CITY OF CLOVIS SUMMARY OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLOVIS AMENDING SECTION 4.5.1014, OF CHAPTER 4.5, OF TITLE 4, OF THE CLOVIS MUNICIPAL CODE PERTAINING TO COMMERCIAL VEHICLE PARKING

On November 13, 2018, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council will consider a request amending section 4.5.1014, of chapter 4.5, of title 4, of the Clovis Municipal Code pertaining to commercial vehicle parking.  The proposed ordinance will place limitations on commercial vehicle parking.  No person shall park any of the following commercial vehicles on any public street, alley, right of way, or highway, other than a state highway, in the City of Clovis for a period of more than four (4) hours in any twenty four (24) hour period:

(1) Commercial trucks larger than one-ton size not to exceed a gross vehicle weight rating of more than 15,000 pounds;

(2) Buses;

(3) Commercial trailers of all types.

No person shall park commercial vehicles as defined above on a public street within 500 feet of a residential zone district between the hours of 10:00 p.m. and 7:00 a.m. after the effective date of this ordinance.

NOTICE INVITING BIDS

Sealed bids or electronic bids will be received at the office of the Purchasing Manager of the City of Fresno for the following:

REQUIREMENTS CONTRACT FOR PERMANENT ASPHALT CONCRETE PAVEMENT REPAIRS

BID FILE NUMBER: 9484

The scope of work includes: This requirements contract is to furnish and install permanent asphalt concrete pavement repairs.

The Contract term is for one (1) year, with provisions for three (3) one-year extensions. 

The Annual Estimated Requirements Allocation for this project is $1,500,000.

Bids will be taken on complete work, in accordance with Plans and Specifications on file in the office of the Purchasing Manager, 2600 Fresno St Room 2156 Fresno California, 93721 , phone number (559) 621-1332.

Bids may be submitted electronically or by paper only not via fax.

Bid Proposals must be filed with the Purchasing Manager prior to the bid opening at 3 p.m. on Tuesday, November 27, 2018 when the bids will be publicly opened and recorded.

The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code.  The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City.  A copy of the resolution is on file at the Office of the City Clerk.  Actual wage schedules are available at Construction Management Office, 1721 Van Ness Avenue, Fresno, California 93721, (559) 621-5600.

Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager. A Bid Deposit, which can be provided separately, in the amount of TEN PERCENT(10%) of the Total Net Bid amount, in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount.  All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected. Copies of Bid Deposits may be submitted electronically, with the exception of a cashier’s check, which must be brought to the Purchasing Managers office and labeled accordingly with bid number.

The City of Fresno hereby notifies all Bidders that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation, ethnicity, status as a disabled veteran or veteran of the Vietnam era or on any other basis prohibited by law.

A pre-bid conference will be held at 10:00 a.m., on N/A , 2018, in the N/A at the Division located at , Fresno, California.  Prospective Bidders are encouraged to attend since City Staff will be present to answer any questions regarding the Specifications, and there may be an inspection tour of the job site(s).

In accordance with provisions of section 22300 of the California Public Contract Code, Contractor may substitute securities for any monies withheld by City to ensure performance under the Contract.

An annual 100percent Material and Labor Bond and an annual 100percent Performance Bond must be filed with the Contract Documents for the initial year of this Contract and on or before the start of any extension period.  The bonds must be approved by the City before the Contractor enters upon performance of the Work. In no event shall the bonds securing materials and labor, and performance respectively, provided during the life of this Contract, total less than 100% of the amount payable by City.

Bidders are advised that, as required by the Fresno Municipal Code, the city has established a National Targeted Worker mandatory participation level.

Bidders are advised that as required by the Fresno Municipal Code, the City of Fresno is implementing new National Targeted Worker requirements for public work of improvement contracts over $200,000. The mandatory participation level for National Targeted Workers is 15%.

No bid will be considered for award unless the Bidder at the time of bid opening, is licensed with a valid Class “A” or “C12” Contractor’s License issued by the State of California.

TCP Mitigation Project – Group 1 – Well 17 and Well 37

General Work Description: The work to be done consists of furnishing all labor, materials and equipment necessary to construct two (2) new Granular Activated Carbon treatment facilities, in the City of Tulare.  The work will include; Demolition, Clearing and Grubbing, Site Grading, Aggregate Base Surfacing, Site Piping, GAC Vessels, Vessel Installation and Testing, Vessel Foundation and Site Concrete, Washwater Disposal System, Chemical Piping, Chemical Storage Enclosures, Access Gates, and Electrical, Instrumentation and Controls.

Plan Holder: To be considered a plan holder and to receive any Addendums or other pertinent information, bidders must register by email, telephone, or in person at the Fresno office of Provost and Pritchard Consulting Group to Jennifer Tucker, jtucker@ppeng.com. Bidders may also be added to the plan holders list at the mandatory pre-bid meeting.  Bidders must be registered on the plan holders list for their bid to be considered responsive.  Plan holder names may be obtained from Provost and Pritchard Consulting Group (559)449-2700.

Documents: Construction documents including the plans, Bid/Contract Documents can be obtained at the office of Provost and Pritchard Consulting Group, 286 W. Cromwell Avenue, Fresno, CA 93711. A non-refundable fee of $80.00 per set will be charged. An additional fee of $15.00 will be charged for sets mailed to perspective bidders.

Under the “Departments” tab, select “Engineering” under Development Services subheading under Community Development heading, and then select “City Projects.”

Bid Security, Bonds, and Insurance: Pursuant to California Public Contract Code Section 20170, each bid proposal must be accompanied by cash, certified or cashier’s check, or bidder’s bond, made payable to the City of Tulare for an amount equal to at least ten (10%) of the amount of the proposal, such guarantee to be forfeited should the bidder to whom the contract is awarded fails to enter into a contract.

The successful bidder shall furnish the payment bond, performance bond, a maintenance/warranty bond, workers compensation certificate, and all other insurance requirements identified in the Bid/Contract Document.

Substitution of Securities: Pursuant to Section 22300 of the California Public Contract Code, the Contractor may request the City to make retention payments directly to an escrow agent or may substitute certain securities for money withheld by the City to ensure performance under the Contract.

Award of Contract: All proposals will be compared on the basis of the Engineer’s Opinion of Probable Construction Cost of the work to be done and the Engineer’s evaluation of bidder’s performance on prior public works construction projects as cited by bidder in the bid proposal.

All bidders are invited to attend the bid opening. The results of the bid opening will be reported to the City Council (and/or Board of Public Utilities) of the City of Tulare at a regularly scheduled City Council or Board meeting. The contract will be awarded in the manner and within the time periods provided in Bid/Contract Document and as amended by the project Special Provisions and/or any Addenda.

The right is reserved by the City of Tulare to reject any and all bids, to waive any informality in the bids received, and to evaluate the bids submitted and to award the contract according to the proposal which best serves the interest of said City.

Contractor Licenses: Pursuant to California Public Contract Code Section 3300, the Contractor shall possess a valid California Contractor’s Class A, General Engineering License at the time this contract is awarded and shall maintain a current and valid license throughout the duration of the project. Failure to possess the specified license(s) at the time the bid is submitted shall render the bid non-responsive.

City Business Licenses: The Contractor and all subcontractors listed in the Bid/Contract Document shall have a valid City of Tulare Business License at the time the contract is awarded.

Time of Completion: Contractor shall complete all work contained in the construction documents within 140 working days.

Engineer’s Opinion of Probable Construction Cost: The engineer’s opinion of probable construction cost is: $3,675,000.

Mandatory Pre-Bid Meeting: A mandatory pre-bid meeting will be held on November27,2018 at 3:00 PM to entertain questions and to provide general project information. The meeting will be held at – Tulare City Hall Community Room, 411 E. Kern Ave. Tulare, California, 93274.

Non-Discrimination: The City of Tulare affirms that in any contract entered into pursuant to this advertisement, that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprise, Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

Prevailing Wage Rates: Pursuant to Section 1770 through 1780 inclusive of the California Labor Code, the general prevailing wage rates in Tulare County, in which the work is to be done, have been determined by the Director of the California Department of Industrial Relations. These wage rates are set forth in the General Prevailing Wage Rates for this project, available at the City of Tulare and available from the California Department of Industrial Relations’ Internet web site:

It shall be mandatory upon the Contractor to who the Contract is awarded and upon any subcontractor to pay not less than the specified rates to all workers employed in the execution of the Contract.  The Contractor shall cause a copy to be posted at the job site.
