The Planning Commission considered Project items No. 1 and 2 at its July 28, 2022 meeting at which time it adopted a resolution recommending approval of the projects.
Project Item No. 1 is exempt from CEQA pursuant to a Class 32 categorical exemption. Class 32 exemptions consist of in-fill development less than 5 acres in size meeting the conditions described in California Government Code Section 15332(a), (b), (c), (d) and (e). A Notice of Exemption has been completed during the preliminary review and is kept for public review with the project file during the processing of the project application. Staff will file the notice with the County Clerk if the project is approved.
Project Items No. 2 and 3 have been determined to be consistent with the 2003 Loma Vista Specific Plan and the 2014 Clovis General Plan, both of which were adopted in conjunction with the certification of environmental impact reports (EIRs). No new impacts or changes to the significance of previously identified impacts have been identified and no conditions requiring subsequent review are met. The various elements of the project are therefore exempt from CEQA pursuant to Sections 15182 and 15183 of the CEQA Guidelines and no further environmental review is required for this project.

This contract is funded in part by grants from the Federal Transit Administration (FTA) of the United States Department of Transportation. The award of any contract is subject to the requirements of financial assistance contracts between the City of Fresno and the U.S. Department of Transportation.
Although there is no specific goal or requirement to use participation by Disadvantaged Business Enterprises (DBE) for this project, The City of Fresno highly encourages the participation of Disadvantaged Business Enterprises (DBE). The
encourages all prime Contractors to utilize qualified SBE (Small Business Enterprise) sub-Contractors on the City of Fresno projects and promotes the direct purchase of goods from qualified SBEs by utilizing SBE/DBE vendors when such vendors are available and the price of the goods or services sought is reasonable.
The Contractor is required to comply with all terms and conditions prescribed for third- party contracts by the U.S. Department of Transportation, Federal Transit Administration (FTA). If FTA requires any change to this Contract to comply with its requirements, both parties agree to amend the Contract as required by FTA. If such changes cause an increase or decrease in the work to be performed by the Contractor or the time for such performance, then the compensation to be paid the Contractor and time of performance shall be equitably adjusted.
The City of Fresno reserves the right to reject any and all proposals.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager. A Bid Deposit, which can be provided separately, in the amount of FIFTEEN THOUSAND DOLLARS ($15,000) (or, in bids with Add Alternates, the highest possible combination of the Base Bid Plus Add Alternates) in the form of a certified cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount. Bid Deposits will be refunded after a Contract has been executed with the successful Bidder or all bids have been rejected. Copies of Bid Deposits may be submitted electronically, with the exception of a cashier’s check, which must be brought to the Purchasing Manager’s office and labeled accordingly with bid number prior to the bid opening.
