You will be bidding on a lien, not on the property itself. Placing the highest bid at a trustee auction does not automatically entitle you to free and clear ownership of the property. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on the property.  NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about trustee sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. If you wish to learn whether your sale date has been postponed, and, if applicable, the rescheduled time and date for the sale of this property, you may call (800) 280-2832 or visit this Internet Web site WWW.AUCTION.COM, using the file number assigned to this case 073404-CA. Information about postponements that are very short in duration or that occur close in time to the scheduled sale may not immediately be reflected in the telephone information or on the Internet Web site. The best way to verify postponement information is to attend the scheduled sale. FOR SALES INFORMATION: (800) 280-2832 CLEAR RECON CORP 4375 Jutland Drive San Diego, California 92117

FIRST AMENDED COMPLAINT FOR DAMAGES FOR VIOLATION OF FRESNO MUNICIPAL CODE

IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA

IN AND FOR THE COUNTY OF FRESNO

CITY OF FRESNO, a municipal corporation; and PEOPLE OF THE STATE OF CALIFORNIA

Plaintiffs,

vs.

MARGARET EASLEY; and Does 1 through 10 inclusive,

Defendants.

Case No.: 17CECG01695

Action Filed: 05/15/17

Trial Date: Not Set

Plaintiffs, City of Fresno and People of the State of California allege:

1.  Plaintiff, City of Fresno (City) is, and at all times herein mentioned was, a charter municipal corporation, duly organized and existing under and by virtue of the Constitution of the State of California.

2.  The City is authorized to bring a civil action for public nuisance abatement when a nuisance exists within the City in the name of the “People of the State of California”.  (CCP §731.) The Fresno Municipal Code makes it unlawful to own or control a property with a public nuisance.  (FMC §10-605.) Public nuisances include, but are not limited to rubbish, junk, abandoned cars, weeds, blighted vacant buildings and attractive nuisances.  (Civ. Code §§3479-3481; FMC §§10-605, 10-617.) When a nuisance exists, the City is permitted to obtain a judgment for damages, enjoin the continuance of the nuisance, or enter upon and correct it.  (CCP §731).

3.  The Fresno Municipal Code also provides the City with several modalities to collect on unpaid abatement costs incurred by the City or penalties issued by it resulting from an ongoing public nuisance, including obtaining a personal judgment (FMC §1-510.)

4.  City is informed and believes and thereon alleges that Defendant, Margaret Easley, (and Does 1 through 10 inclusive, collectively Defendant) are, and at all times mentioned herein were, the record owners and operators of the real property, 1227 East Byrd Avenue, Fresno, California, APN 479-162-14 (the Subject Property).

5.  Defendants Does 1 through 10, inclusive, are sued herein under fictitious names.  Their true names and capacities are unknown to City.  When their true names and capacities are ascertained, City will amend this complaint by inserting their true names and capacities herein.  City is informed and believes and hereon alleges that each of the fictitiously named Defendants is responsible in some manner for the occurrences, conditions and or violations herein alleged.

6.  From 2015, through to the present, the City has inspected the Subject Property for building/municipal code violations numerous times and has consistently found it abandoned, containing ongoing and uncorrected public nuisances including broken windows and doors boarded with plywood in violation of the Fresno Municipal Code, oxidized painted exterior stucco surfaces, garage converted to a living space without permits or inspection, and overgrown vegetation.

7.  From 2015, until the present, the City has noticed owner to correct the public nuisance, without affect.  The City has completed several inspections and issued a Notice and Order regarding the violations, which was not appealed.  The City has spoken with the Defendant to advise of the continuing violations and the City has been advised on numerous occasions the property would be taken care of, and the violations would be corrected.  Attached as Exhibit A is a true and correct copy of the Notice and Order to Remove Public Nuisance Violations issued on October 20, 2015.  Attached as Exhibit B is a true and correct copy of the First Administrative Citation issued on November 30, 2015.  Attached as Exhibit C is a true and correct copy of the invoice issued November 4, 2016, regarding the administrative costs incurred by the City on the Subject Property.

8.  As of March 16, 2018, the total unpaid amount owed by Defendants for the citations and the City’s code enforcement activities at the Subject Property is $33,038.84.  Attached as Exhibit D and incorporated herein by reference is a true and correct copy of the March 16, 2018, Demand for Payoff.

9.  The City continues its efforts on the Subject Property to compel the Defendant to abate the violations of the Fresno Municipal Code, and continues to incur administrative costs, abatement costs, and additional citations may be issued as the violations continue.

10.  But despite noticing the owner, issuing citations, and periodically abating the public nuisances on the Subject Property, the property remains in constant violation of FMC.

11.  The Fresno Municipal Code provides that any person issued a citation has a right to appeal, but if no appeal is filed the citations shall be final and immediately payable.  (FMC §1-308.)

12.  As of the filing of this complaint, the aforementioned costs and penalties remain unpaid and Defendant has failed to take all necessary corrective actions to bring the Subject Property into compliance.

WHEREFORE, Plaintiffs prays as follows:

1.  That Defendants, and each of them, be ordered to pay any and all abatement costs, administrative costs, and administrative citations issued relating to Public Nuisances on the Property, and judgment be entered in an amount according to proof at the time of trial and or Court or Clerk’s default judgment, which as of March 16, 2018, totaled $33,038.84;

2.  That Plaintiff City recover costs of suit from Defendants and each of them and or their successors and assigns, including reasonable attorney fees.  (Gov’t Code §38773.5, FMC §1-510.);

3.  The court take judicial notice under Evid. Code §452(b) of the Fresno Municipal Code, including sections 1-308, 1-510, 10-605 and 10-617;

4.  For such other and further relief as the court deems proper.

DATED: August 1, 2018.

Respectfully submitted,

a.  The text of Council Resolution 2018-267, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Council Resolution 2018-267 is summarized as follows:

b.  As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 11, the boundaries of which are shown on the map on file with the City Clerk.

c.  The purpose of CFD No. 11 is to provide financing for the maintenance of the landscaping and irrigation systems, open spaces, trails, concrete curbs, gutters, medians, hardscaping and sidewalks, street lights, local street paving and street name signage plus any added developer requested features (“Services”) located in street, landscaping and open space easements and public properties associated with the subdivision as more fully described in Council Resolution No. 2018-267 and Exhibit C thereto.

d.  The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 11 under the rate and method of apportionment described in Council Resolution 2018-267 and Exhibit D thereto.  The Special Tax requires the approval of two-thirds of the qualified electors of CFD No. 11 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.

e.  The Special Tax, if approved, will be used to finance all or a portion of the Services.

f.  The Director of Public Works of the City or his designee is directed to cause to be prepared a written report for CFD No. 11, Annexation 90 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 11 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

g.  As set forth below, the City will hold a public hearing on the annexation of Final Tract Map No. 6165, Assessor’s Parcel Number 316-022-62, and Assessor’s Parcel Number 316-022-63 to CFD No. 11 with its Services and Special Tax.

h.  The time and place established under Council Resolution No. 2018-267 for the public hearing required under City Law are Thursday, January 17, 2019, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.

At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 11, the extent of CFD No. 11 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 11, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 11 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 11 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 11, or against levying a specified Special Tax, those types of facilities or the specified Special Tax will be eliminated from the proceedings to annex to CFD No. 11.

The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 11

d.  The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 11 under the rate and method of apportionment described in Council Resolution 2018-297 and Exhibit D thereto.

11, Annexation No. 98 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 11 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

g.  As set forth below, the City will hold a public hearing on the annexation of Final Tract Map No. 6162 o CFD No. 11 with its Services and Special Tax.

h.  The time and place established under Council Resolution No. 2018-297 for the public hearing required under City Law are Thursday, January 17, 2019, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.

FAX now desires to continue this goal by implementing TSP at an additional thirty-one (31) intersections along its Shaw Avenue corridor. This RFI is ONLY for information related to TSP equipment intersection.
