DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE:

The Department operates, manages, and oversees facilities that store, transport and deliver water to urban and agricultural water agencies throughout the State.  Since 1960, the Department has approved, planned and constructed an integrated system of water storage and transportation and power generation facilities called the State Water Resources Development System, more commonly known as the State Water Project. 

Pursuant to applicable statutes and other authorities, the Department is authorized to perform various duties and functions related to the State Water Project.  Among its powers, the Department is authorized to enter into contracts for the sale, delivery, or use of water, generated through the State Water Project, to water agencies in the State. Twenty-nine (29) public water agencies (“Contractors”) currently have contracts (“Water Supply Contracts”) with the Department for delivery of water from the State Water Project.  The Contractors receive water service in exchange for paying all costs that are associated with constructing, operating, and maintaining State Water Project facilities and that are attributable to water supply.  The Water Supply Contracts are required to be substantially uniform with respect to their basic terms and conditions for all 29 Contractors.

The Water Supply Contracts originally included 75-year terms with ending dates that ranged from November 4, 2035 to August 31, 2042, depending on when each specific Water Supply Contract was executed.  Article 4 of the Water Supply Contracts provides that the Contractors, by written notice to the Department at least six (6) months prior to the end of the term of the particular Water Supply Contract in question (as specified in Article 2), may elect to receive continued service under the Water Supply Contracts under certain conditions.  In accordance with Article 4, the Department initiated a process to amend the Water Supply Contracts in order to maintain the financial integrity of the State Water Project. 

On December 11, 2018, the Department’s Director approved the “Amendments for Continued Service and the Terms and Conditions Thereof,” referred to herein as the Contract Extension Amendments.  The Contract Extension Amendments extend the terms of the Water Supply Contracts to 2085, and amend other financial provisions in the Contracts to ensure that the State Water Project is properly managed and financed.  A model form of the Contract Extension Amendments is attached to the Department’s validation complaint as Exhibit A.

The Department brought this validation action to confirm the legality and validity of the Contract Extension Amendments and the proceedings related thereto.  The validation complaint, the accompanying exhibit, and a copy of this Summons are available on the Department’s internet website. The Ordinance to amend Chapter 13.28 to Title 13 of the County of Fresno Ordinance Code (the “Ordinance Amendment”) setting out alternative procedures to exempt certain leases, licenses or subleases of any real property belonging to, leased by, or licensed by the County (“County Real Property”) from formal and informal bidding; to add Section 13.28.030(C) to exclude from formal and informal bidding procedures a lease, sublease or license of County Real Property not exceeding 10 years and with a rental amount up to $35,000 per month, as long as the lessee or licensee provides a service to or for the benefit of the County, the state, or any local public agency; and to authorize the County Administrative Officer, or his/her designee, to approve and execute certain leases and licenses under Chapter 13.28 to Title 13 of the County of Fresno Ordinance Code, with such authorization expiring December 31, 2023; and waive the reading of the proposed Ordinance Amendment in its entirety and adopt the proposed Ordinance Amendment.

This Ordinance amends Chapter 17.92 of the Ordinance Code of Fresno County relating to the collection of Development Fees within the Sphere of Influence of the City of Clovis per the provisions of Sections 4.1.3 and 4.1.4 of Article IV of the City/County Memorandum of Understanding (MOU).  On July 2, 2018, the Clovis City Council adopted Resolution No. 2018-91, which adopted the City of Clovis proposed master development fee schedule for 2018-19.  The City transmitted the signed resolution (City of Clovis, City Council Resolution No. 2018-91) and fee schedule to the County for the County’s adoption on October 2, 2018.  The current request is the eighth adjustment to the City’s fees since implementation of this process in 2005.

NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION FOR THE SHEPHERD / MINNEWAWA SIGNAL INSTALLATION PROJECT

NOTICE OF PUBLIC HEARING

NOTICE OF PUBLIC REVIEW OF A PROPOSED MITIGATED NEGATIVE DECLARATION

Notice is Hereby Given: The City of Clovis (City) is the lead agency on the below-described project and has prepared a Mitigated Negative Declaration (MND) for the proposed Shepherd / Minnewawa Signal Installation Project (Project) pursuant to the California Environmental Quality Act (CEQA). The City has determined that the Project will have a less than significant effect on the environment, with mitigation, and therefore the MND was prepared. The complete Project description, location and the potential environmental effects are contained in the MND, which is available to the public for review.

Project Title: Mitigated Negative Declaration for the City of Clovis Shepherd / Minnewawa Signal Installation Project.

Project Location and Description: The Project is located along the northern border of the City of Clovis, at the intersection of Shepherd Avenue and Minnewawa Avenue. The Project includes the following components:

· Installation of signal lights

· Acquisition of 0.34 acres of additional right-of-way (ROW) to accommodate new right turn lane transitions, curb returns, and four ADA compliant pedestrian ramps

· Installation of a new right turn lane westbound on Shepherd Avenue

· Installation of a new right turn lane southbound on Minnewawa Avenue

· Utility adjustments will include relocating a utility pole outside of the proposed pavement on the northwest corner of Shepherd and Minnewawa avenues.

· Utility adjustments will also include relocating communication pedestals outside of the proposed pavement on the northeast corner of Shepherd and Minnewawa Avenues.

The City will need to acquire a small amount of additional right-of-way (ROW) along the north side of Shepherd Avenue. Construction is expected to begin in Summer 2019 and last up to four months.

Mitigation Measures: The City has incorporated into the project mitigation measures for potentially significant project impacts related to biological and cultural resources. The mitigation measures are included in the Initial Study.

Document Availability and Public Review Timeline: The review period for the MND will be from January 11, 2019 to February 11, 2019. Copies of the MND and construction drawings can be reviewed at the City of Clovis, 1033 Fifth Street, Clovis, CA 93612. INITIAL STUDY APPLICATION NO. 7555 and CLASSIFIED CONDITIONAL USE PERMIT APPLICATION NO. 3625 filed by ROGER HURTADO on behalf of NEW HOPE COMMUNITY CHURCH OF CLOVIS, INC., proposing to allow the expansion of an existing church to include a 9,000 square-foot community hall with parking and related facilities on a 3.97-acre parcel in the RR (Rural Residential, two-acre minimum parcel size) Zone District.  The project site is located on the northeast corner of N. Preuss Drive and E. Nees Avenue, approximately 60 feet north of the nearest city limits of the City of Clovis (4620 E. Nees Avenue, Clovis) (SUP.
