SUMMARY
NOTICE is hereby given that at its regularly scheduled meeting on March 25, 2025, the Fresno County Board of Supervisors adopted Ordinance No. 25-007, an Ordinance of the County of Fresno, State of California. 
SUMMARY OF ORDINANCE
This ordinance amendment is pursuant to the Memorandum of Understanding (MOU) between the County and City of Fresno which provides an adjustment to the sales and use tax sharing ratio between the County and the City of Fresno. The proposed ordinance will allow the change ratio of the one-percent local Sales and Use Tax collected from within the City of Fresno returned to the County by the State Board of Equalization from the current 5.35% to 5%, beginning July 1, 2025. The resulting 5% is the same percentage contained in the MOUs of the other 14 cities in Fresno County.

NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, street rehabilitation on Barstow Avenue from Sunnyside Avenue to Fowler Avenue including pulverizing in place and replacing A.C. pavement; reconstructing concrete curb returns ramps, concrete sidewalk, concrete curb and gutter; adjustment of existing utility manholes and utility valve boxes to finish grades; replacement of traffic striping, markings and signage, traffic loop detectors; and traffic signal modification on the Barstow Avenue Street Improvements (“Project”).
A complete listing of bid quantities is contained in the bid proposal form.  Bids will be received for the complete work in accordance with the plans and specifications on file with the City Clerk at the Clovis Civic Center, Clovis, CA.  Plans and specifications, forms of proposal, contract and special provisions can be downloaded free of charge from the vendor portal of PlanetBids, Inc., which is accessible on the City of Clovis website.

Bid Proposal: Barstow Avenue Street Improvements
No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer.  Each bid must be accompanied by a certified or cashier’s check or bidder’s bond on the City’s form, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid.  Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract.  A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials (Payment) Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded.  Said bonds shall be on the City’s forms and shall be issued by a surety company which is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, which has a rating not lower than “A-” as rated by A.M. In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done.  Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612.  A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.
In accordance with the provisions of Sections 1725.5, 1771.1, 1771.3, and 1771.4 of the Labor Code, this project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal (subject to the requirements of Section 4104 of the Public Contract Code), or engage in the performance of any contract for public work, as defined by that chapter of the Labor Code, unless currently registered and qualified to perform public work pursuant to Section 1725.5 of the Labor Code.  See Section 7-2 of the Standard Specifications (General Conditions) for additional requirements. 
All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form.  The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”.  Bidders for this project must possess a valid Class A or C12 License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available.  Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract.  All representations made on the proposal are made under penalty of perjury.
The project is subject to the contracting requirements and implementing regulations as amended in Title 13, Section 2449 General Requirements for In-Use Off-Road Diesel-Fueled Fleets, of the California Code of Regulations (13 CCR § 2449(i)). Bidders must submit a valid Certificate of Reported Compliance (CRC) issued by the California Air Resources Control Board at the time of bidding. Bidders are responsible for submitting their listed subcontractors’ CRCs and any supporting documentation within five (5) calendar days of bid opening. Failure to submit the required CRCs may render a bid non-responsive.
The lowest bid shall be determined by the amount of the base bid. The Owner reserves the right to add or deduct any of the additive or deductive items after the lowest responsible and responsive bidder is determined.
The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.
Time of completion for the Project shall be Twenty-Five (25) Working Days from the date established in the Owner’s Notice to Proceed.
Unless otherwise required by law, no bidder may withdraw its bid for a period of sixty (60) days after the date set for the opening thereof or any authorized postponement thereof.  The Owner reserves the right to take more than sixty (60) days to make a decision regarding the rejection of bids or the award of the Contract.

This contract is subject to project prequalification pursuant to Public Contract Code section 20111.6.
Pre-Bid Conferences:
Bidders for ALL bid packages must attend at least one pre-bid conference in order to be eligible to submit a bid.
Mandatory Pre-bid conferences will be held on March 28 at 9:00 a.m., and April 8 at 9:00 a.m., at the Flag Pole in front of the Administration Building at Justin Garza High School, 4100 North Grantland Avenue, Fresno, California 93723.  You must attend one of the two walks to be eligible to bid.
Time of completion for this project shall be 720 calendar days (per construction manager’s bid schedule) from the start of the project as established within the Owner’s Notice to Proceed. All procurement, coordination, milestones, durations, activities, and sequences for the bid packages shall be performed as shown in the Construction Management Bid Schedule and Section 01320 of the specification and as modified by a monthly schedule update, if any.

Bids must be accompanied by a bidder’s bond, cashier’s check, or certified check for at least ten per cent (10%) of the amount of the base bid and made payable to the Owner, issued by an Admitted Surety (an insurance organization authorized by the Insurance Commissioner to transact business of insurance in the State of California during this calendar year), which shall be given as a guarantee that the bidder will enter into a contract if awarded the work and will be declared forfeited, paid to, or retained by the Owner as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the Owner after being requested to do so.
This Contract is subject to prequalification pursuant to Public Contract Code section 20111.6. If a bidder is not prequalified for this Project to bid on the Contract, Owner will not accept the bid.  Any subcontractors the bidder lists for work requiring C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, or C-46 licenses must have current pre-qualified status with the Owner for this Project.  Contractors not currently prequalified by the Owner for this Project must submit the prequalification application to the Owner by the date specified in the application.  Bidders may prequalify through Quality Bidders.  The Owner’s approved contractor prequalification list for this Project will be posted on the Facilities Planning webpage.  All prequalification packets must be submitted no later than 12:00 p.m., May 2, 2025. Only bidders who have been prequalified on or before May 2, 2025, will be eligible to bid this project.
The Contractor shall be required to satisfy the conditions set forth in the contract and Education Code section 45125.2 regarding fingerprinting requirements and student safety prior to permitting any contact with students.  Upon award of the contract and before beginning work, the Contractor shall be required to provide a verification of compliance with the student safety provisions of the contract and Education Code section 45125.2.
The Owner will require the successful Bidder to achieve the minimum goal of 3% DVBE (Disabled Veteran Business Enterprises) established in the bidding documents or to provide acceptable evidence of good faith efforts to do so accompanying the bid.       
The successful bidder will be required to furnish a Payment (Labor and Material) Bond in the amount of one hundred per cent (100%) of the contract price, and a Faithful Performance Bond in the amount of one hundred per cent (100%) of the contract price, said bonds to be secured from an Admitted Surety (an insurance organization authorized by the Insurance Commissioner to transact business of insurance in the State of California during this calendar year), and satisfactory to the Owner.  The surety insurers must, unless otherwise agreed to by Owner in writing, at the time of issuance of the bonds, have a rating not lower than “A-” as rated by A.M. Best Company, Inc. or other independent rating companies.  Owner reserves the right to approve or reject the surety insurers selected by the successful bidder and to require the successful bidder to obtain bonds from surety insurers satisfactory to the Owner.  The bidder will be required to furnish insurance as set forth in the Contract Documents.
The successful bidder will be allowed to substitute securities or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the General Conditions.
The Owner will not consider or accept any bids from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors.  In accordance with Section 3300 of said Code, the Contractor shall have a license classification as described in the MULTIPLE PRIME CONTRACT SCHEDULE. 
Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. Bidder shall state the public works contractor registration number on the designation of subcontractors form for each subcontractor performing more than one-half of one percent (0.5%) of the bidder’s total bid.  No bid will be accepted nor any contract entered into without proof of the contractor’s and subcontractors’ current registration with the Department of Industrial Relations to perform public work. If awarded a Contract, the Bidder and its subcontractors, of any tier, shall maintain active registration with the Department of Industrial Relations for the duration of the Project. In bidding on this project, it shall be the Bidder’s sole responsibility to evaluate and include the cost of complying with all labor compliance requirements under this contract and applicable law in its bid.
The lowest bid shall be determined as follows: The lowest total of the prime bid on the base contract and the bids on all additive items and all deductive items.  (Public Contract Code section 20103.8, subd. (b).) The District reserves the right to add or deduct any of the additive or deductive items from the project or contract after the lowest responsible and responsive bidder is determined.
The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages and rate for legal holidays and overtime work as set forth in the Agreement.  The Contractor must pay for any labor therein described or classified in an amount not less than rates specified.  Copies of the required rates are on file at the Owner’s business office and are available to any interested party on request.
The Owner reserves the right to waive any irregularity and to reject any or all bids.  Unless otherwise required by law, no bidder may withdraw its bid for a period of 60 days after date set for the opening thereof.
