NOTICE IS HEREBY GIVEN THAT the Board of Supervisors (“Board”) of the County of Fresno (“County”) will hold a public hearing on May 8, 2018 at 9:00 a.m. or as soon thereafter as the matter may be heard in the Board Chambers, Hall of Records, Third Floor, 2281 Tulare Street, Fresno, California, 93721, to consider and take action to adopt a  Resolution amending the Schedule of Drainage Costs and Fees for local drainage areas and Storm Drainage and Flood Control Master Plan pursuant to Section 17.64.050 of the Fresno County Ordinance Code.

On May 8, 2018, the Board of Supervisors will conduct a hearing to consider amending the Schedule of Drainage Costs and Fees pursuant to the Fresno Metropolitan Flood Control District’s fee update adopted by the District on December 13, 2017.

The purposes of the Fees, as applicable, are to implement the construction of Storm Drainage Master Plan improvements.  The Drainage Fee Ordinance, enacted under the authority of Section 66483 of the Government Code, requires identification of the estimated or actual cost of the planned facilities through the adoption of a Resolution.

A copy of the Schedule of Fees, and any data supporting the proposed Fees, will be available for public review at the office of the Clerk to the Board of Supervisors (“Clerk”), at the above address for the Board Chambers, on County business days between the hours of 8:00 AM and 5:00 PM.  A copy of the Board agenda materials, including the proposed Ordinance, for the Board’s actions on this matter will be made available for public review, commencing on or about the Thursday immediately before the applicable Board public hearing or meeting date, at the office of the Clerk, and on the County’s Internet web site at www.co.fresno.ca.us.

The City of Fowler hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprise, Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

Minimum wage rates for this project, as predetermined by the Secretary of Labor, are set forth in the special provisions.  If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates determined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done. Said wage determinations are on file with the City Clerk and are incorporated herein by reference.       

Bids are required for the entire work described herein.  Bids will be compared on the basis described in the Bid Proposal.

Bid security in the amount of then (10) percent of the amount of the bid, and in the form of a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance, cash, cashier’s check or certified check shall accompany the bid.  Bid security shall be made in favor of the City of Fowler.

The successful bidder shall furnish a faithful performance and labor and materials bonds each in the amount of 100 percent of the contract amount.  Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Fowler.  Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance and that the City of Fowler will not accept a surety company with a Best’s rating of less than B.

Pursuant to Public Contract Code Section 22300, substitution of securities for any moneys withheld by the City of Fowler to ensure performance under the contract shall be permitted.

BIDDERS are to base their BIDS on the project funding being provided in whole or in part by USDA Rural Development which will review and approve the contract award, contract agreement, partial and final payments, and CONTRACT CHANGE ORDERS.  Payment and retainage will comply with the section of the USDA Supplemental Provisions entitled “Payment to Contractor.”  BIDDERS are notified that this CONTRACT does not permit retainage to be invested for the benefit of the CONTRACTOR.

BIDDERS are notified that financing for this project is provided pursuant to the Consolidated Farm and Rural Development Act (7 U.S.C. The Project generally consists of the installation of owner provided process equipment to expand the existing Ultrafiltration membrane system. The existing chemical feed skid will be relocated to accommodate space for the installation of the membrane filter rack. The existing CIP tank will be replaced with the new owner provided CIP tank.

Notice is hereby given that the Project is a public works project within the requirements of Division 2, Part 7, Chapter 1 of the California Labor Code, and that each Bidder and all Subcontractors are required to be registered with the Department of Industrial Relations (“DIR”) pursuant to Labor Code section 1725.5 at the time of bidding.  Failure of the Bidder or a listed Subcontractor to be registered at the time of bidding shall render the Bid nonresponsive and unavailable for award.

Attendance for the duration of the meeting is mandatory. 

This Project is a public works project subject to prevailing wages under Labor Code Section 1771. Compliance with Federal laws and regulations is required, including as referenced in the Contract’s Special Provisions.

Any questions from potential Bidders or subcontractors regarding this IFB may be directed in writing to AECOM by e-mail at aaron.gress@aecom.com no later than seven (7) calendar days before the time specified for submittal of Bids. Bidders are encouraged to submit questions regarding any ambiguity, uncertainty, or other perceived flaw in this IFB as soon as the issue is identified.  Any such issue which is not raised prior to the deadline to submit Bids shall be waived, and the District will not consider any challenge based on the contents, structure, or terms of this IFB after the Bidding deadline. 

Submit Bids in a sealed envelope, marked “Ultrafiltration Membrane Project,” and include the Bidder’s company name and address on the envelope.  Bids must be submitted before the deadline specified above.  Late Bids will not be accepted.

The District does not discriminate on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, genetic information, marital status, sex, age, sexual orientation, military and veteran status, or other protected class in consideration for an award of a Contract.

The District reserves the right to award the Contract, to reject any or all Bids, to waive immaterial irregularities in a Bid, and to reject nonresponsive or conditional Bids or non-responsible Bidders.  If the District awards the Contract under the IFB, then the award shall be to the lowest responsible Bidder meeting the specifications of the IFB. The District shall identify the selected Bidder either in a Notice of Intent to Award the Contract provided to Bidders that submitted Bids on the IFB.
