed by BIOLA COMMUNITY SERVICES DISTRICT, proposing to construct a 500,000-gallon water storage tank with boost pumps at the existing well site on the Assessor’s Parcel Number 016-265-10T in the R-1 (Single-Family Residential) Zone District. Site improvements will be necessary to accommodate the tank and pumps. The project also proposes to replace water services, install new 10-inch water mains to replace existing 6-inch and 8-inch water mains in selected areas of the District, and to replace all existing water meters throughout the District. A Variance is required to allow the installation of fence and wall in excess of three feet within the front-yard setbacks. The project site is located on the north side of West F Street, at its intersection with North Third Street, within the unincorporated community of Biola (SUP. DIST. 1). Adopt the Mitigated Negative Declaration prepared for Initial Study Application No. 7384 and take action on Director Review and Approval Application No. 4522 and Variance Application No. 4050 with Findings and Conditions.

The County of Fresno has determined that it is appropriate to adopt a Mitigated Negative Declaration for the Proposed Project. The purpose of this Notice is to (1) provide notice of the availability of IS Application No. 7384 and the draft Mitigated Negative Declaration, and request written comments thereon; and (2) provide notice of the public hearing regarding the Proposed Project.

NOTICE IS HEREBY GIVEN that on August 2, 2018, at 6:30 pm, or as soon thereafter as the matter can be heard, the Fowler Planning Commission will hold a public hearing at the City Hall Council Chambers at 128 S. 5th Street, Fowler, California.
The Planning Commission will consider recommendations to the City Council on the following matters related to proposals by Fowler Business and Professional Park, LLC., for property located on the south side of West Fresno Street between South 8th Street and State Route 99 (APN: 343-40-21S).
The subject property is an approximately 7,500 square foot portion of Parcel 6 of the recorded Parcel Map No. 2016-01. Parcel Map 2016-01 created a 9-lot commercial subdivision on approximately 16-acres owned by Fowler Business and Professional Park, LLC., for which a prior Initial Study/Mitigated Negative Declaration (IS/MND) was adopted. The IS/MND was adopted for the Fowler Medical Plaza Tentative Parcel Map No. 16-01/Site Plan Review No. 16-04.
General Plan Amendment GPA 17-01 : The applicant proposes a General Plan Amendment from Medium Density Residential planned land uses to Community Commercial planned land uses for the 7,500 square foot project site.
Change of Zone ZA 17-01: The applicant proposes a Change of Zone from R-1-6 (One-Family Residential District, 6,000 square foot minimum parcel size) to the C-2 (Community Commercial District) for the 7,500 square foot project site.
Environmental Finding: The City of Fowler prepared an Addendum pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15164, to the previously approved Initial Study/Mitigated Negative Declaration (IS/MND).
The decision of the Planning Commission will be recommended to City Council for final action at a public hearing to be determined. The Commission requests your participation and the public is welcome to speak at the hearing. If you challenge any action in court, you may be limited to challenge only those issues raised at the Planning Commission and City Council public hearings, or in written correspondence delivered to the Community Development Department at, or prior to, the public hearing.
