NOTICE IS HEREBY GIVEN that the Receiver in the above-captioned lawsuit will sell the Real Property described herein for the sum of $14,500,000.00, or to the highest bidder at public auction, at the Confirmation of Sale Hearing (“Hearing”), to be heard on October 12, 2023, at 3:30 p.m., in Department 502 of the Fresno County Superior Court, B.F. Sisk Courthouse, located at 1130 ‘O’ Street, Fresno, California 93721.
The Real Property is being sold in accordance with the Order dated April 17, 2023, granting the Plaintiff’s Application for the Appointment of a Receiver, in which the Court appointed Dennis L. Bergquist as Receiver and Partition Sale Referee (collectively “Receiver”) for the purpose of, among other things, selling the real property located on the east side of Auberry Road, approximately one-half mile north of Copper Avenue, in Fresno County, which consists of eight (8) parcels totaling 271.20 acres of land, which is legally described in Exhibit A and depicted in Exhibit B, both of which are attached hereto and incorporated herein by this reference (the “Real Property”).
Prospective bidders should refer to Sections 701.510 to 701.680, inclusive, of the California Code of Civil Procedure for provisions governing the terms, conditions, and effect of the sale and the liability of defaulting bidders. The sale is subject to overbid and Court confirmation. If interested in submitting an overbid, please contact the Receiver’s real estate broker, Dan Kevorkian (“Mr. Kevorkian”) at Pearson Realty, who can be reached at (559) 447-6237, dkevorkian@pearsonrealty.com, or 7480 N. Palm Ave., Ste. 101, Fresno California 93711, for the form of Purchase and Sale Agreement, questions and/or directions to the Real Property.
To qualify as a bidder, prior to the Hearing, prospective bidders must provide a cashier’s check to Mr. Kevorkian, in the amount of $423,072.00, made payable to Chicago Title Company (“Deposit”), along with proof of funds in an amount equal to or greater than the amount they intend to bid at the Hearing. The minimum overbid is $14,550,000, with bidding increments of $50,000.00 thereafter until a winner/buyer is determined.
Except for price, any overbids are subject to the same terms and conditions as in the pending Purchase and Sale Agreement. The original offeror will have the right to match any bid at the Hearing. If the original offeror matches an offer, and there are no additional overbids, then the original offeror will be the highest bidder/buyer. All overbids that are not accepted will receive their Deposit back at the end of the Hearing.
Any overbid(s) and accompanying Deposit(s) should be submitted to Mr. Kevorkian by 5:00 p.m., Pacific Standard Time, on October 10, 2023.

NOTICE IS HEREBY GIVEN that Del Rey Community Services District (District) invites and will receive sealed proposals (bids) up to the hour of 2:00 p.m. on October 19, 2023 for the furnishing to said District of all transportation, labor, materials, tools, equipment, services, permits, utilities, and other items necessary to construct said work. Description of Work: The project involves construction of granular activated carbon (GAC) wellhead treatment facilities for removal of TCP for the District’s Wells 4, 5, and 7 with facilities also located at the Well 6 site for treatment of water from Well 5. Work includes offloading and setting of GAC vessels, assembling piping, and miscellaneous equipment supplied by a separate GAC vessel and carbon supplier retained by the District. Work also includes 750 feet of water main, electrical and control equipment, a new standby generator, prefabricated concrete buildings, bolted-steel tanks, and miscellaneous site work.
Each bid shall be submitted on a form furnished as part of the Contract Documents and must be accompanied by cash, a cashier’s check, a certified check, or a bidder’s bond executed by an admitted surety insurer or substitute pursuant to Section 995.710 of the Code of Civil Procedure in an amount not less than 10% of the amount of the bid, made payable to the order of or for the benefit of the District. The security of unsuccessful bidders will be returned by the District no later than sixty (60) days following the date of award. Each bid shall be sealed and delivered to the District at the location designated in this notice for the opening of proposals at or before the time in this notice provided. The check or bond or substitute shall be given as security that the bidder will enter into a contract with the District and furnish the required payment and performance bonds, or substitutes in lieu thereof, and certificates of insurance and endorsements if awarded the work, and will be declared forfeited if the bidder refuses to timely enter into said contract or furnish the required bonds or substitutes, or certificates of insurance and endorsements if their bid is accepted.
The District has obtained from the Director of the California Department of Industrial Relations a determination of the general prevailing rate of per-diem wages and the general prevailing rate for legal holiday and overtime work in the locality in which said work is to be performed for each craft, classification, or type of worker needed. Not less than the determined rates shall be paid to all workers employed in the performance of the contract. Such rates of wages are included with these Contract Documents and are on file with the Department of Industrial Relations (http://www.wdol.gov/dba.aspx) and in the office of the District.
Pursuant to Public Contract Code Section 22300, equivalent securities may be substituted for monies withheld to ensure performance of the contract. The District reserves the right to solely determine the adequacy of the securities being proposed by the Contractor and the value of those securities. The District shall also be entitled to charge an administrative fee, as determined by District in its sole discretion, for substituting equivalent securities for retention amounts. The District’s decisions with respect to the administration of the provisions of Section 22300 shall be final and shall include, but not be limited to, determinations of what securities are equivalent, the value of the securities, the negotiability of the securities, the costs of administration and the determination of whether or not the administration should be accomplished by an independent agency or by the District. The District shall be entitled, at any time, to request the deposit of additional securities of a value designated by District, in District’s sole discretion, to satisfy this requirement. If the District does not receive satisfactory securities within twelve (12) consecutive days of the date of the written request, District shall be entitled to withhold amounts due Contractor until securities of satisfactory value to District have been received.

REQUEST FOR PROPOSALS
