On or about January 14, 2017 January 16, 2018 the County of Fresno will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of the Lead-Based Paint Hazard Control Grant Program (LBPHC) as authorized by Section 1011 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X of the Housing and Community Development Act of 1992, 42 U.S.C. 4852) with funding provided by the Consolidated Appropriations Act, 2017 (Public Law 115-31), approved May 5, 2017. The Lead-Based Paint Hazard Control Program funding is authorized under Section 502 of the Housing and Urban Development Act of 1970 (12 U.S.C. 1701z-2) for the following multi-year program/project, which covers a period of time from January 16, 2018 to January 16, 2021.  The Lead-Based Paint Hazard Control Program will be applied in removing lead hazards from 65 units of low-income housing in Fresno County. The grant will also increase lead awareness through community events, presentations, workshops and meetings, consultations, agency and community-based collaborations, targeted mailings, and build the capacity for maintaining affordable lead-safe housing by providing 20 individuals with lead safety training. The targeted area for the grant includes zip codes 93648, 93662, 93702, 93703, and 93706 in the County of Fresno. The County is requesting the release of $1,000,000.00 of HUD Lead-Based Paint Hazard Control Grant funds and $360,047.42 of County local funds.

The proposed hazard control activities to be funded under this program are categorically excluded from the National Environmental Policy Act requirements, but subject to compliance with some of the environmental laws and authorities listed at § 58.5 of 24 CFR Part 58. In accordance with §58.15, a tiered review process has been structured, whereby some environmental laws and authorities have been reviewed and studied for the intended target areas listed above. Other applicable environmental laws and authorities will be complied with, when individual projects are ready for review. Specifically, the target areas have been studied and compliance with the following laws and authorities have been established in this Tier 1 review:  Airport Hazards, Coastal Barrier Resources, Air Quality, Coastal Zone Management, Endangered Species, Explosive and Flammable Hazards, Farmlands Protection, Floodplain Management, Noise Abatement and Control, Sole Source Aquifers, Wetlands Protection, Wild and Scenic Rivers, and Environmental Justice. In the Tier 2 review, compliance with environmental laws and authorities for the following will take place for proposed projects funded under the program listed above:  Flood Insurance, Contamination and Toxic Substances, and Historic Preservation. Should individual aggregate projects exceed the threshold for categorical exclusion detailed at §58.35(a), an Environmental Assessment will be completed and a separate Finding of No Significant Impact and Request for Release of Funds published. The County of Fresno certifies to HUD that Steven E. White in his capacity as Director of the Department of Public Works and Planning, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Fresno County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the County of Fresno’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Fresno; (b) the County of Fresno has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U.S. Department of HUD, CPD Office, 3rd  Floor, San Francisco Regional Office-Region IX, 600 Harrison Street, San Francisco, CA  94107-1300.  Potential objectors should contact HUD to verify the actual last day of the objection period.

NOTICE INVITING BIDS

Sealed bids or electronic bids will be received at the office of the Purchasing Manager of the City of Fresno for the following:

CLEANING AND DEWATERING OF DIGESTERS #3 AND #10 AT THE FRESNO/CLOVIS REGIONAL WASTEWATER RECLAMATION FACILITY

BID FILE NUMBER: 3572 

The scope of work includes the cleaning of 2 digesters at the Fresno/Clovis Regional Wastewater Reclamation Facility (RWRF), this is part of a rotating maintenance program that was established to improve efficiencies. The digesters #3 and #7 (75 foot diameter and 85 foot diameter, respectively) will contain approximately 10 feet, of accumulated solids consisting of sludge, sand and other debris normally found in wastewater digesters. The work under this contract is to furnish any and all necessary labor, materials and equipment for the removal of access hatches and cleaning of the digesters, this generally includes but is not limited to screening of pumped digester sludge (capable of removing particles ¼ inch and larger), a dewatering process to remove water from the screened sludge resulting in a minimum of 20% bio solids by weight, and transferred to a designated staging area (the fluid separated during dewatering process will be deposited into a plant drain).Then, after the digesters are emptied, any solids on the digester ceiling, walls, floors and equipment must be water blasted until clean as shown on the plans and specified herein.

The Construction Allocation for this project is $275,000.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager, A Bid Deposit, which can be provided separately, in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount.  All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected. An annual 100 percent Material and Labor Bond and an annual 100 percent Performance Bond must be filed with the Contract Documents for the initial year of this Contract and on or before the start of any extension period.  The bonds must be approved by the City before the Contractor enters upon performance of the Work.  In no event shall the bonds securing materials and labor, and performance respectively, provided during the life of this Contract, total less than 100% of the amount payable by City.

Bidders are advised that, as required by the Fresno Municipal Code, the city has established a National Targeted Worker mandatory participation level.
