The City of Fresno is offering an opportunity to submit qualifications and proposals to purchase, design, and develop approximately ±0.54 acres of land containing a one-story industrial warehouse generally located on H Street between Kern Street and Mono Street in the South Stadium neighborhood in downtown Fresno.

The proposals received shall become the property of the City and are subject to public disclosure.  Those parts of a proposal which are defined by the Proposer as business or trade secrets as that term is defined in California Evidence Code, Section 3426.1, and are reasonably marked “Trade Secrets,” “Confidential” or “Proprietary” and placed in a separate envelope shall only be disclosed to the public if such disclosure is required or permitted under the California Public Records Act or otherwise by law.  Proposers who indiscriminately and without justification identify most or all of their proposal as exempt from disclosure may be deemed non-responsive.  Proposals, excluding confidential information, will be available for review after posting of staff recommendation.

The City anticipates that they will utilize a Disposition and Development Agreement (Agreement) as shown in Attachment D but subject to change at the City’s sole discretion.  The Agreement is expected to contain the terms of purchase, scope, schedule of development, insurance requirements, and conveyance. Upon the Review Committee’s recommendation of a proposal and negotiation of an Agreement, the successful Proposer will be required to execute and return the Agreement in a timely manner. Should the successful Proposer fail or refuse to execute the Agreement, the City reserves the right to withdraw the recommendation/acceptance of the Proposer and, at its discretion, accept the proposal of another Proposer. The Agreement will also include performance requirements such as a one year timeline for successfully obtaining all required building permits, close of escrow based upon aforementioned permitting, and language which reverts the Property back to the City of Fresno in the case of a default of the terms of the agreement by the Proposer. All terms are subject to City Council approval.

A site tour will be held from 10:30 a.m. – 11:30 a.m., on Tuesday August 07, 2018 at the project site, 741 H Street, Fresno, California located on the corner of H and Mono. Prospective Bidders are encouraged to attend since City Staff will be present to answer questions.

A Proposer who has been determined by the City to violate Fresno Municipal Code Section 4-104 may be debarred from bidding or proposing upon or being awarded any contract with the City, or from being a subcontractor or supplier at any tier upon such contract, in accordance with the procedures in Fresno Municipal Code Section 4-104 adopted by Council on May 17, 2018.  The initial period of any such debarment shall not be less than one year and may be permanent.  A Proposer may request a hearing, in accordance with Fresno Municipal Code Section 4-104.  A copy of the Debarment ordinance may be obtained from the City Clerk’s Office, 2600 Fresno Street, Fresno, California 93721.

All responses to the RFQ/P will be evaluated by a Review Committee comprised of representatives from the City and other relevant entities. The Committee reserves the right to reject all proposals or to waive minor irregularities.  The City may enter into negotiations with one or more Proposers concurrently.  The City will select the Proposer who the City determines is in the best interest.  The City is not obligated to select the Proposer who provides the highest purchase price.  The City has no obligation to enter into an agreement with any party in respect to purchase and development of the site as a result of their response to this offering.

The RFQ/P package contains descriptions of the site and other matters that are deemed accurate.  However, the City makes no representations in respect to any factors affecting the development of the site.  Prior to entering into an agreement with the City, it is assumed that the prospective firm(s) will complete their own due diligence.  The cost of preparing any responses to this RFQ/P shall be borne by the respondents and shall not be reimbursed by the City.

The scope of work includes, but is not limited to: An Interior ADA remodel of the Manchester Transit Center located at 3590 N Blackstone Avenue in Fresno, CA. The Construction Allocation for this project is $266,374.

DISADVANTAGED BUSINESS ENTERPRISE (DBE)

It is the policy of the Department of Transportation and the City of Fresno that Disadvantaged Business Enterprises (“DBE”) as defined in 49 CFR part 26, shall have the maximum opportunity to participate in the performance contracts financed in whole or in part with Federal Funds. The national goal for participation of Disadvantaged Business Enterprises (DBE) is 10% the City’s overall goal for DBE participation is 13%.

No specific goals are set on a contract by contract basis.

The goal is accomplished through the use of race-neutral measures in accordance with 49CFR, Part 26.  The City shall take all necessary steps to ensure nondiscrimination in the award of all contracts to meet the objectives of the above cited regulation.  When listing sub-contractors on page 1.8.  Bidder shall identify them as DBE with the approximate value of their sub-contract.

Bidders are advised that any award of the Contract will be conditioned on the successful Bidder meeting the good faith efforts to meet the established goal for this project pursuant to 49 CFR 26.53.
