NOTICE IS HEREBY GIVEN that at a regular meeting on Thursday, May 6, 2021 at 6:30 p.m. or as soon thereafter as the matter can be heard, the Fowler Planning Commission will hold a hearing at the City Hall Council Chamber at 128 S. 5th Street, Fowler, California to consider the following:
Conditional Use Permit Application No. 21-01 and Categorical Exemption. This project proposes substantial changes in the mode or character of the operation of alcohol sales of the Mi Favorito Place, which requires a Conditional Use Permit. The requested changes are as follows:
1. Removal of time restrictions for sale, service, or consumption of alcohol.
2. Allow a bar and/or lounge area for the purpose of sales, service or consumption of alcoholic beverages directly to patrons for consumption.
3. Sale of alcoholic beverages would not be required to be incidental to the sale of food.
4. Allow live entertainment and/or dancing on the premises at any time.
5. No monitoring and/or record maintenance of quarterly gross sales of alcoholic beverages or quarterly gross sales of food.
The Planning Commission will also consider the adoption of a Categorical Exemption analyzing the potential project impacts pursuant to the California Environmental Quality Act (CEQA). The subject property is located at 115 North 6th Street (APN: 343-142-17) between East Merced and Tuolumne Streets.
The Commission requests your participation, and the public is welcome to speak at the hearing on the project or the environmental document. If you challenge any Planning Commission action in court, you may be limited to challenge only those issues raised at the Planning Commission hearing or subsequently at the City Council public hearing if the Planning Commission action is appealed, or prior to, the public hearing.
This meeting will be conducted pursuant to the provision of Paragraph 11 of the Governor’s Executive Order N-25-20 which suspends certain requirements of the Ralph M. Brown Act, and as a response to mitigating the spread of COVID-19, the meeting will not be open to the public.
The Applications, Environmental Documents, Staff report, and a telephone number to provide access to the City Council meeting via teleconference will be available to the public at least three business days prior to the hearing and may be reviewed at www.fowlercity.org.
