Bids shall be submitted electronically through Planet Bids or by paper only.
NR 1. General Description
The City of Fresno is soliciting bids to purchase 40 ft. all electric buses for delivery as stated in SP 5.2 Delivery Schedule.
The units shall be an air-conditioned low floor battery electric transit coaches comprised of a single functional unit. They shall have seating, as further described and shall have doors, and floor configurations suitable for City passenger use. Vehicles shall be supplied with a wheelchair ramp at the entrance and wheelchair positions with restraints.
In all cases, materials must be new and furnished as specified. Where brand names or specific items are used in these specifications, consider the term “reviewed equal” to follow. Wherever such names appear, reviewed equals will be accepted only with the prior written concurrence from the City. All test data required within these specifications shall be submitted to the City prior to delivery of pilot vehicle unless specified otherwise.
The Contractor shall conform to these technical specifications and shall not omit any unit or component or both, part or detail to make these buses ready for service, even though such part or detail is not mentioned in these specifications. In absence of a specification, the Contractor shall adhere to its manufacturing standards. No changes or substitutions are permitted without the prior written consent of the City. This procurement will allow retirement of older buses and expansion of the revenue fleet. The City’s overall objective for purchase, design, and operation of a new fleet of electric buses shall be to satisfy the following requirements:
· Safe and Reliable in Operation
· Economic to Purchase, Operate and Maintain
· Optimized Performance, Emissions and Fuel Consumption
· Full compliance with all applicable rules, regulations, and standards in place at the time of manufacturing.
This is a federally funded project. All proposers must comply with all FTA terms and conditions stated in section 4.
Completed Disadvantaged Business Enterprise (DBE) Utilization Form and Participation Schedule in Attachment G. Please note that there is a 0% DBE participation requirement for this project, but DBE reporting is still required. If a DBE is part of the Contractor’s team then the percentage of DBE participation shall be recorded.
NR 2. Description of the Work to be Done
Specifically, the City is requesting the following types of vehicle(s):
· 40 Foot Low Floor Regular All-Electric Fixed Route Bus
NR 3. Vehicle Design
The 40 ft. all electric buses shall have a sleek, aerodynamic, modern, and fashionable design that is aesthetically appealing. A raised roof cap shall be designed to run the entire roof of the bus and conform to the contours of the body’s sleek, aerodynamic, modern, and fashionable design of the bus. The raised roof cap shall mask the electrical, HVAC system, battery system, and any other roof mounted equipment of the bus. The raised roof cap shall flow seamlessly from the top of the windshield to the rear of the bus. The windows shall be hidden framed and mount flush with the exterior of the bus. All exterior panels shall have a smooth and seamless look with no visible fasteners. Exterior access doors shall be designed to be functional with a sleek and discrete look.
NR 4. Obtaining Bid Documents
The Bid Proposal forms and specifications may be obtained from the Office of the Purchasing Manager (phone 559 621-1332) or downloaded via the City’s website: www.fresno.gov, Doing Business (at the top of the screen), Bid Opportunities.
NR 5. Bid Due Date and Submittal Requirements
Bids are to be submitted at the Office of the Purchasing Manager of the City of Fresno, 2600 Fresno Street, Room 2156, Fresno, CA 93721 prior to the opening at 3 p.m. on Tuesday, June, 26th, 2018, at which time they will be publicly opened and recorded.
All bids must be made on the bid forms provided by the Purchasing Manager and must be accompanied by a deposit in the amount of FIFTEEN-THOUSAND DOLLARS ($15,000) in the form of a Cashier’s or Certified Check, an irrevocable letter of credit, or a certificate of deposit, or a bidder’s bond of a corporate surety, authorized by the California Insurance Commissioner to do business in the State of California, payable and acceptable to the City of Fresno. All deposits will be held until a Contract has been executed with the successful Proposer or all bids have been rejected.
The City of Fresno hereby notifies all Proposers that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation or on any other basis prohibited by law.
NR 6. Pre-Bid Meeting Information
A Pre-Bid conference will be held at 11:00 a.m. on June, 11th, 2018, at the Office of the Purchasing Manager, 2600 Fresno Street, Room 2156, Fresno, California. Prospective Proposers are encouraged to attend.
The meeting room is physically accessible. Services of an interpreter and additional accommodations such as assistive listening devices can be made available. Requests for accommodations should be made at least five working days but no later than 48 hours prior to the scheduled meeting/event. NR 7. Federal
This project is funded in part with financial assistance from the U.S. Department of Transportation, Federal Transit Administration (FTA). The successful proposer shall be knowledgeable of and in compliance with all applicable Federal Third Party Contract Clauses. The actual number of purchased will be based upon the overall availability of local and federal funds.
Applicable FTA Guidance
FTA Circular 4220.1F provides contracting guidance for recipients of federal assistance awarded by FTA when using that federal assistance to fund procurements or third party contracts. FTA also publishes a Best Practices Procurement Manual (BPPM) which is available on FTA’s website. Additional procurement requirements can be found in the Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments at 2 Code of Federal (CFR) 200.317-.326. Contracting and procurement staff should consult these authorities and guidance documents when procuring items funded by FTA.
The City will carry out applicable federal requirements in the award and administration of any contract award hereunder. This is a federal project funded in full or in part through the U.S. Department of Transportation, Federal Transit Administration (FTA).
Bidders are advised that, as required by federal law, the State of California has established a statewide overall DBE goal. City of Fresno federal-aid contracts are considered to be part of the statewide overall DBE goal and the City is required to report to the Federal Transit Administration (FTA) on DBE participation for all Federal-aid contracts each year so that attainment efforts may be evaluated.

It is the intention of the Council of the City of Clovis to order the levy and collection of an assessment for the 2018-19 fiscal year under the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code beginning with Section 22500 of said Code, for Landscape Maintenance District #1 of the City of Clovis (herein “LMD No. 1”).

REQUEST FOR RELEASE OF FUNDS
On or about June 18, 2018 the County of Fresno will submit a request to the Department of Housing and Urban Development (HUD) for the release of Federal funds under the HOME Investment Partnerships (HOME) Program of Title II of Cranston-Gonzales National Affordable Housing Act, as amended, 42 U.S.C. 12701 et seq, to undertake a project known as Hull Reconstruction Project for the purpose of demolishing and rebuilding a single-family residence that was damaged by fire located at 1443 Grove Street, Selma, estimated funding: $180,000.
FINDING OF NO SIGNIFICANT IMPACT
The County of Fresno has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 2220 Tulare Street, Suite A, Fresno, CA 93721 and may be examined or copied Mondays through Thursdays 9 A.M to 5 P.M. and Fridays 8:30 A.M. to 12:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the County of Fresno Department of Public Works and Planning, Attn: Chrissy Monfette. All comments received by: June 16, 2018 will be considered by the County of Fresno prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The County of Fresno certifies to HUD that Steven E. White in his capacity as Director of the Department of Public Works and Planning consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County of Fresno to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the County of Fresno’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Fresno; (b) the County of Fresno has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at One Sansome St., Suite 1200, San Francisco, CA 94104. Potential objectors should contact HUD to verify the actual last day of the objection period.

Bids must be made on a form prepared by the District and included in the contract documents. Bids will be received no later than Thursday, June 28, 2018 at 2:00 PM after which time they will be opened and read aloud. Bids must be sealed, marked with bid number and title, and returned to the Purchasing Department of the State Center Community College District at 1525 E. Weldon Ave, Fresno, CA 93704. Facsimile (FAX) copies of the bid will not be accepted.
A pre-bid conference has been scheduled on Tuesday, June 12, 2018 @ 9:00AM. Those attending the non-mandatory pre-bid conference shall meet at District Operations, Conference Room.

Prospective bidders shall be required to have a valid Class B Contractor’s License.
The successful bidder will be required to furnish a Payment Bond, a Performance Bond, Workers Compensation and General Liability Insurance as required by the Contract Documents. The successful bidder shall also be required to enter into a written agreement on a form provided by the District.
Bids must be accompanied by a bidder’s bond or certified check for at least ten (10%) of the amount of the bid and payable to the District, which shall be given as a guarantee that the bidder will enter into a contract if awarded the work. Said bond or certified check will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the District.
Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”). A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness. Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors. If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.
The Work is subject to payment of Prevailing Wage Rates (PWRs). The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided. Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.
The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Contractor must pay for any labor described or classified in an amount not less than rates specified.
Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.
The Board of Trustees reserves the right to reject any or all proposals, waive any informality in the receiving of bids, and consider quality, convenience, and reasonable qualifications as well as price in making awards.
