DETAILED SUMMARY OF THE MATTER:

The United States has constructed and is operating the California Central Valley Project (“Project”) for diversion, storage, carriage, distribution, and beneficial use, for flood control, irrigation, municipal, domestic, industrial, fish and wildlife mitigation, protection and restoration, generation and distribution of electric energy, salinity control, navigation, and other beneficial uses, of waters of the Sacramento River, the American River, the Trinity River, and the San Joaquin River and their tributaries.

On August 20, 1975, County entered into a contract for water service with the United States, Contract No. 14-06-200-8292, as amended, which provided for the delivery of water to County through Project facilities. County subsequently entered into interim renewal contracts identified as Contract No. 14-06-200-8202A-OR1 through IR18, which provided for and provide for the continued water service to County from March 1, 2020 through February 28, 2022.

On or about December 16, 2016, the 114th Congress of the United States of America enacted the Water Infrastructure Improvements for the Nation Act (Pub. L. 114-322, 130 Stat. 1628) (“WIIN Act”). Section 4011(a)(1) of the WIIN Act provides that: “upon request of the contractor, the Secretary of the Interior shall convert any water service contract in effect on the date of enactment of this subtitle and between the United States and a water users’ association [Contractor] to allow for prepayment of the repayment contract pursuant to paragraph (2) under mutually agreeable terms and conditions.”

Pursuant to, and consistent with, the WIIN Act, County requested that the United States convert the County’s existing interim renewal contract to a repayment contract. The United States and County subsequently negotiated terms and conditions to convert County’s existing interim renewal contract to a repayment contract, and those terms and conditions are set forth in the “Contract Between the United States and the County of Fresno Providing for Project Water Service and Facilities Repayment” (hereinafter “Contract.”) The Contract also reflects the current standard terms and conditions required by the Reclamation Manual, and continues water service to the County in the same scope and nature of the ongoing Project and its existing facilities.

Under the Contract, ongoing receipt and delivery of water to the County will continue with no expansion of service and no new facilities constructed because the County will deliver the water received under the Contract: (a) to lands within the County’s boundaries for beneficial use and that have been in production in CSA No. 34, and (b) through existing facilities.

County has reviewed the terms and conditions of the Contract and finds the form and content thereof to be acceptable to the County and appropriate for execution. The terms and conditions of the Contract are within the scope of, and consistent with, the County’s powers and authorities under the Constitution of California and other applicable California law.  On November 16, 2021, at a duly-noticed and regular meeting of the County’s Board of Supervisors, the Board of Directors approved the execution of the Contract

This action is brought in this court as a special in rem validation proceeding for the judicial examination and validation of the Contract.  County seeks a validation judgment under Code of Civil Procedure sections 860 through 870.5, and other applicable law. County further seeks judicial examination, approval, and confirmation of the proceedings leading up to and including the approval of the Contract. All such proceedings by and for the County, as set forth herein, were, and are, in the best interests of the County and all interested parties, and were, and are, in conformity with the provisions of all laws and enactments at any time in force or controlling upon such proceedings, whether of law, statute or ordinance, and whether federal, state or municipal and were, and are, in conformity with all requirements of all regulatory bodies, agencies or officials having authority over or asserting over the proceedings or any part thereof

COMMUNITY FACILITIES DISTRICT NO. 11

ANNEXATION NO. 131

Notice is hereby given that on February 17, 2022, the City Council of the City of Fresno (City) adopted Council Resolution No. 2022-051 to annex Final Tract Map No. 6187 to the City of Fresno Community Facilities District No. 11 (CFD No. 11) and to authorize the levy of Special Taxes under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (City Law).  Under this City Law and Council Resolution No. 2022-051, the City gives notice as follows:

a.            The text of Council Resolution No. 2022-051, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Council Resolution No. 2022-051 is summarized as follows:

b.            As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 11, the boundaries of which are shown on the maps on file with the City Clerk.

c.            The purpose of CFD No. 11 is to provide financing for the maintenance of the landscaping and irrigation systems, open spaces, trails, concrete curbs, gutters, medians, hardscaping and sidewalks, street lights, local street paving and street name signage plus any added developer requested features (Services) located in street, landscaping and open space easements and public properties associated with the subdivision as more fully described in Council Resolution No. 2022-051 and Exhibit C thereto.

d.            The method of financing the Services is through the imposition and levy of a special tax (Special Tax) to be apportioned on the properties in CFD No. 11 under the rate and method of apportionment described in Council Resolution No. 2022-051 and Exhibit D thereto.  The Special Tax requires the approval of two-thirds of the qualified electors of CFD No. 11 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.

e.            The Special Tax, if approved, will be used to finance all or a portion of the Services.

f.             The Director of Public Works of the City or his designee is directed to cause to be prepared a written report for CFD No. 11, Annexation No. 131 (District Report) that shows the Services by type and required to adequately meet the needs of CFD No. 11 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

g.            As set forth below, the City will hold a public hearing on the annexation of Final Tract Map No. 6187 to CFD No. 11 with its Services and Special Tax.

h.            The time and place established under Council Resolution No. 2022-051 for the public hearing required under City Law are THURSDAY, March 24, 2022, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.

            At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 11, the extent of CFD No. 11 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 11, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 11 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 11 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 11, or against levying a specified Special Tax, those types of facilities or the specified Special Tax will be eliminated from the proceedings to annex to CFD No. 11.

            The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 11.

The scope of work includes: Reconstruct portions of the existing East Apron and expand it to the east with demolition of paved surfaces and reconstruction with concrete and asphalt. The Project also includes relocation of utilities, lighting, fencing, pavement markings, reconfigured service roads and two new passenger boarding bridges.

The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code.  The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City.  A copy of the resolution is on file at the Office of the City Clerk.  Actual wage schedules are available at Construction Management Office, 1721 Van Ness Avenue, Fresno, California 93721, (559) 621-5600.

Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and

1771.5 prior to submitting bids.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager and must be accompanied by a Bid Deposit in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount.  All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected.  Copies of Bid Deposits may be submitted electronically, with the exception of a certified or cashier’s check, which must be brought to the Purchasing Manager’s office and labeled accordingly with the bid number prior to the bid opening.

An expanded Security Screening Checkpoint.  A new two gate/holdroom concourse served by passenger boarding bridges, additional concessions and support spaces. A new FIS international arrivals facility.  Landside modifications.  Project location: 5175 East Clinton Way   Fresno, CA  Building area for entire project: 130,000 sf  Estimated value of construction for entire project: $90,000,000  Trades include: building and site concrete, reinforcing steel, structural steel, casework, millwork, insulation, roof and wall panels, TPO roofing, hollow metal doors, overhead doors, metal stud framing, drywall, specialty ceilings, flooring, paint, specialties, plumbing, HVAC, fire      sprinklers, electrical, site work, and baggage handling system.  Construction schedule: Project start August 2022 and completion December      2024  This project is subject to the payment of State or Federal prevailing wage rates, whichever rate is higher  Subcontractors and lower tier subcontractors must have valid DIR #  There is a PLA on this project which will be in the bid documents
