NOTICE OF PUBLIC HEARING
REGARDING ANNEXATION OF TERRITORY TO
CITY OF FRESNO
COMMUNITY FACILITIES DISTRICT NO. 9
ANNEXATION NO. 20
Notice is hereby given that on October 12, 2017, the City Council of the City of Fresno (“City”) adopted Resolution 2017-274 to annex the territory known as Assessor’s Parcel Number 403-021-03 to the City of Fresno Community Facilities District No. 9 (“CFD No. 9”) and to authorize the levy of Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”).  Under this City Law and Resolution 2017-274, the City gives notice as follows:
The text of Resolution 2017-274, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Resolution 2017-274 is summarized as follows:
a.            As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 9, the boundaries of which are shown on the map on file with the City Clerk.
b.            The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions.  These improvements include, without limitation, landscaping and irrigation systems, street trees, median hardscaping, local street curbs, gutters, sidewalks, street paving, street name signage and street lights, trails and trail amenities (“Services”).
c.            The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the rate and method of apportionment described in Resolution 2017-274 and Exhibit C thereto.  The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.
d.            The Special Tax, if approved, will be used to finance all or a portion of the Services.
e.            The Director of Public Works or his designee of the City is directed to cause to be prepared a written report for CFD No. 9, Annexation No. 20 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.
f.             As set forth below, the City will hold a public hearing on the annexation of Assessor’s Parcel Number 403-021-03 to CFD No. 9 with its Services and Special Tax.
g.            The time and place established under Resolution 2017-274 for the public hearing required under City Law are Thursday, November 9, 2017, at 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.
            At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.
            The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 9.

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the County of Fresno.
REQUEST FOR RELEASE OF FUNDS
On or about November 17, 2017 the County of Fresno will submit a request to HUD for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as Environmental Assessment No. 7309 – Ringo Park Restroom Replacement for the purpose of replacing the existing restroom with a pre-fabricated restroom, including removal and replacement of appurtenant improvements such as concrete and utilities, lighting and electrical improvements, and the installation of security cameras; other existing park amenities, such as picnic tables and play equipment may be modified, improved, or replaced as funds allow at Ringo Park, located within the limits of the City of Selma, at the northwest corner of the intersection of Nebraska and Mitchell Avenues (APN: 388-030-14T). The estimated project cost is $125,000.00 and is anticipated to be funded completely through CDBG funds.
FINDING OF NO SIGNIFICANT IMPACT
The County of Fresno has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at 2220 Tulare Street, Suite A, Fresno, CA 93722 and may be examined or copied Monday through Thursday, 9 a.m. to 5 p.m.  Friday, 8:30 a.m. to 12:30 p.m. The ERR is also available online at the following address: http://www.co.fresno.ca.us/InitialStudies.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Christina Monfette by email at cmonfette@co.fresno.ca.us or by mail at 2220 Tulare Street, Sixth Floor, Fresno, CA 93721.  All comments received by November 16, 2017 will be considered by the County of Fresno prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The County of Fresno certifies to HUD that Steven White, in his capacity as Director of the Department of Public Works and Planning, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County of Fresno to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the County of Fresno’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Fresno; (b) the County of Fresno has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at One Sansome Street, Suite 1200 San Francisco, CA 94104.  Potential objectors should contact HUD to verify the actual last day of the objection period.
