NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN THAT the Board of Supervisors (“Board”) of the County of Fresno (“County”) will hold a public hearing on May 9, 2023 at 9:30 a.m. or as soon thereafter as the matter may be heard in the Board Chambers, Hall of Records, Third Floor, 2281 Tulare Street, Fresno, California, 93721, to consider and take action to adopt a  Resolution amending the Schedule of Drainage Costs and Fees for local drainage areas and Storm Drainage and Flood Control Master Plan pursuant to Section 17.64.050 of the Fresno County Ordinance Code.

On May 9, 2023, the Board of Supervisors will conduct a hearing to consider amending the Schedule of Drainage Costs and Fees pursuant to the Fresno Metropolitan Flood Control District’s fee update adopted by the District on March 8, 2023 by amended resolution.

The purposes of the Fees, as applicable, are to implement the construction of Storm Drainage Master Plan improvements.  The Drainage Fee Ordinance, enacted under the authority of Section 66483 of the Government Code, requires identification of the estimated or actual cost of the planned facilities through the adoption of a Resolution. 

A copy of the Schedule of Fees, and any data supporting the proposed Fees, will be available for public review at the office of the Clerk to the Board of Supervisors (“Clerk”), at the above address for the Board Chambers, on County business days between the hours of 8:00 AM and 5:00 PM.  A copy of the Board agenda materials, including the proposed Resolution, for the Board’s actions on this matter will be made available for public review, commencing on or about the Thursday immediately before the applicable Board public hearing or meeting date, at the office of the Clerk, and on the County’s Internet web site at www.co.fresno.ca.us.

PROJECT LOCATION

Fresno County is one of the eight counties that collectively form the greater San Joaquin Valley. The County covers approximately 6,000 square miles stretching from the Coast Range mountains to the west to the Sierra Nevada Range to the east. For the purposes of this EIR the Planning Area is defined as unincorporated Fresno County and is the land over which the County has land use authority and where the policies and goals proposed in the General Plan Review and Zoning Ordinance Update are applicable. The County has 15 incorporated cities, with the City of Fresno being the largest at 546,770 and the City of San Joaquin being the smallest with a population of 3,674 as of 2021. For the purpose of the General Plan Review and Zoning Ordinance Update, the County has been divided into five geographic sub-regions to provide greater context. This is because Fresno County is diverse not only in the size of its communities, but also the vast geographic area it covers. These five sub-regions do not have any policy status but are useful for general orientation and for framing and describing geographically unique planning issues. The sub-regions include Coast Range Foothills Area, Westside Valley Area, Eastside Valley Area, Sierra Foothill Area, and Sierra Nevada Mountain Area.

PROJECT DESCRIPTION

The General Plan Review is intended to build on the major policies of the current 2000 General Plan but expand and strengthen them to meet the challenges and community needs through planning horizon year 2042. The General Plan Review would accommodate County population growth projected through 2042. The 2042 General Plan seeks to preserve agricultural land and natural resources; conserve public spaces and recreational resources; promote the wellbeing of County residents; maintain economic vitality and balance; and direct land use policies that enable sustainable and forecasted growth in the County. The major themes of the current 2000 General Plan have been retained in the General Plan Review and include directing urban growth to existing communities, limiting the intrusion of development and incompatible land uses onto productive agricultural land, and limiting rural residential development. The revisions include only minimal changes to the land use designations and land use maps in the existing 2000 General Plan. The majority of revisions are to goals, policies, and implementation programs of the General Plan. The revision also includes addressing laws affecting the General Plan, including the addition of an Environmental Justice Element to the General Plan Policy Document.

Section 65860(c) of the Government Code requires that when a General Plan is amended in a way that makes the Zoning Ordinance inconsistent with the General Plan, “the Zoning Ordinance shall be amended within a reasonable time so that it is consistent with the general plan as amended.” However, the Government Code does not define a specific time period that would constitute a reasonable time. In this instance, the proposed project includes updating the Fresno County Zoning Ordinance to be consistent with the proposed revisions to General Plan Policy Document included in the General Plan Review. Components of the Zoning Ordinance update that could result in physical changes to the environment include the revisions to the regulations for accessory dwelling units, density bonus and other State-mandated changes to California Zoning law which became effective since the adoption of the 2000 General Plan.

SIGNIFICANT ENVIRONMENTAL EFFECTS

The County of Fresno has prepared a Draft EIR to address the specific environmental effects of implementing the General Plan Review and Zoning Ordinance Update. The Draft EIR identified the following potentially significant environmental issue areas requiring mitigation:

·   Air Quality

·   Biological Resources

·   Cultural Resources

·    Greenhouse Gas Emissions

·    Noise

·    Transportation

·    Wildfire

 

Impacts to Agriculture, Air Quality, Cultural Resources, Greenhouse Gas Emissions, Transportation, Utilities, and Wildfire were found to be significant and unavoidable.

DRAFT EIR REVIEW AND COMMENT

A 60-day review and comment period for this DEIR is provided, which exceeds the 45-day minimum review period provided under State law, beginning on April 28, 2023. The deadline for your comments is 5:00 p.m., June 27, 2023. Please send your response to Chris Motta, Principal Planner, at the address shown above. Please reference “GPR/ZOU (General Plan Review and Zoning Ordinance Update Project)” and provide the name and address for a contact person.

RELEASE OF PUBLIC REVIEW DRAFTS:

The County is notifying interested agencies, organizations, and individuals of that the release of revised draft documents associated with the General Plan Review and Zoning Ordinance Update will occur simultaneously with the release the DPEIR.    A deadline for comments on these documents will coincide with the 60-day comment deadline for the DPEIR. Community meetings will be scheduled soon to provide the public an opportunity to comment on these documents, although comments may be sent to County staff at any time.

UBICACIÓN DEL PROYECTO

El condado de Fresno es uno de los ocho condados que colectivamente forman el gran Valle de San Joaquín. El condado cubre aproximadamente 6,000 millas cuadradas que se extienden desde las montañas de la Cordillera de la Costa al oeste hasta la Cordillera de Sierra Nevada al este. Para los propósitos de este EIR, el Área de Planificación se define como el Condado de Fresno no incorporado y es la tierra sobre la cual el Condado tiene autoridad de uso de la tierra y donde se aplican las políticas y objetivos propuestos en la Revisión del Plan General y la Actualización de la Ordenanza de Zonificación. El condado tiene 15 ciudades incorporadas, siendo la ciudad de Fresno la más grande con 546,770 y la ciudad de San Joaquín la más pequeña con una población de 3,674 a partir de 2021. Para el propósito de la Revisión del Plan General y la Actualización de la Ordenanza de Zonificación, el Condado se ha dividido en cinco subregiones geográficas para proporcionar un mayor contexto. Esto se debe a que el condado de Fresno es diverso no solo en el tamaño de sus comunidades, sino también en la vasta área geográfica que cubre. Estas cinco subregiones no tienen ningún estatus político, pero son útiles para la orientación general y para enmarcar y describir cuestiones de planificación geográficamente únicas. Las subregiones incluyen Coast Range Foothills Area, Westside Valley Area, Eastside Valley Area, Sierra Foothill Area y Sierra Nevada Mountain Area.

DESCRIPCIÓN DEL PROYECTO

La Revisión del Plan General está destinada a construir sobre las principales políticas del Plan General actual de 2000, pero ampliarlas y fortalecerlas para enfrentar los desafíos y las necesidades de la comunidad a través del horizonte de planificación del año 2042. La Revisión del Plan General acomodaría el crecimiento de la población del Condado proyectado hasta 2042. El Plan General 2042 busca preservar las tierras agrícolas y los recursos naturales; conservar los espacios públicos y los recursos recreativos; promover el bienestar de los residentes del Condado; mantener la vitalidad y el equilibrio económicos; y políticas directas de uso de la tierra que permitan un crecimiento sostenible y previsto en el Condado. Los temas principales del actual Plan General de 2000 se han mantenido en la revisión del Plan General e incluyen dirigir el crecimiento urbano a las comunidades existentes, limitar la intrusión del desarrollo y los usos incompatibles de la tierra en tierras agrícolas productivas, y limitar el desarrollo residencial rural. Las revisiones incluyen sólo cambios mínimos en las designaciones de uso de la tierra y los mapas de uso de la tierra en el Plan General existente de 2000. La mayoría de las revisiones son a metas, políticas y programas de implementación del Plan General. La revisión también incluye abordar las leyes que afectan el Plan General, incluida la adición de un Elemento de Justicia Ambiental al Documento de Política del Plan General.

La Sección 65860 (c) del Código de Gobierno requiere que cuando un Plan General se enmiende de una manera que hace que la Ordenanza de Zonificación sea incompatible con el Plan General, “la Ordenanza de Zonificación se enmendará dentro de un tiempo razonable para que sea consistente con el plan general enmendado”. Sin embargo, el Código de Gobierno no define un período de tiempo específico que constituiría un tiempo razonable. En este caso, el proyecto propuesto incluye la actualización de la Ordenanza de Zonificación del Condado de Fresno para que sea consistente con las revisiones propuestas al Documento de Política del Plan General incluido en la Revisión del Plan General. Los componentes de la actualización de la Ordenanza de Zonificación que podrían resultar en cambios físicos en el medio ambiente incluyen las revisiones a las regulaciones para unidades de vivienda accesorias, bonificación de densidad y otros cambios ordenados por el Estado a la ley de zonificación de California que entraron en vigencia desde la adopción del Plan General de 2000.

EFECTOS AMBIENTALES SIGNIFICATIVOS

El Condado de Fresno ha preparado un borrador de EIR para abordar los efectos ambientales específicos de la implementación de la Revisión del Plan General y la Actualización de la Ordenanza de Zonificación. El borrador de EIR identificó las siguientes áreas de problemas ambientales potencialmente significativos que requieren mitigación:

 

·   Agricultura

·   Calidad del aire

·   Recursos biológicos

·   Recursos culturales   

·   Emisiones de gases de efecto invernadero

·   Ruido

·   Transporte

·   Incendios forestales

 

Se encontró que los impactos en la agricultura, la calidad del aire, los recursos culturales, las emisiones de gases de efecto invernadero, el transporte, los servicios públicos y los incendios forestales eran significativos e inevitables.

BORRADOR DE REVISIÓN Y COMENTARIO DE EIR

Se proporciona un período de revisión y comentarios de 60 días para este DEIR, que excede el período mínimo de revisión de 45 días provisto por la ley estatal, a partir del 28 de abril de 2023.  La fecha límite para sus comentarios es a las 5:00 p.m., 27 de junio de 2023. NOTICE FOR CONSULTING SERVICES

THE CITY OF FRESNO IS INVITING CONSULTANTS TO SUBMIT “STAMENT FOR QUALIFICATIONS” FOR ENGINEERING SERVICES FOR THE SHAW AVENUE ROADWAY IMPROVEMENTS PROJECT

BID FILE NO. 12302605

The City of Fresno (CITY) Public Works Department is requesting Statements of (SOQ) from qualified Civil Engineering firms to provide Engineering Services for the City of Fresno Public Works Department Capital Program (BID FILE NO. 12302605).

Services will include but are not limited to preparation of necessary plans, specification, estimates and conducting necessary utility coordination for project. In general:

·  Coordinate meetings with City staff and stakeholders as needed.

·  Prepare and maintain a design delivery schedule to meet the Design Completion Date of August 2024.

·  Prepare and maintain design scope, budget, quality, and schedule and provide a monthly project status report.

·  Prepare utility notification letters and/or applicable documents to utilities and agencies as needed to begin utility relocations and/or Civil work.

·  Preparation of utility communication log to be completed and updated with every submittal, or upon request of City Project Management Team.

·   Conduct site investigations as needed to produce accurate design documents.

·  Identify additional topographic survey requirements for City Survey team to perform survey and for the consultant to process City provided topographic survey information.

·   Prepare and develop a conceptual traffic control plan.

·   Prepare    and    provide    pothole    exhibit    based    on    utility    research    and    engineers’ recommendation showing potential utility conflicts.

·   Provide Geotechnical testing.

·   Prepare and have Geometrically Approved Drawing (GAD) of project approved, including specifications and engineer’s estimate.

·   Prepare construction plans, technical specifications, and construction cost estimates at each phase of work identified in the consultant agreement to meet City of Fresno and Specifications.

·   Submit construction documents for review to City offices, utilities/agencies, and obtaining final signatures on construction documents.

·   As part of the bidding phase, attend the pre-bid conference, prepare addenda and clarifications as needed, and attend bid opening.

·   As part of the construction phase and General construction contract administration, attend the pre-construction conference, review shop drawings, and other contractor submittals, provide clarification of construction documents during construction, review and provide technical information for construction contract change order requests if necessary, and perform as many as two site visits during construction.

·   Prepare record drawings documenting the as-built improvements, have as-built approved, and both Mylars and final CAD drawing provided to City.

SUMMARY OF ORDINANCE NO. 2023-07 OF THE CITY OF FOWLER

REGARDING THE IMPROPER COLLECTION OF SOLID WASTE

On April 18, 2023, the Fowler City Council introduced Ordinance No. 2023-07 to add Article 6 to Chapter 2 of Title 6 of the Fowler Municipal Code to provide regulations relating to the improper collection of solid waste.

On April 18, 2023, the Fowler City Council adopted Ordinance No. 2023-06 which amended sections 1-8.02 and 1-8.08 of Chapter 8, of Title 1, of the Fowler Municipal Code regarding administrative citations; adding Chapter 25 to Title 5 regarding the regulation of short-term rentals; adding section 6-2.313 of Article 3, of Chapter 2, of Title 6 regarding violations of unauthorized dumping of trash; and amending Chapters 2, 3, 7, 9, and 10 of Title 8 to provide updates to the City’s adoption of the California Administrative, Electrical, Housing, Mechanical, and Dangerous Buildings Codes.

Ordinance No. 2023-06 was adopted by the City Council on April 18, 2023, by the following vote:

Statements of Qualifications will be received prior to 2:01 P.M. on May 17, 2023 on Procureware, the District’s online purchasing portal https://fresnousdpurchasing.procureware.com/home.  Qualifications received later than the designated time and date will not be accepted.  Facsimile (FAX), mailed or e-mailed copies of submittals will not be accepted. Submissions will not be read out loud since based on qualification criteria which could result in multiple vendor awards.

NOTICE IS HEREBY GIVEN that on May 16, 2023, at the hour of 9:00 a.m., or as soon thereafter as practicable, at the District’s Fresno Office, 3130 N. Fresno St., Fresno, California 93703, the Board of Westlands Water District will sit as a Board of Equalization to equalize the District’s assessment for 2023.

NOTICE IS FURTHER GIVEN that at that time and place, the Board will hear all objections presented to it regarding the correctness of any 2023 Westlands Water District assessment valuation as made by the Assessor of said District pursuant to the District’s 2023 Benefit Assessment and set forth in 2023 Assessment Book of the District on file with said Board and will continue in session from day to day until all objections and relevant evidence have been acted upon by said Board and, after hearing all objections and evidence, said Board will revise the valuation of any parcel of land as necessary to reflect its proper valuation and will fix the valuations of the parcels of land, if any, that have not been assessed.

NOTICE IS FURTHER GIVEN that objections to the valuation must be preceded by the filing with the Secretary of the Board of Directors, prior to 5 p.m., on May 9, 2023, of a written application for a modification of valuation(s) showing the facts claimed to require the reduction and the applicant’s opinion of the proper valuation(s) of said property.

NOTICE IS FURTHER GIVEN that the 2023 Assessment Book is now on file with the Secretary of the Board and it may be inspected at the District’s Office (3130 N. Fresno Street, Fresno, California 93703) between the hours of 8 a.m. and 5 p.m. or at the District’s Five Points Shop and Field Office (23050 W. Mt. Whitney Avenue, Five Points, California 93624) between the hours of 7 a.m. and 3:30 p.m., on each day, Saturdays, Sundays, and holidays excepted, commencing on April 19, 2023, and ending upon the termination of the aforesaid hearing.
