JOINT NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION FOR CITY OF CLOVIS DOG PARK MASTER PLAN AND NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on Monday, December 2, 2019, at 6:00 p.m., a public hearing will be conducted in the Council Chambers of the Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612. The Clovis City Council will consider the proposed Dog Park Master Plan in accordance with the California Environmental Quality Act (CEQA). On October 24, 2019, the Planning Commission considered the project and recommended approval to the City Council.
The Dog Park Master Plan is a citywide policy document that includes goals establishing best practices, design standards, and planning recommendations for the long-term expansion of a dog park system within the City of Clovis. The Dog Park Master Plan is intended primarily as a planning policy document and additional planning, design, and/or permits may be required for the actual construction or buildout of said facilities. The Dog Park Master Plan identifies several candidate Parks and priority Sites within existing City parks as appropriate locations for future dog parks. Dog parks constructed on selected sites, would occupy a small portion of the existing areas of candidate Parks and priority Sites, and would not result in the expansion of candidate Parks and priority Sites. The priority Sites selected are Sierra Bicentennial, Letterman and Pasa Tiempo Parks.
A Mitigated Negative Declaration has been completed for this project, pursuant to 15070 of CEQA, which means that the City has tentatively concluded that the project would not have a significant effect on the environment with the incorporation of proposed mitigation measures. Recommendation of a proposed Mitigated Negative Declaration does not necessarily mean this project will be approved. Hard copies and electronic copies of the proposed Mitigated Negative Declaration for this project may be reviewed and/or obtained at the City of Clovis Planning and Development Services Department, 1033 Fifth Street, Clovis, California, Monday through Friday, between 8:00 a.m. and 3:00 p.m., or online at www.cityofclovis.com.
All interested parties are invited to comment in writing. If the commenter believes that the project may have a significant environmental effect, it would be helpful to identify the specific effect, explain why the effect would occur, and why it would be significant. On November 14, 2019, at the time of day indicated below, or as soon thereafter as possible, a public hearing will be held in Room 301, Hall of Records, Tulare and “M” Streets, Fresno, California, to consider all items contained within this agenda that are subject to the provisions of either the Fresno County Ordinance Code or the California State Planning Law. The Commission will also determine whether a Negative Declaration, Mitigated Negative Declaration or an Environmental Impact Report is appropriate on all projects for which an Initial Study (IS) has been prepared. PROGRAM ACCESSIBILITY AND ACCOMMODATIONS: The Americans with Disabilities Act (ADA) Title II covers the programs, services, activities and facilities owned or operated by state and local governments like the County of Fresno (“County”). Further, the County promotes equality of opportunity and full participation by all persons, including persons with disabilities. Towards this end, the County works to ensure that it provides meaningful access to people with disabilities to every program, service, benefit, and activity, when viewed in its entirety. NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to constructing a two-lane roundabout at the intersection of Temperance Avenue and Owens Mountain Parkway / Alluvial Avenue. Bids must be filed with the City Clerk at the Clovis Civic Center prior to 2:00 p.m., Tuesday, November 19, 2019, at which time the City Clerk will open said bids. Bids shall be submitted in sealed envelopes and marked:
Bid Proposal: Owens Mtn & Temperance Roundabout
No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer. Each bid must be accompanied by a certified or cashier’s check or bidder’s bond, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid. Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract. A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded. Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Clovis. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance. Pursuant to Public Contract Code Section 22300, substitution of securities for any monies withheld by the City of Clovis to ensure performance under the contract shall be permitted. In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.
In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done. Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612. A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.
The City of Clovis will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.
The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor are set forth in the Bid book and in copies of this book that may be examined at the offices described above where project plans, special provisions, and bid forms may be seen. The latest edition is also available from the Internet web site at www.gpo.gov and archives are available through the Wage Determinations Online Program. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to holders of Bid book. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. “Modifications” to the wage rates typically change the wage rate or fringe benefits for particular crafts and trades included in the original decision. Modifications will not be effective if they are received after the bid opening or later than ten (10) days prior to the bid opening (unless there is reasonable time to notify bidders). Modifications received prior to ten (10) days before the bid opening will require notification of bidders by Addendum.
Attention is directed to the Federal minimum wage rate requirements in the Bid book. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes “helper” (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in question.
Bidders are advised that, as required by federal law, the City of Clovis is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE). Section 2, “Proposal Requirements and Conditions,” under subsection titled “Disadvantaged Business Enterprises (DBE)” and Section 5, “General,” under subsection titled “Performance of Subcontractors” of these special provisions cover the DBE requirements. The DBE Contract goal is eighteen percent (18%). The Agency may consider the DBE commitments of the 2nd and 3rd bidders when determining whether the low bidder made good faith efforts to meet the DBE goal.
This project is subject to “Buy America” requirements of the Surface Transportation Assistance Act of 1982 (Section 165), and the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) Sections 1041(a) and 1048(a), Title 23 CFR 635.410, and the regulations adopted pursuant thereto.
This project is also subject to the Cargo Preference Act (CPA) implementing regulations in Title 46 CFR 381, “Cargo Preference – U.S.-Flag Vessels”, for all Federal-aid projects.
All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form. The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”. Bidders for this project must possess a valid Class A or C12 License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available. Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract. All representations made on the proposal are made under penalty of perjury.
The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.

Notice of Public Hearing – Dunlap Road Vacation of Excess Right-of-Way
RESOLUTION OF INTENTION AND NOTICE OF HEARING
BEFORE THE BOARD OF SUPERVISORS
OF THE COUNTY OF FRESNO
STATE OF CALIFORNIA
IN THE MATTER OF THE VACATION OF EXCESS PUBLIC ROAD RIGHT-OF-WAY OF DUNLAP ROAD
VACATION APPLICATION NO. V15-03
WHEREAS, the Director of the Department of Public Works and Planning informs this Board that the Department initiated the process to vacate excess public road right-of-way of Dunlap Road, located approximately 3.5 miles southeast of Kings Canyon Road along the frontage of Dunlap Elementary School and the Dunlap Community Club property (Vacation Application No. V15-03); and
WHEREAS, the Department of Public Works and Planning reviewed the General Plan and the proposed vacation, including the location, purpose, and extent of such proposed vacation, and reported in the Agenda Item for October 22, 2019, that the proposed vacation is consistent and in conformity with the General Plan; and
WHEREAS, the Department of Public Works and Planning recommends the following:
(1) That the Board of Supervisors declares its intent to hold a hearing pursuant to Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code (collectively, the “Vacation Laws”) for the proposed vacation of the excess right-of-way more particularly described in Exhibit A. A map showing the proposed vacation is on file with the Clerk of the Board.
(2) That the vacation procedure be conducted under the Vacation Laws.
(3) That a public hearing be set to consider the vacation of said right-of-way.
(4) That the Board of Supervisors consider the report of the Director of the Department of Public Works and Planning and make a finding that the proposed vacation is consistent and in conformity with the General Plan, pursuant to Government Code section 65402, subdivision (a).
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors to:
(1) Adopt the foregoing recitals as true and correct.
(2) Direct the Clerk of the Board to publish for at least two successive weeks prior to the hearing, a notice of intent to vacate, and direct the Department of Public Works and Planning to post notice of the same, pursuant to the Vacation Laws.
(3) Set the public hearing to consider vacation of said right-of-way for the hour of 9:00 a.m. on November 19, 2019 in the Chambers of the Board of Supervisors, Room 301, Hall of Records, Tulare and “M” Streets, Fresno, California.
(4) Consider the report of the Director of the Department of Public Works and Planning on the proposed vacation, and make a determination whether it is consistent and in conformity with the General Plan, pursuant to Government Code section 65402, subdivision (a).

RESERVING THEREFROM:
