If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due. If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the foreclosure commissioner after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder. There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. NOTICE INVITING SEALED BIDS FOR WATER SYSTEM RELIABILITY PROJECT – WATER STORAGE TANK, ANCILLARY FACILITIES,
WELL NO. 5 IMPROVEMENTS AND PIPELINE CONNECTIONS LONDON COMMUNITY SERVICES DISTRICT
NOTICE IS HEREBY GIVEN that the Board of Directors of the London Community Services District invites all and will receive sealed Bids at the office of the Engineer, 209 South Locust Street, Visalia, California, up to the hour of 2:00 p.m. on the 18th day of December 2025, for the construction of improvements to an existing municipal water well (Well No. 5), welded steel water storage tank, booster pump system, hydropneumatic tank, emergency electrical generator, automatic transfer switch, site earthwork, surfacing, fencing, pipeline connection to the water distribution system, electrical building, electrical, controls, instrumentation, PG&E new service installation/connection and Well No 1 destruction.
The award will be made to the lowest responsible bidder in accordance with these Contract Documents, but the District reserves the right to reject any and all Bids and waive minor discrepancies in the bid.
Copies of the contract documents are on file and may be examined in the offices of the Engineers from 8 a.m. to 5 p.m. Plans and Specifications may be obtained from the office of the Engineer, Dennis R. Keller Consulting Civil Engineer, Inc. 209 South Locust Street, Visalia, California. A non-refundable charge of one hundred fifty ($150.00) dollars will be required for each set of Plans and Specifications which includes shipping. Questions regarding the Bidding Documents shall be directed to James Blair of the office of the Engineer at (559) 732-7938. Only Contractors obtaining Plans and Specifications from the office of the Engineer will be allowed to submit a sealed Bid.
Each Bid shall be made out or submitted on the form included with the Specifications and must be accompanied by a cashier’s check, a certified check, or a bidder’s bond, or substitute pursuant to Section 995.710 of the Code of Civil Procedure, in an amount not less than ten (10) percent of the amount of the bid, made payable to the order of the London Community Services District and each bid proposal shall be sealed and filed with the Engineer at or before the time provided in this Notice. The above-mentioned check, bond, or substitute shall be given as a guarantee that the bidder will enter into a contract with the District if awarded the work and will be declared forfeited if the successful bidder refuses to enter into said contract.
The successful bidder will be required to furnish within fifteen (15) calendar days from the award of the Contract, a faithful Performance Bond in an amount equal to one hundred (100) percent of the contract price and a Payment Bond in an amount equal to one hundred (100) percent of the contract price, said bonds to be obtained from a surety company satisfactory to the District. The successful bidder will also be required to furnish insurance in defined coverages and amounts in accordance with the specifications.
The London Community Services District hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunities to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done.
The London Community Services District advises potential bidders that the project is funded in whole or part with federal grant funds through the California Drinking Water State Revolving Fund (DWSRF).
Contractors will be required to comply with all requirements of the California prevailing wage provisions, the Davis-Bacon Act, the Disadvantaged Business Enterprise (DBE) Participation requirements, including all DBE good faith efforts, Iran Contracting Act Certification, American Iron and Steel (AIS), debarment and suspension per Executive Order 12549, trafficking of persons, nondiscrimination per Executive Order 11246, non-segregated facilities, drug-free workplace, procurement prohibition under federal system for Award Management – http://www.sam.gov/ and other requirements of the DWSRF Program.
American Iron and Steel (AIS) Requirements apply to this project. P.L. 113-76, Consolidated Appropriations Act, 2014 (Act), includes an “American Iron and Steel (AIS)” requirement in section 436 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States.
Contractors that submit a Bid are encouraged to attend a non-mandatory pre-Bid meeting at the work site (meet at Well No. 5 site) on Monday, November 3, 2025, at 11:00 a.m., rain or shine. The primary topic will be electric panel install schedule for PG&E meter, coordination of equipping Well No. 5 and disconnection and reconnection of the well to the District’s distribution system, DBE and AIS requirements for this DWSRF funded project.
The submitted Bid Proposal shall include a notarized Non-collusion Declaration.
The Contractor is to comply with the Six (6) Good Faith Efforts (GFE) listed in the specifications to ensure that DBEs have the opportunity to compete. Failure of the apparent low bidder to perform the GFE prior to bid opening constitutes a non-responsive bid. The construction contract may then be awarded to the next low, responsive, and responsible bidder that meets the requirements, or the District may re-advertise the Project.
The three (3) lowest bidders shall submit to the Engineer all DBE documentation required in these specifications.  The documentation shall be submitted to the office of the Engineer the next business day after the Bid opening date and before 5:00 p.m.
Provision is made in the Specifications to permit the substitution of securities for any moneys withheld by the District to ensure performance under the Contract. At the request and expense of the Contractor, any payments withheld by the District to ensure performance under this contract shall be deposited with an Escrow Agent who may either be the District, or a State or Federally chartered bank, and who shall pay such moneys withheld to the Contractor upon the depositing of eligible securities into the Escrow account by the Contractor and upon the satisfactory completion of the contract. Eligible securities pursuant to this section shall be securities that are eligible for investment of State funds as listed in Section 16430 of the Government Code of the State of California, or bank or savings and loan certificates of deposit.
The Contractor shall be the beneficial owner of any securities substituted for money withheld and deposited in the Escrow account pursuant to this section, and shall receive any interest thereon.
In accordance with the provisions of California Public Contract Code Section 3300, the District has determined that the General Contractor shall possess a valid Class A Contractor’s license. A C57 contractor’s license is required for Well No 1 destruction. Failure to possess said license at the time of award shall render the bid non-responsive and shall act as a bar to award of a contract to any bidder not possessing said license.
All terms and conditions contained in the contract documents including the information to bidders shall become a part of the contract. No bidder may withdraw his bid for a period of one hundred twenty (120) days after the time set for the opening thereof. Substantial Completion of the Work shall be completed two hundred seventy-five (275) days after issuance of the Notice to Proceed. Liquidated damages shall be assessed according to the Contract Documents for each calendar day thereafter that the Work under Substantial Completion is not completed. Final completion of the Work shall be completed three hundred twenty (320) days after the issuance of the Notice to Proceed. Liquidated damages shall be assessed according to the Contract Documents for each calendar day thereafter that the Work is not completed.
