All that portion of Lot 2 of Tract No. 3587, in the City of Fresno, County of Fresno, State of California, according to the map recorded in Book 41 Pages 31 and 32 of plats, in the Office of the County Recorder, shown and defined as Unit 840 on the condominium plan of Tract No. 3587, recorded in Book 41 of Plats, at Page 33 to 37 inclusive, Official Records of said County and the First Amended Condominium Plant of Tract No. 3587 recorded October 9, 1984 in Book 42 of Plats, at Pages 20 to 24, inclusive, Fresno County Records.

An undivided one twenty-fourth (1/24th) interest, as a tenant-in-common, in and to all of said Lot 2 of Tract No. 3587, per map hereinabove described excepting therefrom all units shown and designated on the condominium plan for Tract No. 3587, which plan was recorded in the Office of the Fresno County Recorder as hereinabove described.

The aforementioned documents in Subparagraphs A to E, inclusive, are collectively referred to herein as Declaration.
(Said Enabling Declaration, Amended and Restated Enabling, Declaration, Amendment to the Amended and Restated Enabling Declaration and the Second Amended to the Amended and Restated Enabling Declaration are collectively referred to herein as “Declaration”).
Parcel Three (Easement):
The exclusive easement and right to the use of certain restricted common area appurtenant to Parcel 1 and Parcel 2, hereinabove described, as said restricted common area is described and depicted upon the condominium plan of Tract No. 3587, reference to which is hereby made.
Parcel Four (Easement):
A non-exclusive easement and right-of-way appurtenant to Parcel 1 and Parcel 2, hereinabove described, over and upon the common area (including the recreational common area but excluding the restricted common area) of Dominant Parcel, hereinabove described, and every part thereof, as said common area is described in Article 1, Subparagraph 6 of the Declaration and on the condominium plan for Lot 1 of Tract No. 3172, Lot 1 of Tract No. 3334, Lots 1 and 4 inclusive, of Tract No. 3540, and the Condominium Plan for Tract No. 3587, and on the Condominium Plan for Lots 3 and 4 of Tract No. 3587, should either of said Lots be annexed to the project, for the purposes of ingress and egress by the owners of said Parcel 1 and Parcel 2, hereinabove described, and for incidental, recreational horticultural purposes, all as set forth in Article 11 of the Declaration.

Prodigy Square Revised CUP
The City of Parlier has prepared an Initial Study and proposed Mitigated Negative Declaration (IS/MND) for the Project described below. The Initial Study did not identify any potentially significant effects on the environment that may result from the Project that cannot be mitigated to a less-than-significant level. Accordingly, adoption of a Mitigated Negative Declaration for this project is recommended. The Parlier City Council is anticipated to consider adoption of the IS/MND in conjunction with the relevant Project entitlement as part of a public hearing at a regular meeting to be held on February 16, 2023 at 6:30 PM in the Parlier City Council Chambers, 1100 E. Parlier Avenue, Parlier, CA.
Project Title:
Prodigy Square Revised CUP (Conditional Use Permit)
Project Location:
The Project Site consists of approximately 5.66 acres located at the southeast corner of E. Manning Avenue and S. Academy Avenue and includes Fresno County Assessor’s Parcel Numbers (APN) 358-390-61, 62, & 63 along with a portion of APN 358-390-25.
Project Description:
The applicant proposes to develop the vacant Project site into a gas station with a mini-mart, quick-serve restaurant, and second-floor office space; a drive-thru car wash with vacuum station; a standalone drive-thru quick serve restaurant; a standalone multi-tenant retail building with drive-thru; and a diesel fueling station and truck wash. Construction of the Project would involve demolition, grading, paving, building construction, and painting. Site access during construction would be via Manning Avenue, Academy Avenue, and Progress Drive as needed. Principal deliveries to the Project site would include construction equipment, imported earthwork materials, concrete and asphalt materials, building materials, and any additional hardware required to construct the Project. Material and equipment staging areas as well as construction crew parking would be contained on-site. Construction would be limited to the hours of 6am and 9pm, Monday through Friday, and 7am and 5pm on weekends. At this time, no Project construction commencement schedule has been identified.
Specific development would include:
· Two-story building containing a 4,900-SF mini-mart/Quick Serve Restaurant and 2,400-SF of offices
· 3,142-SF automobile fuel canopy with 12 gasoline pumps
· 1,590-SF truck fuel canopy with 4 diesel pumps
· 3,750-SF commercial building associated with the trucking area of the development
· 2,331-SF drive thru carwash
· 4,864-SF vacuum canopy area
· 1,130-SF restaurant with drive thru
· 4,904-SF undefined Retail Space with drive thru
To facilitate construction and operation of the Project, the City Council will consider approving a revision to the Prodigy Square Commercial Development Project originally approved on August 19, 2021.

Rezone Application No. 22-10. This project proposes a Zoning Ordinance Amendment (rezone) from the C-2 ( Community Commercial) zone district to the RM-2-A (Multi-Family Residential, 3,500 square feet minimum) zone district for the property located at 113 South 9th Ave (APN 343-162-12). The Planning Commission recommended approval of the application.
The City Council requests your participation and the public is welcome to speak at the hearing on either or both projects or the environmental document. If you challenge any City Council action in court, you may be limited to challenge only those issues raised at the Planning Commission or City Council public hearings.

The proposed ordinance would amend multiple provisions of the Fresno County Ordinance Code, Title 15, Building and Construction, particularly Chapters 15.04 (General Provisions), 15.08 (Building Code), 15.10 (Fire Code), 15.12 (Mechanical Code), 15.14 (Energy Code), 15.16 (Electrical Code), 15.18 (Residential Code), 15.20 (Plumbing Code), 15.22 (Green Building Standards Code), 15.28 (Grading and Excavation), 15.32 (Substandard Housing and Unsafe Structures-Nuisances), 15.48 (Flood Hazard Areas), 15.60 (State Responsibility Area Fire Safe Regulations of the County) and added chapters 15.70 (Emergency and Disaster Response) and 15.80 (Electric Vehicle Charging). This proposed ordinance would incorporate changes required by the 2022 California Building Codes, effective January 1, 2023. This proposed ordinance would add Chapter 15.70 to address housing lost to natural or human cause and Chapter 15.80 specifying procedures for permitting of electric vehicle charging systems as required by Assembly Bill 1236.

REQUEST FOR BIDS – CONSOLIDATED IRRIGATION DISTRICT
CENTRAL BASIN AND ACADEMY BASIN
In general, the Work consists of furnishing all labor, materials, equipment, and incidentals necessary to construct recharge basins at two different sites (Central Basin and Academy Basin) including basin levees, levee keyways, a settling channel, a 24-inch diameter distribution pipeline (approx. 1,400 ft long), cast-in-place and pre-cast concrete interbasin and turnout structures, furnishing and installing Rubicon gates, barbed wire fencing, well abandonment, and all other miscellaneous items to complete the work described in the Plans and Specifications to provide for two (2) fully functioning recharge basins. 1) Sealed bids will be received by the Consolidated Irrigation District prior to 10:00:00 a.m. (local time) on Thursday February 9th, 2023, at 2255 Chandler St., Selma, CA 93662, and following said deadline all bids will be publicly opened and read. Bids shall be submitted in a sealed envelope with the name of the bidder, the name of the project and the statement “Do Not Open Until the Time of Bid Opening.” Bids received after said deadline will be returned unopened to the bidder. 2) A mandatory pre-bid meeting and project site tour will be held on Tuesday January 31st, 2023, at 9:00 a.m. beginning at the southwest corner of the intersection of E.
