Plaintiffs allege as follows:

1. Plaintiffs SAY DANG LEE and CHU XIONG are husband and wife and are residents of Fresno County, California.

2. Plaintiff CHAO LEE is a resident of Sacramento County, California.

3. Plaintiffs are informed and believe, and upon such information and belief allege, that Defendants GEORGE TONG LEE, VAH HOUA LEE, GE LEE, KATHY MAIKER LEE, YENG YANG LEE, FUE SUE LEE and YANG LEE are residents of Fresno County, California.

4.  The true names and capacities, whether individual, corporate, associates, or otherwise, of the defendants herein designated as DOES 3 and 5 to 50, inclusive, are unknown to plaintiffs and plaintiffs will ask leave of Court to amend this Complaint to show the true names and capacities when same are ascertained.  Doe 1, designated as Yee Lee, has appeared in this case.  Doe 2, designated as Her Lee, was served and defaulted.  Doe 4, designated as the testate and intestate successors of Yeng Yang Lee, deceased, were served and defaulted.

5. The defendants designated as all other persons unknown, claiming any legal or equitable right, title, estate, lien, or interest in the property described in this complaint, which is adverse to Plaintiffs’ title or creates any cloud on Plaintiff’s title (sometimes referred to as the “unknown defendants”), are unknown to plaintiffs. Each unknown defendant claims some right, title, estate, lien, or interest in the described property, which is adverse to, or creates a cloud on, plaintiffs’ title to that property.

6. Plaintiffs SAY DANG LEE and CHU XIONG are beneficial owners and Plaintiff CHAO LEE is the legal owner of certain property (referred to as “the subject property”), namely street address 8207 North Thompson Avenue, Clovis, California; Fresno County Assessor’s Parcel Number 558-060-05; legal description, as follows:

LOT 28, PARCEL 5 OF PEERLESS ORCHARDS CO. TRACT NO. 1 IN THE UNINCORPORATED AREA, COUNTY OF FRESNO, STATE OF CALIFORNIA, RECORDED IN BOOK 7, PAGE 98 OF PLATS RECORDS OF SAID COUNTY; TOGETHER WITH THAT PORTION OF MONTANA (HARPER AVE.) VACATED LYING BETWEEN LOTS 9 TO 16 AND 17 TO 24 WHICH WOULD PASS BY A CONVEYANCE OF LAND UNDER SECTION 1112 CIVIL CODE.

FIRST CAUSE OF ACTION

(Quiet Title)

7.  Plaintiffs reallege and incorporate herein by reference the allegations contained in paragraphs 1 through 6, inclusive, as though fully set forth. 

8.  Plaintiffs are of Hmong ethnicity and members of the Lee clan.  In 1985 numerous members of the extended Lee clan pooled their recourses to purchase four contiguous lots; identified as Fresno County Assessor’s Parcel Numbers 558-060-05, 558-060-13, 558-060-22 and 558-060-29; of approximately 5 acres each with the common address of 8207 N. Thompson Avenue, Clovis, California. (referred to as “the four-lot property”) The subject property is one of those parcels.

9.  Defendants GEORGE TONG LEE and VAH HOUA LEE, who are the eldest brothers of the Lee clan, acted as trustees and coordinated the above-described purchase and the collection of monies and delivered these monies to the seller.  At the time of completing said purchase, Defendants GEORGE TONG LEE and VAH HOUA LEE held title to the four-lot property in trust.

10.  On or about January 1, 1985, Defendant GEORGE TONG LEE approached Plaintiffs SAY DANG LEE and CHU XIONG, offered to sell them the subject property for $19,500.00, and Plaintiffs SAY DANG LEE and CHU XIONG agreed to purchase the subject property.  They borrowed that sum and paid Defendant GEORGE TONG LEE $19,500.00. 

11. Shortly thereafter, Defendant GEORGE TONG LEE came back to Plaintiffs SAY DANG LEE and CHU XIONG and stated they had not paid enough for the property, even though they had paid everything he asked.  Defendant GEORGE TONG LEE then demanded that Plaintiffs SAY DANG LEE and CHU XIONG pay another $400.00 a month for the next ten years for the subject property, for a total of $48,000.00, which they did. 

12.  Since Plaintiffs SAY DANG LEE and CHU XIONG decided to purchase the subject property, they determined it was appropriate for the subject property to be held by one of their children, rather than in their own names.  They selected their daughter, Plaintiff CHAO LEE.  They requested that she be put on the deed to protect their family’s interest in the subject property.  That deed was recorded on August 5, 1985.  Attached hereto as Exhibit 1 and incorporated herein by this reference is a copy of that deed naming CHAO LEE as one of the owners of the combined properties.  She was incorrectly identified as a single man, but she was named on the deed.

13.  On or about November 10, 2004, someone forged CHAO LEE’S name on a deed, falsely acknowledged that deed, and thereby fraudulently transferred the subject property to Sheng Yang Lee and Cheng Kage Lee, husband and wife.  Attached hereto as Exhibit 2 and incorporated herein by this reference is a copy of that forged deed and falsified acknowledgement, as recorded.  The notarization took place in Orange County, California.

14.  Plaintiff CHAO LEE learned about the forgery and false acknowledgement.  She wrote to R. Sevadjian, the notary of the forged deed.  Her letter to him dated May 18, 2017, is attached hereto as Exhibit 3 and incorporated herein by this reference.  Mr. Sevadjian’s written response is dated May 24, 2017, and is attached hereto as Exhibit 4 and incorporated herein by this reference.  On May 30, 2017, Plaintiff CHAO LEE filed a written complaint with the Secretary of State, Notary Public Section. A copy of that complaint is attached hereto as Exhibit 5 and incorporated herein by this reference.  Attached hereto as Exhibit 6 and incorporated herein by this reference is a copy of the Secretary of State’s response, declining to pursue the matter because the complaint fell outside their statute of limitations and because R. Sevadjian had reported to them in 2009 that he had lost his electronic pin pad and was unable to access his electronic journal. 

15.  For several of the last five years, Dia Vang, the mother of DEFENDANT YANG LEE, has collected money from plaintiffs to pay the property taxes on the subject property.  Plaintiffs have paid the 2013-2014 property tax on the subject property directly to the Fresno County Assessor.

16.  Beginning on or about January 1, 1986 and continuing to the present, plaintiffs have controlled, farmed and otherwise used the subject property for their own purposes.

17.  Defendants GEORGE TONG LEE and KATHY MAIKER LEE held a percentage interest in the entire four-lot purchase and held specific equitable ownership rights to one of the four lots (Lot 5, APN 558-060-29).  In 1998 Defendants GEORGE TONG LEE and KATHY MAIKER LEE wanted to sell their lot.  George’s mother, Defendant YENG YANG LEE, suggested that the Lee clan buy George and Kathy’s interest.  GEORGE and KATHY agreed, and Defendants VAH HOUA LEE and YENG YANG LEE borrowed money from other relatives and friends and purchased George and Kathy’s interest for $50,000.00.  The Lee clan had Defendants convey their interest in the original four-lot property to Defendant FUE SUE LEE, Defendant VAH HOUA LEE’s only son, and Defendant FUE SUE LEE who then held title of the four-lot property in trust.

18.  At some point in time between 1986 and the present, Defendants GEORGE TONG LEE and VAH HOUA LEE conveyed their interest in the four-lot property to Defendant YANG LEE, who then held title to the four-lot property in trust. 

19.  Plaintiffs are informed and believe, and upon such information and belief allege, that at the time of the filing of this Complaint, Defendants FUE SUE LEE and YANG LEE hold title to the four-lot property in trust and are the legal owners of the subject property.

20.  Plaintiffs are informed and believe, and upon such information and belief allege, that Defendants FUE SUE LEE and YANG LEE intend to sell the subject property.

21.  Plaintiffs are informed and believe, and upon such information and belief allege, that Defendants GEORGE TONG LEE, VAH HOUA LEE, KATHY MAIKER LEE, FUE SUE LEE, and YANG LEE claim an interest adverse to plaintiffs in the subject property as present or former owners of the subject property.

22.  The claims of Defendants GE LEE and YENG YANG LEE are unknown.

23. The adverse claims described in paragraphs 15 and 16, and the adverse claims of the unknown defendants described in paragraph 4, are all without any right whatever, and no such defendant has any right, title, estate, lien, or interest whatever in the property or any part of it.

24.  Plaintiffs seek to quiet title to the subject property, against all adverse claims of all claimants, known and unknown, as of January 1, 1986, which is the date plaintiffs obtained equitable title to the subject property.

SECOND CAUSE OF ACTION

(Injunction)

25.  Plaintiffs reallege and incorporate herein by reference the allegations contained in paragraphs 1 through 24, inclusive, as though fully set forth. 

26.  Plaintiffs are informed and believe, and upon such information and belief allege that defendants are interfering with plaintiffs’ use of the subject real property and, in particular, have listed the real property for sale with a real estate agent.

27. Defendants’ actual and continuing interference, unless and until enjoined and restrained by order of this court, will cause grave and irreparable injury to plaintiffs in that plaintiffs will be deprived of use of the subject property.

28. Plaintiffs have no adequate remedy at law for the threatened and continuing conduct in that it would be impossible for plaintiffs to determine the precise amount of damage plaintiffs will suffer if defendants’ conduct is not restrained and plaintiffs will be deprived of the use of the subject property which cannot be compensated in damages.

THIRD CAUSE OF ACTION

(Constructive Trust)

29.  Plaintiffs reallege and incorporate herein by reference the allegations contained in paragraphs 1 through 24, inclusive, as though fully set forth. 

30.  As a proximate result of the defendants’ wrongful conduct as alleged herein, plaintiffs are damaged by the loss of the subject property.

31.  By reason of the wrongful conduct of defendants, or any of them, defendants obtained their alleged right, claim or interest in and to the subject property, and defendants, and each of them, have no legal or equitable right, claim or interest therein, but, instead, defendants, and each of them, are involuntary trustees holding said subject property and profits therefrom in constructive trust for plaintiffs with the duty to convey the same to plaintiffs forthwith.

FOURTH CAUSE OF ACTION

(Cancellation of Deed)

32.  Plaintiffs reallege and incorporate herein by reference the allegations contained in paragraphs 1 through 24, inclusive, as though fully set forth. 

33.  There is in existence a certain written instrument that purports to be a deed to certain real property located in the County of Fresno and described in the deed. The form and contents of the purported deed are as set out in the copy of it that is attached hereto as Exhibit 2 and incorporated herein by this reference.

34.  Plaintiff CHAO LEE did not on or about December 4, 2004, or at any other time, make, sign, or acknowledge the purported deed or authorize any person or persons to do so. Plaintiff CHAO LEE is, and at all times mentioned was, the owner of the land purported to be conveyed by the deed.

35.  On January 3, 2005, the purported deed was recorded in the Official Records of the County of Fresno as Instrument No. 2005-0000154.

36.  Defendants refuse and continue to refuse to reconvey the property back to plaintiff.

37. The conduct of defendants, and each of them, in procuring the forged deed was willful and was intended to injure plaintiffs and to deprive plaintiffs of the property purportedly conveyed by the deed. Plaintiffs therefore seek exemplary and punitive damages according to proof.

WHEREFORE, plaintiffs pray judgment against defendants and each of them, as follows:

AS TO THE FIRST CAUSE OF ACTION:

1. For judgment quieting plaintiffs’ fee simple title to the real property in the name of CHAO LEE, and that defendants have no right, title, or interest in or to the real property;

AS TO THE SECOND CAUSE OF ACTION:

2. For a temporary restraining order, a preliminary injunction, and a permanent injunction prohibiting defendants from interfering with plaintiffs’ use of the real property;

AS TO THE THIRD CAUSE OF ACTION:

3.  For a declaration that defendants hold the real property as constructive trustees for the benefit of the plaintiffs and specifically, CHAO LEE;

AS TO THE FOURTH CAUSE OF ACTION:

4. That the purported deed, Exhibit 2, be declared void.

5. For exemplary and punitive damages.

AS TO ALL CAUSES OF ACTION

Notice of Intent to Adopt a Mitigated Negative Declaration for the

Fowler-McKinley Elementary School Project

NOTICE IS HEREBY GIVEN:

In accordance with the California Environmental Quality Act, the Clovis Unified School District has prepared an Initial Study and proposed Mitigated Negative Declaration for the proposed Fowler-McKinley Elementary School Project. Based on the Initial Study, the District determined that although the project could have a significant effect on the environment, there would not be a significant effect because the District has incorporated into the project mitigation measures that would avoid any significant effects of the project or reduce the effects to an insignificant level.

The Governing Board of the Clovis Unified School District will consider adopting the proposed Mitigated Negative Declaration and approving the project on Wednesday, January 16, 2019, at 6:30 p.m. or as soon thereafter as possible in the District Boardroom, 1680 David E. Cook Way, Clovis, California. You may attend this meeting and present testimony regarding the project.

Project Location and Description: The proposed project includes the acquisition of a 22-acre school site and the construction and operation of an elementary school on the site. The site is located on the northeast corner of Fowler Avenue and the McKinley Avenue alignment in Fresno County, within the City of Fresno sphere of influence.

The elementary school would serve up to 750 students in grades TK-6. The campus would have approximately 28 classrooms, administrative offices, a multi-purpose building, hardcourt areas and athletic fields that could potentially be lighted. The school would have approximately 50 employees, including administrators, faculty, and support staff. The school would be in regular session on weekdays from late August to early June, but may host special events and classes during evenings, on weekends, and during summer recess.

The timing for construction of the school would be dependent on enrollment growth and funding availability. The District estimates that the school could be constructed in approximately five years.

Mitigation Measures: The District has incorporated into the project mitigation measures for potentially significant project impacts related to aesthetics, air quality, biological resources, cultural resources, noise, traffic and tribal cultural resources. The mitigation measures are included in Table 1 of the Initial Study.

Public Review and Comment: The public and interested agencies may review and submit written comments on the proposed Mitigated Negative Declaration and Initial Study. The documents are available for review at the Clovis Unified School District Facility Services Office, 1450 Herndon Avenue, Clovis, California, and on the District’s website: www.cusd.com/facilities-homepage/. The public review period will begin on Monday, October 29, 2018 and end on Wednesday, November 28, 2018.
