MITIGATED NEGATIVE DECLARATION
Notice is hereby given that the County of Fresno has prepared Initial Study (IS) No. 8631 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:
INITIAL STUDY NO. 8631 and CONDITIONAL USE PERMIT NO. 3813 filed by DANNY SOZINHO proposing to allow a solid waste processing facility, consisting of four (4) Biofiltro wastewater processing beds,  one (1) lift station, one (1) mechanical separator, one (1) weeping wall, and one (1) concrete wall in an existing settling cell into two (2) settling cells on the 159.68-acre parcel for an existing pre-October 23, 2007 dairy located within the AE-20 (Exclusive Agricultural, 20-acre minimum parcel size) Zone District.
The subject parcel is located on the southwest corner of east Elkhorn Ave. and south Highland Ave., approximately 3.7-miles from the City limits of the City of Kingsburg. (APN: 056-031-35s) (ADDRESS: 8486 E. Elkhorn Avenue) (Sup. Dist. 4).

The County of Fresno has determined that it is appropriate to adopt a Mitigated Negative Declaration for the Proposed Project. The purpose of this Notice is to (1) provide notice of the availability of IS No. 8631 and draft Mitigated Negative Declaration and request written comments thereon; and (2) provide notice of the public hearing regarding the Proposed Project.
Public Comment Period

NOTICE IS HEREBY GIVEN that on Tuesday, August 5, 2025, at 6:00 p.m. or as soon thereafter as the matter can be heard, the Fowler City Council will hold a regular meeting at the City Hall Council Chamber at 128 S. 5th Street, Fowler, California to hear and consider the following:
Ordinance No. 2025-05. The City of Fowler proposes to adopt an ordinance to retain the current prima facie speed limit of thirty (30) miles per hour for a 1.7-mile section of Adams Avenue located between Golden State Boulevard and Merced Street in the City of Fowler.  This ordinance is being adopted pursuant to California Vehicle Code section 22358.8, which provides that the City may retain the current prima facie speed limit if it is determined that the prima facie speed limit recommended by an engineering and traffic survey is still more than is reasonable or safe, the current prima facie speed limit was established with an engineering and traffic survey, and a registered engineer has determined that no new general purpose lanes have been added to the roadway since completion of the engineering and traffic survey that established the current prima facie speed limit.
The City Council has determined that the change to Fowler Municipal Code is not a “project” pursuant to the California Environmental Quality Act (“CEQA”) as defined by Public Resource Code section 21065 and CEQA Guidelines Section 15378. Adoption of the proposed ordinance will not cause a direct or indirect change in the environment.
The City Council invites your participation, and the public is welcome to speak at the hearing. If you challenge any Planning Commission or City Council action in court, you may be limited to challenge only those issues raised at the Planning Commission or City Council public hearings.
