ARTICLE 4 – APPOINTMENT OF COUNSEL
Family Code §7860 Procedure for Appointment of Counsel
At the beginning of the proceeding on a petition filed pursuant to this part, counsel shall be appointed as provided in this article. The public defender or private counsel may be appointed as counsel pursuant to this article. The same counsel shall not be appointed to represent both the child and the child’s parent.
Family Code § 7861 Appointment to Protect Interests of Child
The court shall consider whether the interests of the child require the appointment of counsel. If the court finds that the interests of the child require representation by counsel, the court shall appoint counsel to represent the child, whether or not the child is able to afford counsel. The child shall not be present in court unless the child so requests or the court so orders.
Family Code § 7862 Appointment of Counsel for Parent
If a parent appears without counsel and is unable to afford counsel, the court shall appoint counsel for the parent, unless that representation is knowingly and intelligently waived.
Family Code § 7863 Compensation and Expenses of Private Appointed Counsel
Private counsel appointed under this article shall receive a reasonable sum for compensation and expenses, the amount of which shall be determined by the court. The amount so to be determined shall be paid by the real parties of interest, other than the child, in proportions the court deems just. However, if the court finds that any of the real parties in interest are unable to afford counsel, the amount shall be paid out of the general fund of the county.

The City of Fresno Department of Transportation/FAX (hereinafter (“FAX”) is soliciting proposals from qualified contractors for Planning Services.
The RFQ forms and specifications may be obtained from the Office of the Project Manager (phone 559-621-1537) via the City’s website: www.fresno.gov, click on “Business” (at the top of the screen), then “Bid Opportunities” under the “Doing Business” section.
Proposals may be submitted electronically via Planet Bids only.
Proposals are to be submitted to the Projects Manager using Planet Bids prior to the deadline at 3 p.m. on Monday, May 18, 2026.
Pre-Proposal Conference
A pre-proposal conference will be held at 2223 G Street, Fresno, CA 93706 and virtually on April 30, 2026 at 9:00 am. Prospective Proposers are encouraged to attend. City Staff will be present to answer any questions regarding the Specifications and provide a tour of the job site.
All proposals must be made on the proposal forms provided by FAX.
The City of Fresno hereby notifies all Proposers that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation or on any other basis prohibited by law.
This contract is funded in part by grants from the Federal Transit Administration (FTA) of the United States Department of Transportation. The award of any contract is subject to the requirements of financial assistance contracts between the City of Fresno and the
U.S. Department of Transportation.
The City of Fresno encourages all prime Contractors to utilize qualified SBE (Small Business Enterprise) sub-Contractors on the City of Fresno projects and promotes the direct purchase of goods from qualified SBEs by utilizing SBE vendors when such vendors are available and the price of the goods or services sought is reasonable.
An Interim Final Rule (IFR) published by the U.S. Department of Transportation (DOT) on October 3, 2025, eliminates the presumption that a business is disadvantaged based solely on the owner’s race, ethnicity, or sex. As a result, the DBE program still exists, but there is a temporary suspension while firms are being recertified. No DBE goal will be placed on this project, and proposals will not be evaluated based on proposed DBE participation.
The Contractor is required to comply with all terms and conditions prescribed for third-party contracts by the U.S. Department of Transportation, Federal Transit Administration (FTA). If FTA requires any change to this Contract to comply with its requirements, both parties agree to amend the Contract as required by FTA. If such changes cause an increase or decrease in the work to be performed by the Contractor or the time for such performance, then the compensation to be paid the Contractor and time of performance shall be equitably adjusted.
The City of Fresno reserves the right to reject any and all proposals.

The Request for Qualifications (RFQ) is to prequalify a pool of vendors to provide leadership development and coaching services for classified, certificated, and executive leaders.
