NOTICE OF INTENTION TO CIRCULATE RECALL PETITION

TO FRESNO UNIFIED SCHOOL DISTRICT TRUSTEE TERRY SLATIC: Pursuant to Section 11020, California Elections Code, the undersigned registered qualified voters of Fresno Unified School District Board of Education, Trustee Area No. 7, in the State of California, hereby give notice that we are the proponents of a recall petition and that we intend to seek your recall and removal from the office of Fresno Unified School District Board of Education Trustee Area No. 7, of the County of Fresno, California, and to demand election of a successor in that office.

The grounds for the recall are as follows:

We call for the removal of Terry Slatic as Trustee for the Bullard area. This is the only way to stop his abusive, traumatizing behavior toward students and staff. He fails to meet the minimum standards expected of an elected representative. In eight short months, despite repeated requests, Slatic’s aggressive and confrontatinal behavior has included but are not limited to:

·  A physical altercation with a Bullard High student;

·  Intimidating and humiliating an army recruiter on campus;

·  Threatening a wrestling coach in a hostile and aggressive manner;

·  Threatening to end the Bullard cheer team if cheerleaders speak out, leaving several girls upset and in tears.

Trustee Slatic continues to make inappropriate demands, exceeding his authority as a Trustee. His bullying and outrageous conduct has stoked fear in students and parents. He refuses to take responsibility.  He is a distraction from FUSD’s primary mission of educating our children.

On August 7th, all his fellow trustees censured Slatic, condemning his unacceptable conduct. Slatic was removed from all committee assignments until he completes an anger management program and suspended from officially representing the district. Slatic’s actions have cost Fresno Unified over $100,000 — funds that should support our students.

We demand the recall of Trustee Slatic.

The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code.  The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City.  A copy of the resolution is on file at the Office of the City Clerk.  Actual wage schedules are available at Construction Management Office, 1721 Van Ness Avenue, Fresno, California 93721, (559) 621-5600.

Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager and must be accompanied by a Bid Deposit in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount.  All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected.

The City of Fresno hereby notifies all Bidders that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation, ethnicity, status as a disabled veteran or veteran of the Vietnam era or on any other basis prohibited by law.

The City will carry out applicable federal requirements in the award and administration of any contract awarded hereunder.  This is a federal project funded in full or in part by the U.S. Department of Transportation, Federal Transit Administration (FTA).  The successful proposer shall be knowledgeable of and in compliance with Federal Third – Party Contract Clauses.

DISADVANTAGED BUSINESS ENTERPRISE (DBE)

It is the policy of the Department of Transportation and the City of Fresno that Disadvantaged Business Enterprises (“DBE”) as defined in 49 CFR part 26 shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds.  The City’s overall goal for DBE participation is 12%. This project does not have a mandated DBE goal.

The goal is accomplished through the use of race-neutral measures in accordance with 49 CFR, Part 26.  The City shall take all necessary steps to ensure nondiscrimination in the award of all contracts to meet the objectives of the above cited regulation.  When listing sub-contractors on page 1.8, Bidder shall identify them as a DBE with the approximate value of their sub-contract.

A pre-bid conference and site visit will be held at 10:00 a.m., October 23, 2019 in the lower conference room, FAX Administration Building, located at 2223 “G” Street, Fresno, California.  Prospective Bidders are encouraged to attend since City Staff will be present to answer any questions regarding the Specifications, and there may be an inspection tour of the job site(s).

Funding for this project is through the Surface Transportation Block Grant (STBG) Program administered by Caltrans on behalf of the Federal Highway Administration. The payment method for this agreement will be “Lump Sum” per Caltrans guidelines.

The City of Fresno will widen Polk Avenue between Gettysburg Avenue and Shaw Avenue. This project includes construction of curb, gutter, sidewalk, street lights, pavement, and drainage facilities. Drainage facilities will also be installed on Shaw Avenue between Hayes Avenue and Polk Avenue.

Scope of Services

The selected firm will be required to: Review existing documents, reports, and Caltrans exhibits including the Preliminary Environmental Study (PES) and prepare environmental studies and technical memos required by the PES. Studies may include: Traffic Technical Memo, Noise Study Report and Noise Abatement Decision Report (NADR), Air Quality Report, Biological Resources Technical Memo, Relocation Impacts Memo, Land use and Community Impact Assessment, Cultural Resources Study including APE map and Historic Property Survey Report (HPSR) including an Archeological Survey Report (ASR) and a Historical Resources Evaluation Report (HRER)

Consultant must provide up to two iterations of all studies and technical memos.
