DISPOSAL OF BIOSOLIDS. This request is for a THREE (3) year Contract with TWO (2) optional ONE (1) year extensions.

NOTICE is hereby given that at its regularly scheduled meeting on December 12, 2023, the Fresno County Board of Supervisors adopted Ordinance No. 23-017, an Ordinance of the County of Fresno, State of California. 
SUMMARY OF ORDINANCE
The Ordinance to amend Chapter 13.28, to Title 13 of the County of Fresno ordinance Code
(the “Ordinance Amendment”) setting out alternative procedures to exempt certain leases, licenses or subleases of any real property belonging to, leased by, or licensed by the County  (“County Real Property” from formal and informal bidding; to authorize the County Administrative Officer, of his/her designee, to approve and execute certain leases and licenses under Chapter 13.28 to Title 13 of the County of Fresno Ordinance Code, with such authorization expiring December 31, 2028; and waive the reading of the proposed Ordinance Amendment in its entirety and adopt the proposed Ordinance Amendment.

SUMMARY OF PROPOSED ORDINANCE
To amend Fresno County Ordinance code, Title 8, to add Chapter 8.52, “Fresno County Infectious Materials Ordinance,” which will give the County authority to address the lack of federal regulation for laboratories that currently do not fall under federal regulations 42 United States Code (USC) § 263a and 42 Code of Federal Regulations (CFR) § 493. Specifically, the Ordinance will provide authority for the County to conduct onsite visits of private property and evaluate if laboratories that are not regulated by Clinical Laboratory Improvement Amendments (CLIA) are in compliance with Hazardous Materials laws and general applicable clinical laboratory safety requirements. Although the Ordinance applies to laboratories located within the County’s jurisdiction, incorporated cities can sign an MOU with the County that allows the County the authority to go onto private property within the incorporated cities to conduct this type of oversight and inspection.

Additionally, the combined business location and device fee cap will increase for specified locations and commercial weighing and measuring devices.

SUMMARY OF ORDINANCE
On December 12, 2023, the Board of Supervisors of the County of Fresno adopted an ordinance to amend the Medium High Density Residential land use designation in the County-adopted Caruthers, Clovis, Del Rey, Fresno High-Roeding, and Riverdale Community Plans to allow a density of up to 20 dwelling units per acre as is implemented in the County General Plan’s Medium High Density Residential land use designation by the approval of General Plan Amendment No. 563 on November 24, 2020; amend the County-adopted Del Rey Community Plan boundary to encompass an 18-acre parcel identified as APN 350-080-68T; amend the County-adopted Caruthers Community Plan and rezone a 3.41-acre parcel identified as APN 043-201-27 from the R-1 (Single Family Residential) Zone District to the R-2 (Low Density Multiple Family Residential) Zone District, amend the County-adopted Clovis Community Plan and rezone a 2.84-acre parcel identified as APN 495-061-25 from the C-2 (Community Shopping Center) Zone District to the R-3 (Medium Density Multiple Family Residential) Zone District, amend the County-adopted Del Rey Community Plan and rezone a 6.5-acre portion of an 18-acre parcel identified as APN 350-080-68T from the AE-20 (Exclusive Agricultural, 20-acre minimum parcel size) Zone District to the R-3 (Medium Density Multiple Family Residential) Zone District, amend the County-adopted Del Rey Community Plan and rezone an 11.5-acre portion of an 18-acre parcel identified as APN 350-080-68T from the AE-20 (Exclusive Agricultural, 20-acre minimum parcel size) Zone District to the R-1 (Single Family Residential) Zone District, amend the Fresno-Roeding Community Plan and rezone a 1.73-acre parcel identified as APN 442-341-07 from the R-R (Rural Residential) Zone District to the R-3 (Medium Density Multiple Family Residential) Zone District, and amend the Riverdale Community Plan and rezone a 6.48-acre parcel identified as APN 053-260-24S from the R-1 (Single Family Residential) Zone District to the R-2 (Low Density Multiple Family Residential) Zone District.
