RESOLUTION NO. 19-201

A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF FRESNO DECLARING ITS INTENTION TO LEVY AN ANNUAL ASSESSMENT UNDER CHAPTER 3 OF THE LANDSCAPING AND LIGHTING ACT OF 1972 IN THE TENAYA PARK ASSESSMENT DISTRICT FOR COUNTY SERVICE AREA NO. 2, AND SETTING A PUBLIC HEARING ON THE PROPOSED ASSESSMENT.

WHEREAS, the County provides park maintenance services, in County Service Area No. 2  – Tenaya Estates (CSA 2), for the park known as Tenaya Park; and

WHEREAS, Government Code, section 25215.3 authorizes the Board of Supervisors (Board), on behalf of CSA 2, to impose a benefit assessment in CSA 2 under the Landscaping and Lighting Act of 1972 (Streets and Highways Code, Division 15, Part 2, beginning with Section 22500) for park maintenance; and

WHEREAS, the Board, by Resolution No. 14-230 on June 17, 2014, formed the Tenaya Park Assessment District, whose boundaries are coextensive with those of CSA 2; and

WHEREAS, the “improvements” for purposes of Streets and Highways Code, section 22525 are generally described as the maintenance of Tenaya Park, which includes landscaping and irrigation systems, lighting and electrical systems, and recreational improvements including playground equipment; and

WHEREAS, there are no substantial changes proposed to be made in existing improvements; and

WHEREAS, the Board has received and approved an engineer’s report, dated May 14, 2019, and prepared by a registered professional engineer certified by the State of California, supporting an assessment in Tenaya Park Assessment District for operation and maintenance of Tenaya Park in CSA 2 in FY 2019-20 (Engineer’s Report); and

WHEREAS, the Engineer’s Report contains a full and detailed description of the improvements, the boundaries of the assessment district, and the proposed assessments upon assessable lots and parcels of land within the Tenaya Park Assessment District; and

WHEREAS, the Engineer’s Report is on file with the Clerk of the Board; and

WHEREAS, before adopting this Resolution, the Board considered all testimony and documentary evidence, and gave all persons a full and fair opportunity to be heard with respect to any matter relating to the subject of this Resolution, both in favor and against it, and any matter relevant to these proceedings, all of which was done in the interest of the public, and the Board is fully informed of all matters referred to in this resolution.

NOW, THEREFORE, THE BOARD OF SUPERVISORS OF THE COUNTY OF FRESNO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:

Section 1.  The above recitals are all true and correct.

Section 2.  The Board hereby declares its intention to levy and collect an assessment in the Tenaya Park Assessment District, under Chapter 3 of the Landscaping and Lighting Act of 1972, for operation and maintenance of Tenaya Park for FY 2019-20. The assessment is not proposed to increase from the previous year, under the definition of “increase” provided by Streets and highways Code, section 22630.5, Government Code, section 54954.6, subdivision (a)(1)(D), and Government Code, section 53750, subdivision (h)(1).

Section 3.  A public hearing of the Board is hereby set for June 4, 2019, at 9:00 A.M., or as soon after as practicable, in the Board Room of the Fresno County Board of Supervisors, Room 301, Hall of Records, 2281 Tulare Street, Fresno, California, 93721, for hearing all objections and protests to the annual assessment, the amount assessed against each parcel, and related matters as set forth in the Engineer’s Report (collectively, Public Hearing).  The Public Hearing shall be held under Sections 22629 through 22631 of the California Streets and Highways Code.  The Public Hearing may be continued from time to time by the Board without further notice, except that it may not be continued to a date after August 10 without prior consent of the County Auditor-Controller/Treasurer-Tax Collector.

Section 4   The Board hereby authorizes and directs the Clerk of the Board to cause notice of the filing of the Engineer’s report, and of the time, date, and place of the Public Hearing to be published under Government Code section 6061, one time, no more than 10 days before the Public Hearing.

Section 5.  Property owners wishing to preserve the opportunity to file a lawsuit challenging the assessment, if levied, must file a written protest and state therein the specific grounds of protest.  Any grounds of protest not stated in a written protest filed prior to the close of the public hearing of protests are deemed waived in any subsequent lawsuit and may not be raised in such lawsuit.

Section 6.  The validity of the assessment announced by the Board of Supervisors shall not be contested in any action or proceeding unless the action or proceeding is commenced within thirty days after the assessment is announced and adopted (Fresno County Ordinance Code, Section 4.28.040).

Section 7.  The Board hereby finds and determines that it took all of the foregoing actions and made all of the foregoing findings in full compliance with the law, including, without limitation, Landscaping and Lighting Act of 1972, Article XIIID of the California Constitution, and any other law referred to in this resolution. All proceedings referred to in this resolution have been taken with respect to the Tenaya Park Assessment District for CSA 2.

Section 8.  This Resolution shall take effect immediately upon its adoption.

Section 9.  The Clerk of the Board shall certify to the adoption of this Resolution and shall cause a certified copy of this Resolution to be filed in the office of the Clerk.

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the County of Fresno.

REQUEST FOR RELEASE OF FUNDS

On or about June 10, 2019 the County of Fresno will authorize Self-Help Enterprises to submit a request to the Department of Housing and Urban Development (HUD) for the release of funds under HOME Investment Partnerships (HOME) Program of Title II of the Cranston-Gonzales National Affordable Housing Act, as amended, 42 U.S.C. 12701 et seq. to undertake a project known as Environmental Assessment No. 7567 for the purpose of the acquisition, development, and construction of a 67-lot single-family subdivision on 13.35 acres. This project is part of a larger development of 151 lots for single-family homes which was approved by the City of Reedley. Project construction will consist of clearing vegetation, grading, installation of streets and utility lines, and construction of project homes. The residences developed on the 67 lots will range in size from approximately 1,240 to 1,435 square feet and will be constructed through Self-Help Enterprises’ (SHE) mutual self-help housing program. Under this program, 8-12 families help each other build their residences with skilled guidance from SHE construction staff. All homes will be marketed to low-income households at or below 80 percent of area median income. As described by the mitigated negative declaration prepared by the City of Reedley, the project is proposed on a 31.02-acre site consisting of four separate parcels, APNs: 363-080-19, 363-080-37, 363-080-35, and 363-062-08S. The portion of the project which SHE will develop is located on three parcels: 363-080-37, 363-080-35, and 363-062-08S. These APNs have been updated since the Mitigated Negative Declaration was published: the complete project is proposed on what is now APNs: 363-080-41, 363-080-37MU, 363-080-37MU, and 363-080-06, with APN 363-080-41 being excluded from SHE’s proposed development. Anticipated funding for the project is provided below:

$1,000,000 SHE (secondary DPA)

FINDING OF NO SIGNIFICANT IMPACT

The County of Fresno has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at 2220 Tulare Street, Suite A, Fresno, CA 93721 and may be examined or copied Mondays through Thursdays, 9 A.M to 5 P.M. and Fridays 8:30 A.M. to 12:30 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the County of Fresno Department of Public Works and Planning, Attn: Chrissy Monfette.  All comments received by June 9, 2019 will be considered by the County of Fresno prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The County of Fresno certifies to HUD that Steven E. White in his capacity as Director of the Department of Public Works and Planning consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County of Fresno to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of fund and the County of Fresno’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Fresno; (b) the County of Fresno has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to U.S. Department of HUD, CPD Office, 3rd Floor, San Francisco Regional Office-Region IX, at One Sansome St., Suite 1200, San Francisco, CA 94104.  Potential objectors should contact HUD to verify the actual last day of the objection period.

REGARDING AMENDMENT OF THE CITY OF FRESNO’S

MASTER FEE SCHEDULE TO 

INCREASE THE EXISTING CITYWIDE IMPACT FEES FOR FIRE FACILITIES

Notice is hereby given that the City Council of the City of Fresno (City) has directed staff to prepare annual updates to the existing development impact fees for fire facilities.  The costs associated with construction of these facilities have increased to the point where an increase in the existing impact fees is warranted.  The time and place established for the public hearing required is as follows:

At the hearing, the written and oral testimony of all interested persons for or against the proposed fee increases, and the rates or methods will be heard.    

1. The Mitigation Fee Act (AB1600, Gov. Code § 66000 et seq.) requires certain findings be made before impact fees may be increased.  The Council will consider an increase to the existing citywide impact fees for fire facilities. These findings are detailed in the reports filed with the City Clerk and are summarized below:

A.     The purpose of the fees are to provide funding mechanisms for orderly acquisition of and installation of fire facilities, as necessary to maintain the current levels of service and mitigate impacts caused by future development in the City of Fresno, and as identified in the City’s 2035 General Plan.

B.     The fees are to be used to purchase property for and finance installation of fire station facilities, fire training facilities, fire equipment maintenance facilities, Fire Department Headquarters, fire trucks, fire engines, and other equipment necessary to staff a fire station.  The fees may also be used to reimburse individuals who construct capital facilities above their conditions of approval and impact fee program administration.

C.     New growth and infill development burden existing fire facilities, requiring upgrades to existing facilities and construction of new public facilities.  An update to the existing fees for fire facilities addresses these issues.

D.     The proposed fees are based on maintaining a level of service consistent with the, goals, policies and objectives of the adopted 2035 General Plan, including the mitigation measures and any statements of overriding considerations adopted with the Master Environmental Report (MEIR) prepared for the Fresno General Plan (SCH # 2012111015) that were made concurrent with the approval process.

2.  The City Council will hold a public hearing regarding the proposed increase to the existing development impact fees for fire facilities.  The City Council will also consider the adoption of resolutions and findings of conformity with the 2035 General Plan for the purposes of amending the Master Fee Schedule and adopting the proposed increased fees.
