R. Doc. 194. UMI was ordered to file any response memorandum within 14 days after service of Plaintiffs’ damages memorandum. R. Doc. 194.

On December 30, 2022, Plaintiffs filed their damages memorandum. R. Doc. 195. On January 3, 2023, Plaintiffs also filed a Bill of Costs detailing their costs associated with this matter. (R. Doc. 197). UMI has not filed any response memorandum or objection to these filings to date.

Considering the Default Judgment entered against UMI on December 13, 2022 (R. Doc.194), the briefing of the parties, and the evidence presented therewith;

IT IS ORDERED, ADJUDGED, AND DECREED that Defendant, Universal Meditech, Inc., be cast in judgment to pay Plaintiffs, Sensiva Health, LLC and Cormeum Lab Services, LLC, as follows:

•  $375,000.00 (THREE HUNDRED SEVENTY-FIVE THOUSAND DOLLARS AND NO/100) for payments made, owed to Cormeum Lab Services, LLC, as of December 24, 2021;

•  Judicial interest on said $375,000.00 beginning on December 24, 2021, until the date of Judgment;

•  $525,000.00 (FIVE HUNDRED TWENTY-FIVE THOUSAND DOLLARS AND NO/100) for payments made, owed to Sensiva Health, LLC as of February 8, 2021;

•  Judicial interest on said $525,000.00 beginning on February 8, 2021, until the date of Judgment;

•   $1,336,558.00     (ONE     MILLION     THREE     HUNDRED     THIRTY-SIX THOUSAND FIVE HUNDRED FIFTY-EIGHT DOLLARS AND NO/100) for lost profits, owed to Sensiva Health, LLC, as of February 8, 2021;

•   Judicial interest on said $1,336,558.00 beginning on February 8, 2021, until the date of Judgment;

•   Judicial interest from the date of this Judgment until the date paid, pursuant to 28 U.S.C. § 1961; and

•   Costs  in  the  amount  of  $13,230.53    (THIRTEEN    THOUSAND    TWO HUNDRED THIRTY DOLLARS AND 53/100) owed to Sensiva Health, LLC.

The Court, upon a finding of good cause shown, expressly designates this Judgment as eligible for immediate registration in other districts for enforcement pursuant to 28 U.S.C. § 1963.

CLEANING OF DIGESTER #1 AND CLEANING/REHABILITATION OF DIGESTER #12 AT THE FRESNO/CLOVIS REGIONAL WASTEWATER RECLAMATION FACILITY

The scope of work includes the dewatering and cleaning, and rehabilitation of two digesters at the Fresno/Clovis Regional Wastewater Reclamation Facility (RWRF). The scope of work for the cleaning is part of a rotating maintenance program that was established to improve efficiencies. Digesters #1 (75 foot diameter) and #12 (105 foot diameter) will contain approximately 13 feet of accumulated solids consisting of sludge, sand and other debris normally found in wastewater digesters. The work under this contract is to furnish any and all necessary labor, materials and equipment for the removal of access hatches and cleaning of the digester, this generally includes but is not limited to screening of pumped digester sludge (capable of removing particles ¼ inch and larger), a dewatering process to remove water from the screened sludge resulting in a minimum of 20% bio solids by weight, and transferred to a designated staging area (the fluid separated during dewatering process will be deposited into a plant drain).Then, after the digester is emptied, any solids on the digester ceiling, walls, floors and equipment must be water blasted until clean as shown on the plans and specified herein. 

The scope of work for rehabilitation consists of coating of wall surfaces in Digester #12. The rehabilitation and coating is expected to include, as a minimum, removal of existing coating, a high pressure water cleaning sufficient to remove all loose concrete and concrete repair, if necessary, with an acid resistant cement or other acceptable product. The corrosion resistant protective coating shall be a spray on elastomeric polyurethane protective coating product. The intent is to allow the Bidder to install a coating system, concrete repair system, top coating, etc. to ensure a 20 year product life when installed in a wastewater environment. All materials shall be suitable for use with ambient air conditions containing H2S in a Wastewater Treatment Plant enclosed environment.

The Engineer’s Estimate for this project is $1,300,000.

FRESNO UNIFIED SCHOOL DISTRICT

NOTICE TO BIDDERS

NOTICE INVITING BIDS PURSUANT TO PUBLIC CONTRACT CODE 22000, ET SEQ.

(THE UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT)

Notice is hereby given that the Fresno Unified School DISTRICT (“DISTRICT”) will receive sealed bids for Bid No. 23-55, Tehipite Middle School New E-Sports Arena, to demolition the existing wood shop and remodel into an e-sports arena.

DISTRICT hereby notifies all bidders that they will affirmatively ensure that in any Contract entered into pursuant to this advertisement, disabled veteran business enterprises (DVBE) will be afforded full opportunity to submit proposals in response to this invitation and will not be discriminated against on the grounds of race, color, creed, sex or national origin in consideration for award. The DVBE goal for the project is as follows:  three percent (3%) of the dollar amount of the Contract.

Notice is hereby given pursuant to the provisions of Section 1770 et seq of the California Labor Code, each worker of the contractor and any of its subcontractors engaged in work on the Project shall be paid not less than the prevailing wage rate. The project is subject to compliance monitoring and enforcement by the Department of Industrial Relations (DIR).

This Project is subject to prequalification, in accordance with Public Contract Code 20111.6. All Bidders performing as either a General Engineering Contractor (A license), General Building Contractor (B license), Electrical Contractor, Mechanical Contractor, or Plumbing Contractor utilized as a Prime Contractor or Subcontractor must be prequalified prior to submitting bids on this project. NOTICE IS HEREBY GIVEN that on March 8, 2023, the Board of Directors of the Golden State Finance Authority (“GSFA”) adopted Resolution No. 23-05, (the “Resolution”) scheduling a public hearing to consider altering its Community Facilities District No. 2014-1 (Clean Energy) (the “District”) to revise the proposed financing arrangements, authorize the financing of seismic safety improvements and wildfire safety improvements, and make various administrative changes, and all other matters set forth in that resolution.

The District was established in 2014 in accordance with section 53328.1 of the Mello-Roos Community Facilities Act of 1982 (Government Code section 53311 et seq.), as amended (the “Act”). The purpose of the District is to levy a special tax to finance the acquisition, installation, and improvement of certain improvements permanently affixed to or on real property and in buildings, with the unanimous approval of the property owner or owners. The territory of the District, to wit, the territory proposed for annexation to the District in accordance with Section 53328.1, includes (1) any unincorporated land within those counties that are now or in the future either full members or associate members of GSFA and consent to the annexation of properties within their jurisdiction to the District and (2) any incorporated land within those cities that are now or in the future either full members or associate members of GSFA and consent to the annexation of properties within their jurisdictions to the District.

By adopting the Resolution, the Board of Directors has determined that the public convenience and necessity require alterations to the District, including revisions to the arrangements for financing the District to allow for the participation of multiple program administrators using a streamlined financing process; addition of seismic safety improvements and wildfire safety improvements to the types of authorized public facilities or services which may be financed by the District; and various administrative changes and updates.

A public hearing to consider these proposed changes will be held by the Board at 9:00 a.m. on Wednesday, April 26, 2023, in the regular meeting place of the Board of GSFA, 1215 K Street, Suite 1650, Sacramento, California 95814, or as soon thereafter as the Board may reach the matter. In addition, it is expected that the public hearing will be continued to 8:30 a.m. on Friday, May 12, 2023, at 999 Yosemite Drive, Chico, California 95928.   Members of the public can watch, listen or participate remotely using the methods prescribed in an agenda to be made available in advance of each public hearing described immediately above at https://www.gsfahome.org/about/public-records.shtml.

This Notice briefly summarizes the Resolution. You should read the Resolution itself for the definitive description of the District’s financing program, including a description of the costs and the improvements that are authorized for this method of financing.  The Resolution can be found at https://legistarweb-production.s3.amazonaws.com/uploads/attachment/pdf/1822117/SB_555_PACE_Program_Revisions_ATTACH_1.pdf. A copy of Resolution No. 23-05 also may be reviewed or obtained at the office of the Secretary of GSFA, 1215 K Street, Suite 1650, Sacramento, California.

As provided in the Act, the Board must hold a public hearing before the Board may make these proposed alterations to the District. This is the notice of the public hearing.

At the public hearing, any persons interested, including all taxpayers, property owners, and registered voters, may appear and be heard, and the oral or written testimony of all interested persons or taxpayers for or against the proposed alterations or any other matters contained in the Resolution will be heard and considered. Any protests to the proposal may be made orally or in writing by any interested persons, except that any protests pertaining to the regularity or sufficiency of the proceedings must be in writing and must clearly set forth the irregularities and defects to which objection is made. The Board may waive any irregularities in the form or content of any written protest and, at the public hearing, may correct minor defects in the proceedings.  All written protests not presented in person at the public hearing must be filed with the Secretary of the Board at or before the time fixed for the public hearing in order to be received and considered. Any written protest may be withdrawn in writing at any time before the conclusion of the public hearing.

After the conclusion of the public hearing, if written protests against one or more of the proposed changes have been filed and not withdrawn by 50% or more of the registered voters residing and registered within the territory of the District, or if written protests against one or more of the proposed changes have been filed and not withdrawn by the owners of one-half or more of the land area that is within the territory of the District and not exempt from the special tax, then such change or changes shall be eliminated from the resolution ordering changes and such change or changes shall not be included in a resolution for a period of one year from the date of the Board of Directors’ determination that a majority protest exists.

At the conclusion of the public hearing, the Board of Directors may abandon these proceedings or may, after passing upon all protests, determine to proceed with the changes set forth in this resolution.  If the Board determines to proceed with the changes, then the election procedure shall be combined with any other elections required by law, and will consist of the execution of Unanimous Approval Agreements as provided in Sections 53328.1, 53329.6 and 53355.5 of the Government Code.

The GSFA Executive Director or such officer’s designee (the “Executive Director”) has studied the proposed changes and will provide, at or before the time of the public hearing, a report describing the following: A list of Authorized Improvements; a representative listing of incidental expenses; a recommended form of Unanimous Approval Agreement; recommendations for appropriate procedures and criteria for processing and evaluating applications for participation and annexation to the CFD from the owners of property within the territory of the CFD; recommended forms for properties to annex to the CFD; and an estimate of the related incidental expenses – all in accordance with the Resolution. Notice is hereby given that the Fresno Unified School DISTRICT (“DISTRICT”) will receive sealed bids for Bid No. 23-63, Edison High School Existing Gym Ceiling Repair, to replace existing damaged ceiling with new tectum panels.

DISTRICT hereby notifies all bidders that they will affirmatively ensure that in any Contract entered into pursuant to this advertisement, disabled veteran business enterprises (DVBE) will be afforded full opportunity to submit proposals in response to this invitation and will not be discriminated against on the grounds of race, color, creed, sex or national origin in consideration for award.
