COMMUNITY FACILITIES DISTRICT NO. 9

Notice is hereby given that on June 28, 2018, the City Council of the City of Fresno (“City”) adopted Council Resolution No. 2018-154 to annex Assessor’s Parcel Number 329-130-17, 18, and 19 to the City of Fresno Community Facilities District No. 9 (“CFD No. 9”) and to authorize the levy of Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”).  Under this City Law and Council Resolution No. 2018-154, the City gives notice as follows:

The text of Council Resolution No. 2018-154, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Council Resolution No. 2018-154 is summarized as follows:

a.            As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 9, the boundaries of which are shown on the map on file with the City Clerk.

b.            The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions.  These improvements include, without limitation, landscaping and irrigation systems, street trees, median hardscaping, local street curbs, gutters, sidewalks, street paving, street name signage and street lights, trails and trail amenities (“Services”).

c.            The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the rate and method of apportionment described in Council Resolution No. 2018-154 and Exhibit C thereto.  The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.

d.            The Special Tax, if approved, will be used to finance all or a portion of the Services.

e.            The Director of Public Works or his designee of the City is directed to cause to be prepared a written report for CFD No. 9, Annexation No. 30 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

f.             As set forth below, the City will hold a public hearing on the annexation of Assessor’s Parcel Number 329-130-17, 18, and 19 to CFD No. 9 with its Services and Special Tax.

g.            The time and place established under Council Resolution No. 2018-154 for the public hearing required under City Law was for Thursday, July 26, 2018, at the hour of 10:05 a.m. and now has been continued to 2:05 p.m., on the same day, or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.

            At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.

            The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 9.

OF THE CITY COUNCIL OF THE CITY OF CLOVIS AMENDING CHAPTER 3.1 OF TITLE 3 OF THE CLOVIS MUNICIPAL CODE PERTAINING TO BUSINESS REGISTRATION AND TAX CERTIFICATES

On July 9, 2018, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance to amend Chapter 3.1 of Title 3 of the Clovis Municipal Code pertaining to Business Registration and Tax Certificates.

The update to the Ordinance changes the title of the current Business License requirement in the Ordinance to a Business Registration and Tax Certificate. City staff undertook a comprehensive review of the existing title of the Business License requirements and determined updating the title to Business Registration and Tax Certificate would reduce confusion on the role of the Business License.

Major substantive changes include: Change the title of the Business License requirement in the Ordinance to a Business Registration and Tax Certificate.

FRESNO LOCAL AGENCY FORMATION COMMISSION

NOTICE IS HEREBY GIVEN that the Fresno Local Agency Formation Commission (LAFCo) will consider the following at a public hearing on August 8, 2018.

City of Fresno “Gettysburg-Bryan No. 1 Reorganization”      A proposed reorganization to annex 158 acres to the City of Fresno and detach      from the North Central Fire Protection District and the Kings River      Conservation District for territory located between West Shaw Avenue and      the Gettysburg Alignment and between North Bryan and North Hayes Avenues.     

Regarding this item, if you are a landowner or registered voter within the territory of the “Gettysburg-Bryan No. 1 Reorganization” as described above, you have protest rights and may file a written protest in opposition to the change of your property. 

LAFCo protest forms can be found on the Fresno LAFCo website (www.fresno.lafco.org) under the “application and documents” tab.  Official LAFCo protest forms should be delivered to the Fresno LAFCo office (address below), or presented to the commission before the end of the public hearing.

NOTICE OF INTENT TO PREPARE AN INTEGRATED REGIONAL WATER MANAGEMENT PLAN

NOTICE IS HEREBY GIVEN that the Southern Sierra Integrated Regional Water Management Group (Group) will prepare an update to its adopted 2014 Integrated Regional Water Management Plan (IRWMP). This update is prepared in accordance with the updated State of California Department of Water Resources IRWMP Guidelines. The IRWMP will include groundwater, surface water, and other water management goals, objectives and identify strategies and projects to implement the IRWMP in a consensus-seeking basis model.

 The Group currently includes 18 Members (participants who have signed the MOU) and over 150 Stakeholders (participating but have not signed the MOU). A map of the Southern Sierra IRWM, as well as a list of each of the Members and stakeholders can be found at the Group’s website: www.southernsierrarwmg.org 

 The Regional Water Management Group formed as a group of agencies, non-profits and landowners and other interested stakeholders. Stakeholders who wish to provide input to the IRWMP may do so by submitting a written letter to Bobby Kamansky, Regional Water Management Group Coordinator, Sequoia Riverlands Trust, 428 S. Garden Street, Visalia, California 93277. Quarterly meetings will be held in June, September to review updated chapters.

 This Notice has been prepared in accordance with Government Code 6066 requirements. Following completion of preparation of the IRWMP, the Group, as well as each member entity, will adopt the IRWMP. Prior to adoption, a Notice of Intent to Adopt the IRWMP will be properly noticed in accordance with Government Code 6066
