COMPUTER AIDED DISPATCH and AUTOMATED VEHICLE LOCATION (CAD/AVL) CONSULTANT

BID FILE No. 3645

FAX will be making system-wide technological enhancements to improve its operational efficiency, security, and customer satisfaction along with its quality of transit service and customer information. FAX intends to replace or upgrade the existing radio based CAD/AVL system to a system that will improve the efficiency transfer rate for the CAD/AVL system providing real-time route and vehicle information via an interface to passengers, dispatchers, and supervisory personnel.

The City of Fresno’s Department of Transportation/Fresno Area Express (FAX) is soliciting proposals for a qualified firm to provide FAX with consultation and expert opinion for a multiphase project to upgrade or replace the existing radio based CAD/AVL system. Consultant will have, at a minimum, three (3) years of extensive experience in all elements of CAD/AVL system design, project management, documentation, contract administration, implementation, and quality assurance/control services. Successful Proposers will also have experience following Federal Transit Administration (FTA) and State of California procurement procedures.

The term of the contract shall commence upon the signing of the agreement by the successful bidder and Fresno Area Express and be in effect for three (3) years. The Proposals received shall become the property of the City of Fresno and are subject to public disclosure.  Those parts of a Proposal which are defined by the Proposer as business or trade secrets as that term is defined in California Civil Code section 3426.1, and are reasonably marked “Trade Secrets”, “Confidential”, or “Proprietary”, and placed in a separate envelope shall only be disclosed to the public if such disclosure is required or permitted under the California Public Records Act or otherwise by law.  Proposers who indiscriminately and without justification identify most or their entire Proposal as exempt from disclosure may be deemed non-responsive.  Proposals, excluding confidential information, will be available for review after posting of staff recommendation.

Upon City’s acceptance of a Proposal, the successful Proposer will be required to execute and return a City Standard Consulting Agreement without changes and all certificates of insurance within ten (10) calendar days from the date of Notice of Award issued by the City.  Should the successful Proposer fail or refuse to execute the Agreement or provide the additionally required instruments and documentation, the City reserves the right to accept the proposal of the Proposer offering the next best value to the City.

A Proposer who has been determined by the Council to be non-responsible may be debarred from bidding or proposing upon or being awarded any contract with the City of Fresno, or from being a subcontractor or supplier at any tier upon such contract, in accordance Fresno Municipal Code Section 4-104 adopted by Council on May 17, 2018.  The initial period of any such debarment shall not be less than one (1) year.  A Proposer may request a hearing, in accordance with Fresno Municipal Code Section 4-104, upon receipt of a notice of proposed debarment from the City Manager or his/her designee. A copy of Fresno Municipal Code Section 4-104 may be obtained from the City Clerk’s Office, 2600 Fresno Street, Fresno, California 93721.

Although there is no specific goal or requirement to use participation by Disadvantage Business Enterprises (DBE) for this project, the City of Fresno highly encourages the participation of Disadvantaged Business Enterprises (DBE). The City of Fresno encourages all prime Contractors to utilize qualified SBE (Small Business Enterprise) sub-Contractors on the City of Fresno projects, and promotes the direct purchase of goods from qualified SBEs by utilizing SBE/DBE vendors when such vendors are available and the price of the goods or services sought is reasonable.

The Contractor is required to comply with all terms and conditions prescribed for third-party contracts by the U.S. Department of Transportation, Federal Transit Administration (FTA). If FTA requires any change to this Contract to comply with its requirements, both parties agree to amend the Contract as required by FTA. If such changes cause an increase or decrease in the work to be performed by the Contractor or the time for such performance, then the compensation to be paid the Contractor and time of performance shall be equitably adjusted.

NIB 4.1 Applicable FTA Guidance

CITY OF CLOVIS

SUMMARY OF ORDINANCE

2019 HOUSING LEGISLATION

On December 16, 2019, the City Council of the City of Clovis adopted Urgency Ordinance No. 19-21 which amends various sections of Title 9 of the Clovis Municipal Code (“Development Code”) to bring the Development Code into compliance with recently enacted State laws (“2019 Housing Laws”) related to procedures and standards for housing development projects, density bonus, accessory dwelling units (“ADUs”), and other housing-related concerns.

The interim ordinance does the following:

Chapter 9.26 of Title 9: Adds a new category of housing developments eligible for a density bonus, along with the corresponding density bonus and the number of incentives or concessions for which such housing developments are eligible.

Section 9.40.020 of Title 9: Replaces Section 9.40.020 in its entirety to reflect the standards, procedures, and permitted accessory dwelling unit (“ADU”) and junior accessory dwelling unit (“JADU”) structures required by Government Code sections 65852.2 and 65852.22.

Section 9.40.200 of Title 9: Adds Low Barrier Navigation Center developments as a use by right in areas zoned for mixed use and nonresidential zones permitting multifamily uses, if State law requirements are satisfied.

Chapter 9.50 of Title 9: Adds a procedure for filing a preliminary application for housing developments and the effect thereof; adds procedures and timelines for review, acceptance, and approval of preliminary and final applications for housing developments; adds special requirements for housing developments in urbanized areas; revises and expands procedures and timelines for streamlined ministerial review of certain housing development projects, including moderate-income multifamily housing.

Chapter 9.77 of Title 9: Adds a chapter that establishes and incorporates objective standards for housing developments and a ministerial review process for qualifying housing developments.
