REGARDING ANNEXATION OF TERRITORY TO
CITY OF FRESNO
COMMUNITY FACILITIES DISTRICT NO. 9
ANNEXATION NO. 17
Notice is hereby given that on August 3, 2017, the City Council of the City of Fresno (“City”) adopted Resolution 2017-200 to annex territory associated with the development of Assessor’s Parcel Number 313-280-73 and 313-280-75, Conditional Use Permit No. 2014-057, as Annexation No. 17 to the City of Fresno Community Facilities District No. 9 (“CFD No. 9”) and to authorize the levy of Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”).  Under this City Law and Resolution 2017-200, the City gives notice as follows:
The text of Resolution 2017-200, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Resolution 2017-200 is summarized as follows:
a.            As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 9, the boundaries of which are shown on the map on file with the City Clerk.
b.            The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions.  These improvements include, without limitation, landscaping and irrigation systems, street trees, median hardscaping, local street curbs, gutters, sidewalks, street paving, street name signage and street lights, trails and trail amenities (“Services”).
c.            The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the rate and method of apportionment described in Resolution 2015-200 and Exhibit C thereto.  The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.
d.            The Special Tax, if approved, will be used to finance all or a portion of the Services.
e.            The Director of Public Works or his designee of the City is directed to cause to be prepared a written report for CFD No. 9, Annexation No. 17 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.
f.             As set forth below, the City will hold a public hearing on the annexation of the territory associated with the development of Assessor’s Parcel Number 313-280-73 and 313-280-75, Conditional Use Permit No. 2014-057, as Annexation No. 17 to CFD No. 9 with its Services and Special Tax.
g.            The time and place established under Resolution 2017-200 for the public hearing required under City Law are Thursday, August 31, 2017, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.
            At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.
            The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 9.

NOTICE IS HEREBY GIVEN that the Fresno Local Agency Formation Commission (LAFCo) will consider the following at a public hearing on September 13, 2017:
1.  Municipal Service Review and sphere of influence update for the Kingsburg Cemetery District.

 No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer.  Each bid must be accompanied by a certified or cashier’s check or bidder’s bond, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid.  Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract.  A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded.  Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Clovis.  Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance.  Pursuant to Public Contract Code Section 22300, substitution of securities for any monies withheld by the City of Clovis to ensure performance under the contract shall be permitted.  In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.
 In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done.  Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612.  A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.
 All bids are to be compared on the basis of the Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form.  The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”.  Bidders for this project must possess a valid Class C33 License with experience in elevated tanks prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available.  Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract.  All representations made on the proposal are made under penalty of perjury.

REQUESTS FOR PROPOSALS
(Education Code § 17406)
Notice is hereby given that Caruthers Unified School District (hereinafter referred to as “Owner”) has issued a Request for Sealed Proposals for Lease-Leaseback Construction Services (“RFP”) for the (1) construction and/or installation of new classroom buildings, (2) modernization of existing classroom facilities at Caruthers Elementary School, and (3) construction of a new central kitchen. The District intends to award contracts for these projects to one contractor determined to be the best value under the provisions of Education Code 17406 et seq. 
The RFP is issued in accordance with Education Code section 17406. The award of an agreement for Lease-Leaseback Construction Services will be determined on a best value basis as detailed in the RFP. Copies of the RFP may be obtained from the District’s website: http://www.caruthers.k12.ca.us/, or by emailing dhaney@caruthers.k12.ca.us.  Owner will receive sealed proposals in response to the RFP no later than September 5, 2017, at 3:00, p.m. on the clock designation by the Owner or its representative as the governing clock, at the District Office located at: 1 Tiller Ave, Caruthers, California.
An optional site walk will be held on August 29, 2017, at 2:00 p.m. at Caruthers Elementary School located at 13699 S. Quince, Caruthers, California.  Immediately following the site walk at Caruthers Elementary School, a subsequent site walk will be held at Caruthers High School located at 2580 W. Tahoe Avenue. Whether or not Contractors attend the optional site walks, which will include the opportunity to inspect the site, may include dissemination of additional information in response to questions or otherwise, all Contractors will be deemed to have notice of all conditions and information which Contractors could have obtained by attending the optional site walks, including but not limited to any conditions in, at, and about the site, the building or buildings, if any, and any work that may have been done thereon.
Public works projects shall be subject to compliance monitoring and enforcement by the Department of Industrial Relations.  A contractor or subcontractor shall not be qualified to submit a proposal or to be listed in a proposal subject to the requirements of Public Contract Code section 4104 unless currently registered and qualified under Labor Code section 1725.5 to perform public work as defined by Division 2, Part 7, Chapter 1 (§§1720 et seq.) of the Labor Code.  A contractor or subcontractor shall not be qualified to enter into, or engage in the performance of, any contract of public work (as defined by Division 2, Part 7, Chapter 1 (§§1720 et seq.) of the Labor Code) unless currently registered and qualified under Labor Code section 1725.5 to perform public work.
The Owner will require the successful contractor to achieve the minimum goal of 3% DVBE (Disabled Veteran Business Enterprises) established in the RFP or to provide acceptable evidence of good faith efforts to do so. 
Pursuant to the Contract Documents, the successful contractor will be required to furnish a Payment (Labor and Material) Bond for each Project in the amount of one hundred percent (100%) of the Total Sublease Amount, and a Faithful Performance Bond in the amount of one hundred percent (100%) of the Total Sublease Amount, said bonds to be secured from Admitted Surety insurers (an insurance organization authorized by the Insurance Commissioner to transact business of insurance in the State of California during this calendar year).  The surety insurers must, unless otherwise agreed to by Owner in writing, at the time of issuance of the bonds, have a rating not lower than “A-” as rated by A.M. Best Company, Inc. or other independent rating companies.  Owner reserves the right to approve or reject the surety insurers selected by the successful contractor and to require the successful contractor to obtain bonds from surety insurers satisfactory to the Owner.  The contractor will be required to furnish insurance as set forth in the Contract Documents.
The successful contractor will be allowed to substitute securities or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the General Conditions.
The Owner will not consider or accept any proposals from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors.  In accordance with Section 3300 of said Code, the contractor shall have a Class “B” license and shall maintain that license in good standing through completion of both Projects and all applicable warranty periods. 
The Director of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate of per diem wages and rate for legal holidays and overtime work.  The Contractor must pay for any labor therein described or classified in an amount not less than the rates specified.  Copies of the required rates are on file at the Owner’s business office and are available to any interested party on request.
