Notice of Pre-Qualification to Contractors

The City of Fresno is issuing the pre-qualification package and seeks pre-qualification proposals from Contractors that are interested in constructing a 4.5 MG Storage Tank and Improvements Project, Phase I at the City of Fresno’s Northeast Surface Water Treatment Facility (NESWTF).

The City seeks pre-qualification proposals for:

Northeast Surface Water Treatment Facility(NESWTF) 4.5 MG Storage Tank and Improvements Project, Phase I

Bid File Number: 3626-1

Pre-qualification will be used to pre-qualify contractors to construct the NESWTF 4.5 MG Storage Tank and Improvements Project. The City of Fresno will determine the pre-qualification status of each General Contractor for the Project.  No pricing, prior to the final bidding process will be evaluated.

Pre-qualifications will be evaluated, in accordance with Specifications on file in the office of the Purchasing Manager, at 2600 Fresno St Room 2156, Fresno California, 93721, phone number (559) 621-1332.

A Pre-Qualification Questionnaire can be downloaded from the City’s website at: http://www.fresno.gov. From the City home page, click on “Doing Business”, then click on “Bid Opportunities.” Pre-Qualifications will not be accepted electronically or via fax.

Pre-qualification Documents will be publicly opened and recorded at 3:00 PM on Wednesday, February 20, 2019. All Pre-qualifications must be filed with the Purchasing Manager prior to the opening. After evaluation of the pre-qualified proposals, contractors will be notified in accordance with the schedule in Table 1 below.

Notice is hereby given that the City of Fresno (City) has determined that bidders for the NESWTF 4.5 MG Storage Tank and Improvements Project to be undertaken, must be pre-qualified prior to submitting a bid. It is mandatory that all Contractors who intend to submit a bid (as a prime contractor), possess a Class A Contractors License, fully complete the pre-qualification questionnaire, submit responses on the forms furnished, provide all materials requested herein, and be approved by the City to be on the final qualified Bidders list. No bid will be accepted from a Contractor that has failed to comply with these requirements.

If two or more business entities intend to submit a bid as part of a Joint Venture, or expect to bid as part of a Joint Venture, a pre-qualified Contractor shall serve as the majority partner (greater than 50 percent).

The Pre-qualification package (questionnaire answers and financial statements) submitted by Contractors are not public records and are not open to public inspection.

Answers to questions contained in the attached questionnaire, information about current bonding capacity, notarized statement from surety, and the most recent reviewed or audited financial statements, with accompanying notes and supplemental information, are required. The City reserves the right to check other sources available. The City’s decision will be based on objective evaluation criteria.

Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting qualifications.

The City of Fresno reserves the right to adjust, increase, limit, suspend or rescind the pre-qualification process based on subsequently learned information. Contractors whose qualification changes sufficiently to disqualify them, will be notified and given an opportunity for an appeal hearing consistent with the City appeal procedure in place as adopted by the City Council on April 29, 2003 in Resolution No. 2003-129. Any Bidder wishing to file an appeal should refer to that Resolution. A copy of the Resolution may be obtained from the City Clerk’s Office, located at 2600 Fresno Street, Fresno, California 93721.

Each questionnaire must be signed under penalty of perjury in the manner designated at the end of the form, by an individual who has the legal authority to bind the Contractor on whose behalf that person is signing. If any information provided by a Contractor becomes inaccurate, the Contractor must immediately notify the City and provide updated accurate information in writing, under penalty of perjury.

City of Fresno reserves the right to waive minor irregularities in the information contained in the pre-qualification package submitted, to make all final determinations, and to determine at any time that the pre-qualification procedures will not be applied to a specific future public project.

This project may be federally funded in whole or in part and subject to both Federal and State prevailing wage requirements. In such case, bids must comply with all requirements associated with this funding source, including but not limited to USEPA DBE Compliance and American Iron and Steel.  In addition, the proposers will be required to comply with all requirements associated with the State Revolving Funding (SRF) in carrying out the project. Federal prevailing wage requirements are established pursuant to the federal Davis-Bacon Act, which requires the payment of wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with Subchapter IV of Chapter 31 of Title 40, United States Code. State prevailing wages are established by the Director of the California Department of Industrial Relations under the provisions of section 1773 of the California Labor Code. The federal prevailing wage rates are specified in the “Federal Davis Bacon Wages” included in the bid specifications, and the State prevailing wage rates are on file at Department of Public Works- Capital Management Office, located at 1721 Van Ness, Fresno, CA 93721, and shall be made available to any bidder upon request.

The City of Fresno hereby notifies all Bidders that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation, or on any other basis prohibited by law.
