REQUEST FOR RELEASE OF FUNDS
On or about December 9, 2019 the County of Fresno will submit a request to the HUD for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as Environmental Assessment No. 7661: Panzak Park Restroom Replacement Project for the purpose of replacing the existing restroom at the park with a new pre-fabricated building that will meet the standards of the Americans with Disabilities Act, estimated funding to include $169,412.00 of HUD funding and approximately $134,828 additional, non-federal funding, located in Panzak Park, Fowler, CA.
FINDING OF NO SIGNIFICANT IMPACT
The County of Fresno has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. HUD will accept objections to its release of funds and the County of Fresno’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Fresno; (b) the County of Fresno has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to U.S. Department of HUD, CPD Office, San Francisco Regional Office-Region IX, 1 Sansome Street, Suite 1200, San Francisco, CA 94104. The Fresno County Board of Supervisors is giving notice that at their regularly scheduled meeting on December 10, 2019 at 9:00 a.m., or as soon thereafter as the matter may be heard, at the Fresno County Hall of Records, Board of Supervisors Chambers, 3rd Floor, 2281 Tulare Street, Fresno, California, they will consider adoption of the ordinance summarized below.
SUMMARY OF PROPOSED ORDINANCE
The proposed ordinance amends Chapter 2.38 to Title 2 of the Fresno County Ordinance Code relating to the Children and Families Commission of Fresno County (“Commission”). The proposed ordinance deletes subsection §2.38.010(D), which prohibits a Commission Board member, or certain of their family members, from being employed by, consult for or contract with an organization that receives funding from the Commission. The proposed ordinance also deletes obsolete language in subsection §2.38.010(A) that relates to the reduction in the number of Commission Board members from 9 to 7, and which members/seats would be removed, effective September 19, 2014.
