The Fresno County Board of Supervisors is giving notice that at their regularly scheduled meeting on December 13, 2022, at 9:00 a.m., or as soon thereafter as the matter may be heard, at the Fresno County Hall of Records, Board of Supervisors Chambers, 3rd Floor, 2281 Tulare Street, Fresno, California, they will consider adoption of the ordinance summarized below.
SUMMARY OF PROPOSED ORDINANCE
The proposed amendments to Chapter 1.13 conform the administrative fine amounts contained in Fresno Ordinance Code § 1.13.110 for infraction violations of Fresno County Ordinance Code provisions to the higher levels allowed by California Government Code § 25132 and add a provision as Fresno Ordinance Code § 1.13.145 for the collection of abatement costs via special assessment on a property tax bill. Specifically, the proposed ordinance increases administrative fines for infractions that are violations of County building and safety codes to $130 for the first violation, $700 for the second violation, and $1,300 for the third violation occurring within one year of the issuance of the first citation. An additional level of fines is adopted to impose a fine of $2,500 per additional violation within two years of the first violation for improved commercial property where the owner has failed to remove visible refuse or prohibit unauthorized use of the property. Language is also added to Section 1.13.110 clarifying that each day a violation exists constitutes a new and separate violation for purposes of administrative fines.
