SUMMARY OF PROPOSED ORDINANCE
COMPREHENSIVE CODE ENFORCEMENT UPDATE
            On August 1, 2017, by a 4-0-1 vote, the City Council of the City of Fowler introduced  Ordinance No. 2017-03, “An Ordinance of the City Council of the City of Fowler adding Chapter 21 of Title 5 Pertaining to Nuisances, Chapter 22 of Title 5 Pertaining to Abatement, Appeals, and Administrative Hearings, and Chapter 23 of Title 5 Pertaining to Cost Recovery, and Repealing and Amending Various Sections in the Municipal Code Pertaining to Code Enforcement to Conform with the Adoption of Chapters 21, 22 and 23.”
            This Ordinance creates a uniform and consistent procedure for the regulation of public nuisances within the City by updating and consolidating existing neighborhood preservation and related nuisance ordinances, and by creating consistent and current code enforcement and cost recovery procedures.
The Ordinance adopts three comprehensive updated code enforcement Chapters on nuisances, abatement, appeal, administrative hearings, and cost recovery, and places them in consecutive Chapters of the Municipal Code.  This will simplify the identification of City nuisances and the procedures for addressing violations of those nuisances. Major substantive changes include:
•An update to the City’s list of property related nuisances;
•The addition of provisions to address the management of real property;
•The establishment of a uniform and consistent procedure for the conduct of administrative hearings, abatement, and cost recovery;
•The addition of a mechanism for the recovery of costs for providing extraordinary department services (multiple responses) that are not otherwise covered by user fees.

REGARDING WATERING SCHEDULE
On August 1, 2017 the City Council of the City of Fowler adopted the Ordinance  No. 2017-02, “An Ordinance of the City Council of the City of Fowler Amending Section 6-4.1107 of the Fowler Municipal Code Relating to the City’s Watering Schedule”.  The Ordinance sets the City’s watering schedule as follows:
(1)        Summer Watering Schedule (3 days per week), between June 1 and September 30.  Odd-numbered street addresses, water on Tuesdays, Thursdays and Saturdays; even-numbered street addresses, water on Wednesdays, Fridays and Sundays.  No watering between the hours of 9:00 a.m. and 6:00 p.m.
(2)        Winter, Spring, Fall Watering Schedule (2 days per week), between October 1 and May 31.  Odd-numbered street addresses, water on Tuesdays and Saturdays; even-numbered street addresses, water on Wednesdays and Sundays.

The work to be performed under this contract is on a project assisted under a program providing direct federal financial assistance from the Department of Housing and Urban Development (HUD), Community Development Block Grant (CDBG) program, and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 USC 1701u.  Section 3 requires that to the greatest extent feasible opportunities for training and employment to be given to low and moderate income persons residing within the project area and that the contracts for work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project.  Regulations for implementing the Section 3 clause are contained in 24 CFR 135, as amended, and as specified in the project specifications.
All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form.  The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”.  Bidders for this project must possess a valid Class A or C12   License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available.  Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract.  All representations made on the proposal are made under penalty of perjury.

Bidders are advised that, as required by federal law, the City of Clovis is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE).  Section 2, “Proposal Requirements and Conditions,” under subsection titled “Disadvantaged Business Enterprises (DBE)” and Section 5, “General,” under subsection titled “Performance of Subcontractors” of these special provisions cover the DBE requirements.  The DBE Contract goal is Seventeen percent (17%).  The Agency may consider the DBE commitments of the 2nd and 3rd bidders when determining whether the low bidder made good faith efforts to meet the DBE goal.
This project is subject to “Buy America” requirements of the Surface Transportation Assistance Act of 1982 (Section 165), and the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) Sections 1041(a) and 1048(a), Title 23 CFR 635.410, and the regulations adopted pursuant thereto.
This project is also subject to the Cargo Preference Act (CPA) implementing regulations in Title 46 CFR 381, “Cargo Preference – U.S.-Flag Vessels”, for all Federal-aid projects.
