Notice is hereby given that on April 20, 2023, the City Council of the City of Fresno (City) adopted Council Resolution No. 2023-101 to annex Final Tract Map No. 6350 to the City of Fresno Community Facilities District No. 11 (CFD No. 11) and to authorize the levy of Special Taxes under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (City Law).  Under this City Law and Council Resolution No. 2023-101, the City gives notice as follows:

a. The text of Council Resolution No. 2023-101, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Council Resolution No. 2023-101 is summarized as follows:

b.  As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 11, the boundaries of which are shown on the map on file with the City Clerk.

c.  The purpose of CFD No. 11 is to provide financing for the maintenance of the landscaping and irrigation systems, open spaces, trails, concrete curbs, gutters, medians, hardscaping and sidewalks, street lights, local street paving and street name signage plus any added developer requested features (Services) located in street, landscaping and open space easements and public properties associated with the subdivision as more fully described in Council Resolution No. 2023-101 and Exhibit C thereto.

d. The method of financing the Services is through the imposition and levy of a special tax (Special Tax) to be apportioned on the properties in CFD No. 11 under the rate and method of apportionment described in Council Resolution No. 2023-101 and Exhibit D thereto.  The Special Tax requires the approval of two-thirds of the qualified electors of CFD No. 11 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.

e. The Special Tax, if approved, will be used to finance all or a portion of the Services.

f.  The Director of Public Works of the City or his designee is directed to cause to be prepared a written report for CFD No. 11, Annexation No. 142 (District Report) that shows the Services by type and required to adequately meet the needs of CFD No. 11 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the Public Hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

g.  As set forth below, the City will hold a Public Hearing on the Annexation of Final Tract Map No. 6350 to CFD No. 11 with its Services and Special Tax.

h. The time and place established under Council Resolution No. 2023-101 for the Public Hearing required under City Law are Thursday, May 25, 2023, at the hour of 10:05 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.

This ordinance is scheduled to be considered for adoption during the regular Clovis City Council meeting on June 5, 2023.

Notice is hereby given that the Fresno Unified School DISTRICT (“DISTRICT”) will receive sealed bids for Bid No. 23-65, ROBINSON ELEMENTARY SCHOOL PORTABLE RELOCATION, to relocate and install two portables.

DISTRICT hereby notifies all bidders that they will affirmatively ensure that in any Contract entered into pursuant to this advertisement, disabled veteran business enterprises (DVBE) will be afforded full opportunity to submit proposals in response to this invitation and will not be discriminated against on the grounds of race, color, creed, sex or national origin in consideration for award. The DVBE goal for the project is as follows:  three percent (3%) of the dollar amount of the Contract.

This Project is subject to prequalification, in accordance with Public Contract Code 20111.6. All Bidders performing as either a General Engineering Contractor (A license), General Building Contractor (B license), Electrical Contractor, Mechanical Contractor, or Plumbing Contractor utilized as a Prime Contractor or Subcontractor must be prequalified prior to submitting bids on this project. 9.  QUALIFICATION OF BIDDERS:  The Lease/Leaseback Contractor and Owner will not consider or accept any bids from subcontractors who are not licensed to do business in the State of California, in accordance with the Public Contract Code of the State of California, providing for the licensing of contractors. 

10. AWARD:  The Lease/Leaseback Contractor and Owner reserve the right to reject any and all bids and/or waive any informality in any bid received and/or determine in their discretion the responsibility of any bidder, and which bid is most advantageous to the Owner.  Unless otherwise required by law, no bidder may withdraw his bid for a period of 60 days after the date set for the opening thereof.  Anticipated Award week of June 14, 2023 (not guaranteed).

11. WAGE RATES:  The subcontractors agree to comply with the prevailing wage laws as set forth in Labor Code sections 1770-1780 unless an applicable federal labor law imposes a higher wage or stricter requirement, in which case the higher wage or stricter requirement will apply.  Subcontractors agree to be responsible for the compliance by all subcontractors with Labor Code Section 1776.  Pursuant to Labor Code Section 1770, the subcontractors shall, as a penalty to the Owner, forfeit not more than $50 for each calendar day or portion thereof, for each worker paid less than the prevailing rates as determined by the director for the work or craft in which the worker is employed.  The amount of this penalty shall be determined by the California State Labor Commissioner and shall be based on consideration of the subcontractor’s mistake, inadvertence, or neglect in failing to pay the correct rate of prevailing wages, or the previous record of the subcontractors in meeting his or her prevailing wage obligations, or the subcontractor’s willful failure to pay the correct rates of prevailing wages. In accordance with the Public Contract Code Section 6109, with respect to subcontractors which are ineligible to perform work on public works projects pursuant to Labor Code Section 1777.1 or 1777.7.   

12. PAYROLL RECORDS:  The subcontractor shall obtain and maintain certified payroll records for the subcontractor’s employees and those of the sub-subcontractors working on this project in accordance with Labor Code 1776.  The certified payroll records shall be on forms provided by Division of Labor Standards Enforcement or shall contain the same information as the forms provided by the division.  The records shall be made available to the Owner upon request.

13. FINGERPRINTING REQUIREMENTS:  Contractors and their employees shall comply with the Michelle Montoya School Safety Act, Section 45125.2 of the Education Code.  Refer to Section 00 7360 – Fingerprinting Requirements.

14.  DIR REGISTRATION:

.1       No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)].

.2      No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.

.3      This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

Community Dialysis Center-Clovis will permanently close effective Friday, August 4, 2023. Services that will be ending include hemodialysis. There will be no reduction in personnel due to the closure.
