SUMMARY OF ORDINANCE

On April 26, 2018, the Fresno County Planning Commission unanimously recommended approval (8 to 0, with one Commissioner absent) to amend the zoning provisions of the Ordinance Code of Fresno County to establish three new tiers of wineries to include Wholesale Limited wineries, Micro wineries, and Minor wineries by amending the text of Sections 803.13, 803.17, 816.1, 817.1, 820.1, and 855-N-37 to permit wholesale Limited wineries as a by‐right use in the R‐R (Rural Residential) Zone District and Wholesale Limited, Minor, and Micro wineries as by‐right uses in the AL (Limited Agricultural) and AE (Exclusive Agricultural) Zone Districts per specific standards to be included in Section 855‐N-37.

On June 12, 2018, the Board of Supervisors unanimously adopted Ordinance T-093-377 with additional modifications to include Micro wineries and Minor wineries in the R‐R (Rural Residential) Zone District subject to a discretionary land use permit thereby also amending Sections 820.2 and 820.3 of the Ordinance Code of Fresno County.

In accordance with Government Code Sections 25123, 25131, and 65854‐65857, this Ordinance, designated as Ordinance No. T‐093-377 shall take effect thirty days after its passage.”

Bids are required for the entire work described herein.  Bids will be compared on the basis described in the Bid Proposal.

Bid security in the amount of then (10) percent of the amount of the bid, and in the form of a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance, cash, cashier’s check or certified check shall accompany the bid.  Bid security shall be made in favor of the City of Fowler.

The successful bidder shall furnish a faithful performance and labor and materials bonds each in the amount of 100 percent of the contract amount.  Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Fowler.  Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance and that the City of Fowler will not accept a surety company with a Best’s rating of less than B.

Pursuant to Public Contract Code Section 22300, substitution of securities for any moneys withheld by the City of Fowler to ensure performance under the contract shall be permitted.

BIDDERS are to base their BIDS on the project funding being provided in whole or in part by USDA Rural Development which will review and approve the contract award, contract agreement, partial and final payments, and CONTRACT CHANGE ORDERS.  Payment and retainage will comply with the section of the USDA Supplemental Provisions entitled “Payment to Contractor.”  BIDDERS are notified that this CONTRACT does not permit retainage to be invested for the benefit of the CONTRACTOR.

BIDDERS are notified that financing for this project is provided pursuant to the Consolidated Farm and Rural Development Act (7 U.S.C. Section 1921 et seq.), and that as allowed in Public Contract Code Section 22300, this contract does not provide for substitution of securities for any monies withheld by the OWNER to ensure performance under the CONTRACT.

BIDDERS are notified of the requirement for affirmative action to ensure equal employment opportunity (Executive Order No. 11246) as set forth in the Equal Opportunity Requirements.  If BID amount exceeds $10,000, a completed and executed Compliance Statement/Certifications of Nonsegregated Facilities (RD 400-6) must be submitted with the BID.

If BID amount exceeds $25,000, a signed Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion – Lower Tier Covered Transactions (AD-1048) must be submitted with the BID.

If BID amount exceeds $100,000, a signed RD Instruction 1940-Q, Exhibit A-1, Certification for Contracts, Grants and Loans must be submitted with the BID.
