Notice is hereby given that on September 26, 2024, the City Council of the City of Fresno (“City”) adopted Council Resolution No. 2024-236 to annex the territory known as Assessor’s Parcel Number 511-250-02 to the City of Fresno Community Facilities District No. 9 (“CFD No. 9”) and to authorize the levy of Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”).  Under this City Law and Council Resolution No. 2024-236, the City gives notice as follows:
The text of Council Resolution No. 2024-236, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Council Resolution No. 2024-236 is summarized as follows:
a.            As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 9, the boundaries of which are shown on the maps on file with the City Clerk.
b.            The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions.  These improvements include, without limitation, landscaping and irrigation systems, street trees, median hardscaping, local street curbs, gutters, sidewalks, street paving, street name signage and streetlights, trails and trail amenities (“Services”).
c.            The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the rate and method of apportionment described in Council Resolution No. 2024-236 and Exhibit D thereto.  The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.
d.            The Special Tax, if approved, will be used to finance all or a portion of the Services.
e.            The Director of Public Works or his designee of the City is directed to cause to be prepared a written report for CFD No. 9, Annexation No. 63 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.
f.             As set forth below, the City will hold a public hearing on the annexation of the territory known as Assessor’s Parcel Number 511-250-02 to CFD No. 9 with its Services and Special Tax.
g.            The time and place established under Council Resolution No. 2024-236 for the public hearing required under City Law are Thursday, October 31, 2024, at the hour of 9:10 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.
            At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.
   The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 9.

NOTICE IS HEREBY GIVEN that the Clovis Unified School District (CUSD) has prepared a Draft Initial Study-Mitigated Negative Declaration (IS-MND) for the project listed above (State Clearinghouse Number 2022110544) pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15000 et seq. PROJECT LOCATION: The project site is located at the southeast corner of the intersection of Herndon Avenue and North Fowler Avenue, on approximately 5.08 acres within Assessor’s
Parcel Number: 550-020-47T, owned by CUSD. See Figure 1 for a map of the project site. The project site does not contain hazardous waste sites identified on lists compiled pursuant to
Government Code Section 65962.5.
PROJECT DESCRIPTION: The proposed project consists of Phase II of a multi-phased CUSD office development. Phase II would construct four buildings and associated site infrastructure, including parking, required for an administration office building (Building A) and shop buildings (Buildings B, C, and D). Building A would be 11,848 square feet, Building B would be 2,099 square feet, Building C would be 9,337 square feet, and Building D would be 13,818 square feet. All four buildings would be constructed from type v-b, pre-manufactured metal and would have six-foot-tall rooftop parapet walls. The proposed buildings would exceed Title 24 Building Energy Efficiency Standards by approximately 3.5 percent. The project would include low flow plumbing fixtures as water conservation measures. The proposed project also includes the installation of three air compressors and five heating, ventilation, and air conditioning units. Project construction is anticipated to occur between 7:00 AM and 3:30 PM for approximately 14 months beginning in January 2025.
The shop buildings would each contain various tools and machinery. The southern end of Building C would be used as a grounds environmental safety storage room. The southern end of Building D would be used as a concrete grading room. Operational activities would not include students on-site.
ENVIRONMENTAL DETERMINATION:
Pursuant to the requirements of CEQA, an Initial Study was prepared for the project. The Initial Study describes the environmental impacts of the project and suggests mitigation measures where necessary to reduce impacts to biological resources, cultural resources, geology and soils (paleontological resources), hazards and hazardous materials (potential agricultural chemical
presence), and tribal cultural resources to less-than-significant levels. The proposed mitigation measures will be implemented as part of the project to ensure the project will not generate a significant adverse impact on the environment during construction or operation. Based on this assessment, a Mitigated Negative Declaration has been prepared.

Contractors and Subcontractors at every tier shall be required to comply with Education Code section 17407.5 and Public Contract Code sections 2600-2602, which require the Contractor and its subcontractors at every tier to employ a skilled and trained workforce.  Contractors must identify experience complying with this requirement and a proposed plan to ensure that the appropriate percentage of the workforce employed on the Project are graduates of an apprenticeship program.
Public works projects shall be subject to compliance monitoring and enforcement by the Department of Industrial Relations. A contractor shall not be qualified to submit a proposal unless currently registered and qualified under Labor Code section 1725.5 to perform public work as defined by Division 2, Part 7, Chapter 1 (§1720 et seq.) of the Labor Code. A contractor or subcontractor shall not be qualified to enter into, or engage in the performance of, any contract of public work (as defined by Division 2, Part 7, Chapter 1 (§1720 et seq.) of the Labor Code) unless currently registered and qualified under Labor Code Section 1725.5 to perform public work.
Pursuant to Labor Code sections 1770 to and including 1781, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work in the locality in which the work is to be performed for each craft, classification, or type of worker needed to execute the agreement. Contractor and each subcontractor shall pay not less than the specified prevailing rates of wages to all workmen, including apprentices, employed in the execution of the Agreement. A contractor and any subcontractor that pays less than the specified prevailing rates of wages are subject to penalties under applicable laws, including Labor Code section 1775. Copies of the prevailing rate of per diem wages are on file at the Contractor’s principal office and at the job site, which copies shall be made available to any interested party on request.
David A. Bush, Inc. is seeking proposals from subcontractors for this project.  Proposals from DVBE contractors are encouraged.
Pre-Bid Meeting: There will be no pre-bid meeting.
Completion for this project shall be as established in the Owner’s Notice to Proceed. All durations, activities and sequences for the subcontractors shall be performed as shown in the Construction Bid Schedule and Section 01320 of the specification and as modified by a monthly schedule update, if any.

In accordance with Section 3300 of said Code, the Contractor shall have the license classification as required by the State of California Contractor’s License Board and shall maintain that license in good standing through project completion and all applicable warranty periods.
Unless otherwise required by law, no bidder may withdraw its bid for a period of 45 days after date set for the opening thereof. The Owner reserves the right to waive any irregularity and to reject any or all bids.
