Plaintiffs, City of Fresno and People of the State of California allege:

            1.         Plaintiff, City of Fresno (City) is, and at all times herein mentioned was, a charter municipal corporation, duly organized and existing under and by virtue of the Constitution of the State of California.

            2.         The City is authorized to bring a civil action for public nuisance abatement when a nuisance exists within the City in the name of the “People of the State of California”.  (CCP §731)  The Fresno Municipal Code (FMC) makes it unlawful to own or control a property with a public nuisance.  (FMC §10-605)  Public nuisances include, but are not limited to rubbish, junk, abandoned cars, weeds, blighted vacant buildings and attractive nuisances.  (Civ. Code §§3479-3481; FMC §§10-605, 10-617)  When a nuisance exists, the City is permitted to obtain a judgment for damages, enjoin the continuance of the nuisance, or enter upon and correct it.  (CCP §731)

3.         California Government Code Section 38771 authorizes the Fresno City Council, by ordinance, to declare what constitutes a nuisance.  The Fresno Municipal Code makes it unlawful to own or control a property with a public nuisance.  (FMC §10-605)  Public nuisances include, but are not limited to rubbish, junk, abandoned cars, weeds, blighted vacant buildings and attractive nuisances.  (Civ. Code §§3479-3481; FMC §§10-605, 10-617.)  When a nuisance exists, the City is permitted to obtain a judgment for damages, enjoin the continuance of the nuisance, or enter upon and correct it.  (CCP §731) 

4.         The Fresno Municipal Code also provides the City with several modalities to collect on unpaid abatement costs incurred by the City or penalties issued by it resulting from an ongoing public nuisance, including obtaining a personal judgment (FMC §1-510.) 

5.         The allegations in this Complaint, stated on information and belief, have current and substantial evidentiary support.

            6.         City is informed and believes and thereon alleges that defendant Ngocmai Truong (and Does 1 through 50 inclusive, collectively Defendant) are, and at all times mentioned herein were, the record owners and operators of the real property, 1731 S. Cherry Avenue, Fresno, California, APN 468-303-06 (the Subject Property), whose present condition is in violation of the Fresno Municipal Code and constitutes a public nuisance. 

            7.         Defendants Does 1 through 50, inclusive, are sued herein under fictitious names.  Their true names and capacities are unknown to City.  When their true names and capacities are ascertained, City will amend this complaint by inserting their true names and capacities herein.  City is informed and believes and hereon alleges that each of the fictitiously named Defendants is responsible in some manner for the occurrences, conditions and/or violations herein alleged.

            8.         Wherever in this Complaint reference is made to any act of Defendants, such allegations shall be deemed to mean Defendants or their officers, agents, managers, representatives, employees, who did or authorized such acts while actively engaged in the operation, management, direction or control of the affairs of Defendants while acting within the course and scope of their duties.

9.         The Subject Property has a more than four year history of Municipal Code Violations, which the Defendants have failed to timely and adequately correct.

            10.       From October 2013 through the present, the City has inspected the Subject Property for building/municipal code violations numerous times and has consistently found a vacant blighted, dilapidated property unsafe for occupation, containing ongoing and uncorrected public nuisances including: (a) junk, rubbish, trash and debris; (b) overgrown landscaping; (c) graffiti; (d) evidence of fire damage; and (e) evidence of transients. 

12.       From 2013 until the present, the City has noticed the owner to correct the public nuisances, without affect.  The City has had to frequently board up the Subject Property and deal with transient activity at the property which causes a significant risk to health and safety.  The City has also assessed the real property and submitted the assessed costs and penalty with Fresno County Tax authorities.  As of September 29, 2017, the total unpaid amount owed by Defendants for the citations, and the City’s code enforcement activities at the Subject Property is $18,403.98.  Attached as Exhibit A and incorporated herein by reference is a true and correct copy of the September 29, 2017, Demand for Payoff. 

13.       The City continues its efforts on the Subject Property to compel the Defendants to abate the violations of the Fresno Municipal Code, and continues to incur administrative costs, abatement costs, and additional citations may be issued as the violations continue. 

14.       The Fresno Municipal Code provides that any person issued a citation has a right to appeal, but if no appeal is filed the citations shall be final and immediately payable.  (FMC §1-308)  Defendants have not appealed any of the citations or invoices and the statutory period within which to do so has expired.

            15.       As of the filing of this complaint, despite providing repeated notice to Defendants, issuing citations, and periodically abating the public nuisances on the Subject Property, Defendants have failed to take the necessary corrective action to bring the Subject Property into compliance, it remains in constant violation of the Fresno Municipal Code, and the aforementioned costs and penalties remain unpaid.

            WHEREFORE, Plaintiffs pray as follows:

            1.         That Defendants, and each of them, be ordered to pay the City any and all abatement costs, administrative costs, and administrative citations issued relating to Public Nuisances on the Property which as of September 29, 2017, totaled $18,403.98.

            2.         That the City recover costs of suit from Defendants and each of them and/or their successors and assigns, including reasonable attorney fees under California Government Code Section 38773.5 and Fresno Municipal Code Section 1-510;

            3.         For such other and further relief as the court deems proper.
