EVALUATION OF AN EXISTING GROUNDWATER MONITORING NETWORK

AND ARSENIC AND MANGANESE ASSESSMENT AT THE

FRESNO-CLOVIS REGIONAL WASTEWATER RECLAMATION FACILITY

Overview

The City of Fresno (City), Department of Public Utilities, Wastewater Management Division (WMD) is seeking Statements of Qualifications (SOQ) from environmental consultants with expertise in groundwater studies.

WMD is under Waste Discharge Requirements (WDR) Order No. R5-2018-0080 for the Fresno-Clovis Regional Wastewater Reclamation Facility (RWRF).  The RWRF has a network of 24 monitoring well locations (cluster and individual) for a total of 49 individual monitoring wells.  Wells perforated at depths ranging from 20 to 130 feet below ground surface (ft-bgs) monitor the shallow zone “A” of the unconfined aquifer, and wells perforated at depths ranging from 150 to 250 ft-bgs monitor the intermediate zone “B” of the unconfined aquifer.  In addition, wells in the underlying confined aquifer are perforated at depths of 400+ ft-bgs.  Refer to the RWRF Site Map for existing monitoring well locations.  (Attachment1)

The Consultant shall prepare a workplan for the evaluation of the existing groundwater monitoring network, and its adequacy on characterizing influence on water quality by the RWRF treatment and disposal processes.  In addition, a workplan shall be required for evaluating the impact of arsenic and manganese beneath and downgradient of the RWRF.  The workplans should further evaluate if elimination of any of the existing wells and/or addition of new wells is warranted. 

In accordance with Business and Professions Code sections 6735, 7835, and 7835.1, engineering and geologic evaluations and judgement shall be performed by, or under the direction of, registered professional(s) competent and proficient in the fields pertinent to the required activities.  All technical reports that contain workplans for investigations and studies, that describe the conduct of investigations and studies, or that contain technical conclusions and recommendations concerning engineering and geology, shall be prepared by, or under the direction of, appropriate qualified professional(s) even if not explicitly stated.  Each technical report submitted shall bear qualified professional’s signature and stamp.

Scope of Services

Expected completion date for workplans to be submitted to the WMD is November 15, 2019.

The workplans evaluating the existing groundwater monitoring network and assessing arsenic and manganese compliance at the RWRF shall encompass, but not be limited to, the following:

A.  Groundwater Monitoring Well Network Evaluation and Well Installation Workplan

1.  Evaluate the ability of the existing groundwater monitoring network to characterize upgradient groundwater quality and assess impacts by the RWRF’s treatment and disposal processes.

2.  Ensure adequate monitoring upgradient and downgradient of all disposal ponds and all surrounding restricted areas irrigated with undisinfected secondary effluent.

3.  Evaluate and recommend if proper abandonment of any of the existing wells and/or installation of new wells is warranted.

4.  Prepare workplan in accordance with WDR Order No. R5-2018-0080, including Section 1 of Attachment D, titled “Requirements for Monitoring Well Installation Workplans and Monitoring Well Installation Reports.” (Refer to Attachment 2, page 39)

5.  Provide workplan to WMD for final revision and approval before it is submitted to the Regional Board.

6.  Address concerns/comments from the Regional Board, with subsequent follow up until workplan’s final approval.

B.  Arsenic and Manganese Groundwater Compliance Assessment Workplan

1.  Evaluate the horizontal and vertical extent of elevated arsenic and manganese concentrations in groundwater beneath and downgradient of the RWRF.

2.  Evaluate the impacts elevated concentrations may have on beneficial users located downgradient of the RWRF:

i.  Conduct a survey of domestic wells near the facility.

ii.  Propose a strategy and schedule for sampling impacted wells.

3.  Propose monitoring locations (new and/or existing wells) to determine compliance with the arsenic and manganese Groundwater Limitations stipulated in Section F of the WDR Order No. R5-2018-0080.  (Refer to Attachment 2, page 33)

4.  Prepare workplan in accordance with WDR Order No. R5-2018-0080. (Refer to Attachment 2, page 38)

5.  Provide workplan to WMD for final revision and approval before it is submitted to the Regional Board.

6.  Address concerns/comments from the Regional Board, with subsequent follow up until workplan’s final approval.

Statement of Qualifications Package

The qualified candidate shall have experience developing workplans for the evaluation of an existing groundwater monitoring system and its adequacy on characterizing influence on water quality. Experience in developing groundwater monitoring networks for groundwater influenced by wastewater treatment processes shall also be demonstrated.

Interested candidates are required to submit a Statement of Qualifications which shall include the following information:

1.  Company background and experience in providing groundwater studies consulting services to other municipal agencies.

2.  Identify key staff and their assigned role for this project. Include resumés highlighting relevant project experience and qualifications of which services were rendered during the last three years.

3.  Listing of sub-consultants that may be required to complete the work.

4.  Client references associated with similar completed projects, including contact information.

The proposed schedule for hiring the Consultant is as follows:

Professional consultant services are individually selected for a specific project based upon experience of the consultant, special knowledge of the subject matter, ability to perform the services in the time allowed, record of success on similar work, ability to conduct presentations to City Council, project coordination and key project interaction, as well as fees to be paid.  Ultimately, the consultant selected will be the firm evaluated to provide the best overall value to the City.

The City reserves the right to accept or reject any or all proposals and may select, and negotiate with one or more respondents concurrently.  The City reserves the right to make the selection of a respondent based on any or all factors of value, whether quantitatively identifiable or not, including, but not limited to, the anticipated initiative and ability of the respondent to perform the services set forth herein.  Furthermore, the City reserves the right to modify or adjust the scope and schedule for the project as may be necessary.

Each firm submits a SOQ package at its own risk.  No compensation will be due any firm for preparation of a written SOQ.  The City can cancel the project at any time without consequence.

Consultant selection shall be in accordance with established City consultant selection policy.  Fresno Municipal Code Section 4-109 provides for a local preference to local firms as defined in said section.

The minimum insurance requirements for this project will be professional liability insurance (errors and omissions) with limit of liability of not less than $1,000,000 and commercial general liability of not less than $1,000,000.  The City’s standard contract will be used, which includes a conflict of interest statement and completion of a statement of economic interest.  Copies of the City’s Standard Contract, Local Preference and Consultant Selection Policies are available upon request.  The actual insurance limits may be adjusted during negotiation; however the minimums will remain at $1,000,000.

Regulated Communication in City Procurement Process Ordinance

The Regulated Communications in City Procurement Process Ordinance (Article 6, Chapter 4 of the Fresno Municipal Code) became effective May 7, 2004.  With certain specified exceptions, the Ordinance provides that no Respondent, Bidder, Proposer (as the case may be) shall initiate, engage in, or continue any communication to or with any City elected official concerning or touching upon any matter which is the subject of this competitive procurement process.

Any Respondent, Bidder, Proposer or elected official (as the case may be) who initiates, engages in, continues in, or receives any regulated communication shall file the written disclosure required by the Regulated Communications in City Procurement Process Ordinance.

Any Respondent, Bidder, or Proposer violating the Regulated Communications in City Procurement Process Ordinance may be disqualified from participating in this procurement process and/or determined to be non-responsible.  Additionally, the City may set aside the award of a contract, prior to its execution, to a party found to have violated the Ordinance.

Debarment

Time of completion for the Project shall be Seven Hundred and Thirty-Two (732) calendar days from the date established in the Owner’s Notice to Proceed.

The retention amount on this Project is Five Percent (5%)

Pre-bid conferences will be held on Wednesday, February 20, 20197 at 2:00 pm and on Thursday, February 28, 2019 at 1:00 pm. The pre-bid conference will be held in the parking lot of the future high school, 4100 N. Grantland Avenue, Fresno, CA 93723, located on the northeast corner of Ashlan and Grantland Avenues. This is a non-mandatory pre-bid conference to cover contractor pre-qualifications and to perform a physical job-walk.

The Owner will require the successful Bidder to achieve the minimum goal of 3% DVBE (Disabled Veteran Business Enterprises) established in the bidding documents or to provide acceptable evidence of good faith efforts to do so.  The DVBE documents must be sealed and filed at Room 4 of the District Office of the Central Unified School District, 5652 W. Gettysburg Avenue, Fresno, California, 93722 on Wednesday, March 13, 2019 before 3:00:00 pm, at which time the bids (including the DVBE forms) will be opened in public.

Bids must be accompanied by a bidder’s bond, cashier’s check, or certified check for at least ten percent (10%) of the amount of the base bid and made payable to the Owner.  If a bid bond is used, it must be issued by an Admitted Surety (an insurance organization authorized by the Insurance Commissioner to transact surety insurance in the State of California during this calendar year), which shall be given as a guarantee that the bidder will enter into a Contract if awarded the Work and will be declared forfeited, paid to, or retained by the Owner as liquidated damages if the bidder refuses or neglects to enter into the Contract provided by the Owner after being requested to do so.  The surety insurer must, unless otherwise agreed to by Owner in writing, at the time of issuance of the bond, have a rating not lower than “A-” as rated by A.M. Best Company, Inc. or other independent rating companies.  Owner reserves the right to approve or reject the surety insurer selected by Contractor and to require Contractor to obtain a bond from a surety insurer satisfactory to the Owner.

Bids must be accompanied by an executed Fingerprinting Notice and Acknowledgment. 

Pursuant to the Contract Documents, the successful bidder will be required to furnish a Payment (Labor and Material) Bond in the amount of one hundred percent (100%) of the Contract Sum, and a Faithful Performance Bond in the amount of one hundred percent (100%) of the Contract Sum, said bonds to be secured from Admitted Surety insurers (an insurance organization authorized by the Insurance Commissioner to transact business of insurance in the State of California during this calendar year).  The surety insurers must, unless otherwise agreed to by Owner in writing, at the time of issuance of the bonds, have a rating not lower than “A-” as rated by A.M. Best Company, Inc. or other independent rating companies.  Owner reserves the right to approve or reject the surety insurers selected by the successful bidder and to require the successful bidder to obtain bonds from surety insurers satisfactory to the Owner.  The bidder will be required to furnish insurance as set forth in the Contract Documents.

The successful bidder will be allowed to substitute securities or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the Agreement Between Owner and Contractor and General Conditions.

The Owner will not consider or accept any bids from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors.  In accordance with Section 3300 of said Code, the bidder shall have a Class “B” license and shall maintain that license in good standing through Project completion and all applicable warranty periods.  Bidder shall state the California contractor license number on the Designation of Subcontractors form for all subcontractors doing more than one-half of one percent (0.5%) of the bidder’s total bid.  An inadvertent error in listing a California contractor’s license number shall not be grounds for filing a bid protest or for considering the bid nonresponsive if the bidder submits the corrected contractor’s license number to the Owner within 24 hours after the bid opening, or any continuation thereof, so long as the corrected contractor’s license number corresponds to the submitted name and location for that subcontractor. 

Subcontractors shall maintain their licenses in good standing through Project completion and all applicable warranty periods.  Owner reserves the right to reject any bid as nonresponsive if bidder or any subcontractor is not licensed in good standing from the time the bid is submitted to Owner up to award of the Contract, whether or not the bidder listed the subcontractor inadvertently, or if a listed subcontractor’s license is suspended or expires prior to award of the Contract.  Owner also reserves the right to reject any bid as non-responsive if a listed subcontractor’s license is not in good standing to perform the work for which it is listed from the time of submission of the bidder’s bid to award of the Contract.

This Project is using state bond funds and is therefore subject to labor compliance monitoring and investigative activities by the Compliance Monitoring Unit (“CMU”) of the Division of Labor Standards Enforcement, Department of Industrial Relations of the State of California (“DIR”), in conformance with Labor Code sections 1771.55 and 1771.75, and subchapter 4.5 (commencing with section 16450) of title 8 of the California Code of Regulations.  A prejob conference shall be held with the Contractor and Subcontractors to discuss federal and state labor law requirements applicable to the Project.  The Contractor and Subcontractors shall furnish certified payroll reports to CMU on a weekly basis, using either the format prescribed by section 16401 of title 8 of the California Code of Regulations, or using CMU’s electronic certified reporting system (“eCPR”).  CMU may require the Contractor and Subcontractors to furnish certified payroll reports to CMU using eCPR.  CMU shall review, and may confirm or audit payroll records to verify compliance with Chapter 1, Part 7 of Division 2 of the California Labor Code.  CMU may also conduct on-site visits to each Project job site at its discretion. Contractor shall display a mandatory poster at the Project job site as described by 16451, subd. (d), of title 8 of the California Code of Regulations.  Owner shall withhold contract payments when CMU issues Owner a notice to withhold such payments upon a finding by CMU that payroll records are delinquent or inadequate.  In addition to withholding contract payments based on delinquent or inadequate payroll records, penalties may be assessed for failure to timely comply with a written request for certified payroll records.  Further, upon a finding by CMU that Contractor is liable for unpaid wages or penalties, the Labor Commissioner may issue and serve a Civil Wage and Penalty Assessment.

This Project is subject to prequalification.  If the bidder is not prequalified to bid on this Project, the bid will not be accepted by Owner.  Any subcontractors listed by the bidder for work requiring C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, or C-46 licenses must have current pre-qualified status with the Owner.  Contractor prequalification’s for this project have been advertised and posted to the Facilities Planning webpage on the Central Unified website. A short prequalification period will open February 8, 2019 and must be submitted to the Owner by February 28, 2019 before 3:00 pm. The Owner reserves the right to waive any irregularity and to reject any or all bids.

Unless otherwise required by law, no bidder may withdraw its bid for a period of sixty (60) days after the date set for the opening thereof or any authorized postponement thereof.  The Owner reserves the right to take more than sixty (60) days to make a decision regarding the rejection of bids or the award of the Contract.

Notice of Intent to Adopt a

Mitigated Negative Declaration

California State University (CSU), Fresno (Fresno State) proposes to construct a new, approximate 80,000-gross-square-foot (GSF) Student Union building. The Project would also include demolition of the existing 7,400-GSF Keats building, the 47,000-square-foot amphitheater and 3,000-square-foot stage on the Project site. The building would include lounge spaces, meeting rooms for student clubs and organizations, campus-serving retail services and program spaces, and offices for professional staff affiliated with Fresno State. The building would also include a 12,000-square-foot multi-purpose meeting room accommodating 1,200 seats. Event type and frequency would not increase with the Project.

The Draft Initial Study/Mitigated Negative Declaration concludes that, with project-level mitigation measures incorporated into the Project, no significant environmental impacts relating to the Project would occur. Therefore, adoption of a Mitigated Negative Declaration is proposed for the Project. The CSU Board of Trustees is tentatively scheduled to consider approval of the master plan revision and schematic designs for the Project and adoption of the Mitigated Negative Declaration during its July 2019 meetings.

The Draft Initial Study/Mitigated Negative Declaration for the project are available for public review at the Fresno State Henry Madden Library at 5200 N. Barton Avenue and online at http://fresnostate.edu/adminserv/facilitiesmanagement/campus-projects/index.html. The public review period begins on February 5, 2019 and ends at 5:00 p.m. on March 7, 2019.
