ARTICLE 4 – APPOINTMENT OF COUNSEL
Family Code §7860 Procedure for Appointment of Counsel
At the beginning of the proceeding on a petition filed pursuant to this part, counsel shall be appointed as provided in this article.  The public defender or private counsel may be appointed as counsel pursuant to this article. The same counsel shall not be appointed to represent both the child and the child’s parent.
Family Code § 7861 Appointment to Protect Interests of Child
The court shall consider whether the interests of the child require the appointment of counsel. If the court finds that the interests of the child require representation by counsel, the court shall appoint counsel to represent the child, whether or not the child is able to afford counsel. The child shall not be present in court unless the child so requests or the court so orders.
Family Code § 7862 Appointment of Counsel for Parent
If a parent appears without counsel and is unable to afford counsel, the court shall appoint counsel for the parent, unless that representation is knowingly and intelligently waived.
Family Code § 7863 Compensation and Expenses of Private Appointed Counsel
Private counsel appointed under this article shall receive a reasonable sum for compensation and expenses, the amount of which shall be determined by the court.  The amount so to be determined shall be paid by the real parties of interest, other than the child, in proportions the court deems just. However, if the court finds that any of the real parties in interest are unable to afford counsel, the amount shall be paid out of the general fund of the county.

Plan Consolidado

Plan de Acción Anual
El objetivo del Plan de Acción Anual es mostrar cómo se utilizarán los fondos del Programa CDBG de la Ciudad durante el año fiscal 2026-2027, de manera que se enfoquen en las necesidades, prioridades y objetivos contenidos en el Plan Consolidado 2026-2030 propuesto por la Ciudad.

Consolidated Plan
A Consolidated Plan is required in order for the City receive Community Development Block Grant (CDBG) Program funding from the U.S. Department of Housing and Urban Development (HUD). CDBG funds must be used for activities that meet one of three national goals, which are: securing decent housing, providing a suitable living environment and/or expanding economic opportunities. The Consolidated Plan is developed to determine how these goals will be met over a five-year period in the City of Clovis. Maximum priority shall be given to fund activities that benefit low-moderate income persons, aid in the prevention or elimination of slums or blight, and/or meet other urgent community development needs.
Annual Action Plan
The purpose of the Annual Action Plan is to show how the City’s CDBG Program funding will be expended during the 2026-2027 program year in a way that addresses the needs, priorities and objectives contained in the City’s proposed 2026-2030 Consolidated Plan.
The 2026-2027 CDBG allocations from the U.S. Department of Housing and Urban Development (HUD) have not been announced yet, but Clovis estimates receiving an entitlement allocation of $710,000. The entitlement amount, together with an additional $87,951 in carryover funds, will total $797,951 in CDBG funds to be allocated for the 2026-2027 program year. The proposed use of funds for the 2026-2027 program year is as follows:
•              Housing Rehabilitation – $130,000
•              Micro-Enterprise Culinary Kitchen – $87,000.00
•              Clovis Senior Senter Enrichment Activities – $40,000.00
•              Marjaree Mason Center Critical Domestic Violence Services – $61,491.00
•              Cole/Elm Alley Improvements – $ 193,000.00
•              ADA/Sidewalk Accessibility Improvements (Estabrook/Music/Acacia) – $144,460.00
•              Administration – $142,000.00
An increase or decrease in the estimated CDBG funding level will be applied to the ADA/Sidewalk Accessibility Improvements Project (Estabrook/Music/Acacia), and Administration (20% maximum).
By this notice, the City of Clovis invites parties that have an interest in, or may be impacted by, the activities discussed in the Consolidated Plan and/or Annual Action Plan, to submit a written comment in-person, via telephone, via mail or e-mail (see contact information below) and/or attend the Public Hearing to provide their views and comments. Citizen participation is considered an important element of the Plan development process and HUD recommends Cities receive and incorporate public comments into its planning and review process. ENGINEERING SERVICES FOR THE H STREET PARKING STRUCTURE PROJECT AT THE FOLLOWING LOCATION:

I.                 Introduction
The City of Fresno (City) Capital Projects Department is issuing this Request for Qualifications (RFQ) for Statement of Qualifications (SOQ) from qualified Engineering Services firms to provide Acceptance Testing and Engineering Inspection Services Consultant for the capital improvement project at APN 46704020S. Funding for this project will be through Governor’s Office of Business and Economic Development (GO-Biz).
II.                Project Description
The H Street Parking Structure design-build project is located in District 3 and is bounded by H Street, Mono Street, Union Pacific Railroad (UPRR), and the extension of Inyo Street, as shown in the attached exhibit. The scope of work includes but is not limited to; demolition of an existing City owned surface parking lot and construction of a seven-story parking structure with a 900+ car capacity, frontage improvements along H Street, traffic signal improvements at the intersection of Inyo and H Street including a pedestrian scramble, and improvements for an all-way stop at the intersection of Mono and H Street.
This Project is fully funded by GO-Biz funds. No special guidelines are required for the specified fund in relation to the expenditure required for the project.
There are no DBE goals listed for this project.
III.              Scope of Services
Services will include but are not limited to perform on this project to ensure they compy with necessary specifications and standards. These tests are performed as specified by frequency and methods outlined in the 2021 QAP and as amended. The materials laboratory shall be under the responsible management of a California registered Engineer with experience in sampling, inspection and testing of construction materials. The Engineer shall certify the results of all tests performed by laboratory personnel under the Engineer’s supervision. The materials laboratory shall contain certified test equipment capable of performing the tests conforming to the contract documents, project plans, specifications,
and the provisions of the 2021 QAP and, as amended. In general:
The materials laboratory used shall be certified by the City of Fresno Independent Assurance (IA) Consultant, Moore Twining Associates, Inc. – or will be certified by June 2026* and shall provide documentation that the laboratory complies with the following procedures:
·         Correlation Testing Program – The material laboratory shall be certified by the City of Fresno IA Consultant – or will be certified by June 2026 and shall be a participant in one or more of the following testing programs:
a.    AASHTO Materials Reference Laboratory (AMRL)
b.    Cement and Concrete Reference Laboratory (CCRL)
c.    Caltrans’ Reference Samples Program (RSP)
·         Certification of Personnel – The materials laboratory shall employ personnel who are certified by the City of Fresno IA Consultant – or will be certified by June 2026 and by one or more of the following:
a.    Caltrans District Materials Engineer
b.    Nationally recognized non-Caltrans organizations such as the American Concrete Institute, Asphalt, National Institute of Certification of Engineering Technologies, etc.
c.    Other recognized organizations are approved by the State of California and/or recognized by local governments or private associations.
·         Field and Laboratory Testing in accordance with Industry Standards
·         Compaction Testing
·         Concrete Testing
·         Asphalt Testing
·         Steel Reinforcement Inspection
·         Post Tension Verification
·         Masonry Inspection and Testing
·         Shop and Field Welding Inspection
·         Post-installed Anchor Inspection
·         High-Strength Bolt Inspection
·         Provide Geotechnical Investigation and Testing as required
·         Calibration, verification, and certification services
·         Preparation of test plans, procedures, and documentation
·         Detailed reporting of results, including nonconformance identification
·         Coordination with project managers, contractors, and regulatory bodies
·         Participation in project meetings, inspections, or audits as required
*Upon award the COF will work with the IA Lab to have the Laboratory, Laboratory technician(s), and filed technicians certified by the specified date.
Anticipate 2-4 days to complete IA certification.

IV.              SOQ Requirements
If your firm is interested in this project, please submit three (3) copies of your Statement of Qualifications that includes the following:
§  Cover letter
§  Overview of the firm and any proposed sub-consultants
§  Summary of the prime consultant and any subconsultant firm experience and performance on similar projects completed in the last ten years, including references, resumes for the Project Manager and key support staff including education, relevant past project experience, applicable licensing & certifications, and description of their assignment on this project
§  Work plan for identifying tasks to be completed by the Consultant team, approach to the work, and key issues for this project
§  Schedule for project completion including the milestones identified in the work plan
§  Listing of client references associated with completed projects would be desirable
§  Certification of Local Preference, if applicable
§  Signed Addenda issued during advertisement
§  The SOQ should be concise and shall not exceed TWENTY-FIVE 25 pages.
Note: Required exhibits and signed addenda do not count toward the maximum page count.
V.               Schedule:
The tentative schedule for hiring and engaging the Consultant is as follows:
§  SOQs submitted to City – by 5:00 P.M. on Friday, April 17, 2026
§  Interviews of candidates – week of 4/22/2026
§  Notice to Proceed – June, 2026
*If three (3) or fewer SOQs are received, then the City reserves the right to select a
Consultant based on the SOQ’s submitted, and interviews may not be conducted.
VI.              Consultant Selection
Consultant selection for award of a contract shall be in accordance with City’s consultant selection policy, qualitative analysis, and consultant evaluation forms. The City reserves the right to make the selection of a consultant based on any or all factors of value, whether quantitatively identifiable or not, including, but not limited to, the anticipated initiative and ability of the consultant to perform the services set forth herein.
The initial screening of the Consultant SOQs shall be based on categories identified in the Consultant SOQ Evaluation Form. Consultants who scored the highest will be
short listed and invited to an interview. The number of Consultants invited to the interview will be dependent on the number of SOQ’s received by the City. At a minimum, three (3) consultants will be invited to the interview process. In the interview, the consultant’s presentation will be scored on the categories identified on the Consultant Final Evaluation Form. The final selection shall be based on Consultant interview, presentation, and the Consultant who provides the best value to the City, in its own discretion.
Any contract exceeding $100,000 shall be subject to the approval of the City Council in accordance with the Fresno Municipal Code. The City’s standard contract will be used, which includes a conflict-of-interest statement, and completion of a statement of economic interest. Local Preference will be given pursuant to the Fresno Municipal Code Section 4-109. In order to be eligible for Local Preference consultants must complete the Certification for Local Preference attached to this RFQ.
This solicitation for SOQ’s does not commit the City of Fresno to enter into a contract or to pay any costs incurred in the preparation of the SOQ. The City of Fresno reserves the right to accept or reject any SOQs, and to negotiate with any qualified consultant, or to cancel in part or in its entirety this solicitation for SOQ’s.
VII.            Insurance Requirements
Consultants shall meet all insurance requirements specified in the Consultant Agreement attached hereto at the time of contract execution.
VIII.          Regulated Communication in City Procurement Process Ordinance The Regulated Communications in City Procurement Process Ordinance (Article 6, Chapter 4 of the Fresno Municipal Code) became effective April 29, 2004. With certain specified exceptions, the Ordinance provides that no Respondent, Bidder, Proposer (as the case may be) shall initiate, engage in, or continue any communication to or with any City elected official concerning or touching upon any matter which is the subject of this competitive procurement process.
Any Respondent, Bidder, Proposer, or elected official (as the case may be) who initiates, engages in, continues in, or receives any regulated communication shall file the written disclosure required by the Regulated Communications in City Procurement Process Ordinance.
Any Respondent, Bidder, or Proposer violating the Regulated Communications in City Procurement Process Ordinance may be disqualified from participating in this procurement process and/or determined to be non-responsible. Additionally, the City may set aside the award of a contract, prior to its execution, to a party found to have violated the Ordinance.

IX.              Debarment
A Bidder may be debarred from bidding or proposing upon or being awarded any contract with the City, or from being a subcontractor or supplier at any tier upon such contract, in accordance with the procedures in Fresno Municipal Code Section 4-104 adopted by Council on May 17, 2018. The initial period of any such debarment shall not be less than one year and may be permanent depending on the violation. A Bidder may request a hearing, in accordance with Fresno Municipal Code Section 4-104, upon receipt of a notice of proposed debarment from the City Manager or designee. Detailed statements shall be rendered monthly and will be payable in the normal course of City business. The anticipated Contract duration for this project is JUNE, 2026 through SEPTEMBER, 2027.
XI.              Requests for Information
All requests for information (RFI) and questions regarding this project shall be in writing via email to the Project Manager identified in this RFQ. There shall be NO phone calls to the City for additional information or clarification. All RFI’s shall be submitted within five (5) business days from the submittal deadline. Failure to abide by this provision shall deem that Consultant non-responsive and the SOQ will not be considered. Responses to RFI’s shall be addressed via issuance of an addendum, which will be emailed and posted on the City’s PlanetBids website.
