Plaintiffs, City of Fresno and People of the State of California allege:

1.  Plaintiff, City of Fresno (City) is, and at all times herein mentioned was, a charter municipal corporation, duly organized and existing under and by virtue of the Constitution of the State of California.

2.  The City is authorized to bring a civil action for public nuisance abatement when a nuisance exists within the City in the name of the “People of the State of California”.  (CCP §731.) The Fresno Municipal Code makes it unlawful to own or control a property with a public nuisance.  (FMC §10-605.) Public nuisances include, but are not limited to rubbish, junk, abandoned cars, weeds, blighted vacant buildings and attractive nuisances.  (Civ. Code §§3479-3481; FMC §§10-605, 10-617.) When a nuisance exists, the City is permitted to obtain a judgment for damages, enjoin the continuance of the nuisance, or enter upon and correct it.  (CCP §731). 

3.  The Fresno Municipal Code also provides the City with several modalities to collect on unpaid abatement costs incurred by the City or penalties issued by it resulting from an ongoing public nuisance, including obtaining a personal judgment (FMC §1-510.)

4.  City is informed and believes and thereon alleges that Defendant, Margaret Easley, (and Does 1 through 10 inclusive, collectively Defendant) are, and at all times mentioned herein were, the record owners and operators of the real property, 1227 East Byrd Avenue, Fresno, California, APN 479-162-14 (the Subject Property).

6.  From 2015, through to the present, the City has inspected the Subject Property for building/municipal code violations numerous times and has consistently found it abandoned, containing ongoing and uncorrected public nuisances including broken windows and doors boarded with plywood in violation of the Fresno Municipal Code, oxidized painted exterior stucco surfaces, garage converted to a living space without permits or inspection, and overgrown vegetation. 

7.  From 2015, until the present, the City has noticed owner to correct the public nuisance, without affect.  The City has completed several inspections and issued a Notice and Order regarding the violations, which was not appealed.  The City has spoken with the Defendant to advise of the continuing violations and the City has been advised on numerous occasions the property would be taken care of, and the violations would be corrected.  Attached as Exhibit A is a true and correct copy of the Notice and Order to Remove Public Nuisance Violations issued on October 20, 2015.  Attached as Exhibit B is a true and correct copy of the First Administrative Citation issued on November 30, 2015.  Attached as Exhibit C is a true and correct copy of the invoice issued November 4, 2016, regarding the administrative costs incurred by the City on the Subject Property.

8.  As of March 16, 2018, the total unpaid amount owed by Defendants for the citations and the City’s code enforcement activities at the Subject Property is $33,038.84.  Attached as Exhibit D and incorporated herein by reference is a true and correct copy of the March 16, 2018, Demand for Payoff.

9.  The City continues its efforts on the Subject Property to compel the Defendant to abate the violations of the Fresno Municipal Code, and continues to incur administrative costs, abatement costs, and additional citations may be issued as the violations continue. 

10.  But despite noticing the owner, issuing citations, and periodically abating the public nuisances on the Subject Property, the property remains in constant violation of FMC.

11.  The Fresno Municipal Code provides that any person issued a citation has a right to appeal, but if no appeal is filed the citations shall be final and immediately payable.  (FMC §1-308.)

12.  As of the filing of this complaint, the aforementioned costs and penalties remain unpaid and Defendant has failed to take all necessary corrective actions to bring the Subject Property into compliance.

WHEREFORE, Plaintiffs prays as follows:

1.  That Defendants, and each of them, be ordered to pay any and all abatement costs, administrative costs, and administrative citations issued relating to Public Nuisances on the Property, and judgment be entered in an amount according to proof at the time of trial and or Court or Clerk’s default judgment, which as of March 16, 2018, totaled $33,038.84;

2.  That Plaintiff City recover costs of suit from Defendants and each of them and or their successors and assigns, including reasonable attorney fees.  (Gov’t Code §38773.5, FMC §1-510.);

3.  The court take judicial notice under Evid. Code §452(b) of the Fresno Municipal Code, including sections 1-308, 1-510, 10-605 and 10-617;

4.  For such other and further relief as the court deems proper.

e.  The Special Tax, if approved, will be used to finance all or a portion of the Services.

f.  The Director of Public Works of the City or his designee is directed to cause to be prepared a written report for CFD No. 11, Annexation 90 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 11 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

REQUEST FOR INFORMATION FOR:

Traffic Signal Priority (TSP) Intersection Equipment

BACKGROUND

In February 2018, the City of Fresno department of Transportation, Fresno Area Express (FAX), implemented a Transit Signal Priority (TSP) solution along its Bus Rapid Transit (BRT) route to improve bus schedule adherence and transit operational efficiency. FAX accomplished this by installing new or upgraded Opticom equipment on 73 intersections and 20 buses along with system management software. FAX now desires to continue this goal by implementing TSP at an additional thirty-one (31) intersections along its Shaw Avenue corridor. This RFI is ONLY for information related to TSP equipment intersection.

PURPOSE OF THE RFI

The primary purpose of this RFI is to acquire information on available TSP Intersection equipment that is natively compatible with existing Opticom/GTT Intersection Equipment and central management system (CMS) without the use of 3rd party conversion hardware of any sort. Cost information is also being sought for budgetary purposes in order for FAX to make a determination on the final standards and optional features available to meet FAX needs and requirements.  Vendor information shall be taken into consideration of the development of the bid specifications.

INSTRUCTIONS TO RESPONDERS

THIS IS A REQUEST FOR INFORMATION (RFI) ONLY. Project Item 4, is exempt from CEQA pursuant to a Class 32 categorical exemption.  Class 32 exemptions consist of in-fill development less than 5 acres in size meeting the conditions described in California Government Code Section 15332(a), (b), (c), (d) and (e).  A Notice of Exemption has been completed during the preliminary review and is kept for public review with the project file during the processing of the project application.  Staff will file the notice with the County Clerk if the project is approved.
