CITY OF CLOVIS SUMMARY OF ORDINANCE 23-12 OF THE CITY COUNCIL OF THE CITY OF CLOVIS AMENDING SECTIONS 5.22.02 AND 5.22.05 OF CHAPTER 5.22, OF TITLE 5 OF THE CLOVIS MUNICIPAL CODE PERTAINING TO DEFINITIONS AND REGULATIONS FOR THE DELIVERY OF MEDICINAL MARIJUANA.
On January 8, 2024, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance to amend sections 5.22.02 and 5.22.05 of the Clovis Municipal Code (CMC) pertaining to definitions and regulations for the delivery of medical marijuana. With the enactment of Senate Bill (SB) 1186, which adds Section 26322 to the Business and Professions Code beginning January 1, 2024, a local jurisdiction is prohibited from limiting the delivery of medical marijuana to patients or their primary caregivers by licensed medical marijuana businesses. The Clovis Municipal Code currently prohibits the delivery of all marijuana including medical marijuana, except to and from cannabis testing facilities as permitted in CMC section 5.22.09. This ordinance amendment will allow delivery of medical marijuana in compliance with state law, while prohibiting delivery in all other instances, except to and from cannabis testing facilities as currently authorized in CMC section 5.22.05, subdivision (c).  The amendment will also require that prior to any person engaging any medicinal marijuana deliveries, such persons must first receive a business tax certificate from the City, consistent with Business and Professions Code section 26322, subdivision (b)(3).

PROJECT DESCRIPTION: The S. STAMOULES, INC. PISTACHIO PROCESSING FACILITY PROJECT (Project) is proposed by OPA Pistachio on behalf of Stamoules Produce Company. The Applicant has applied to the Fresno County Department of Public Works and Planning (the County) for an Unclassified Conditional Use Permit (CUP) to construct, operate, and maintain a pistachio hulling, processing, and packing facility and Variance to allow 50-foot-high storage silos. The proposed facility will process pistachio crops from the property owner’s surrounding area orchards and include huller buildings, a processing building containing pistachio processing equipment, propane-powered dryer areas, drive-over dump pit areas, storage silos, among other structures and work areas. Processed water from the facility will be conveyed via existing subsurface piping to irrigate approximately 3,740 acres of agricultural land owned by the owner of the project site.
IDENTIFIED POTENTIAL ENVIRONMENTAL EFFECTS: The County of Fresno has prepared a Draft EIR analyzing the Project’s potential environmental effects.  Significant and unavoidable impacts with no feasible mitigation measure would result regarding Greenhouse Gas Emissions.  The Project will have a less than significant impact (with or without mitigation measures) regarding Aesthetics, Energy, Land Use and Planning, Noise, Transportation, Utilities and Service Systems, Air Quality, Agriculture and Forestry Resources, Biological Resources, Geology and Soils, Cultural and Tribal Cultural Resources, Hydrology and Water Quality.  No impact would result to Mineral Resource, Population and Housing, Public Services, Recreation, or Tribal Cultural Resources.

Proposed Flood Hazard Determinations for the City of Clovis, Fresno County, California, and Case No. 22-09-1501P. Regular Meeting, January 16, 2024
NOTICE IS HEREBY GIVEN that at a regular meeting on Tuesday, January 16, 2024, at 6:00 p.m. or as soon thereafter as the matter can be heard, the Fowler City Council will hold a hearing at the City Hall Council Chamber at 128 S. 5th Street, Fowler, California to consider the following:
City of Fowler Planning Fee and Development Impact Fee Schedule for 2024. The City Council will consider an update to the City of Fowler’s Planning Fee and Development Impact Fee Schedule for calendar year 2024. Such updates would result in an inflationary increase in fees collected to process development projects. This increased cost will cover the current estimated reasonable cost of providing such services. Pursuant to Government Code Section 66016(a), the data and information from which the proposed fees are derived shall be made available for public review at Fowler City Hall during normal business hours beginning not less than ten (10) days prior to the hearing.
The City Council invites your participation and the public is welcome to speak at the hearing on the proposed updates. If you challenge any City Council action in court, you may be limited to challenge only those issues raised at the Planning Commission or City Council public hearings.
Meeting material(s), staff report(s), and a telephone number to provide access to the City Council meeting via teleconference will be available to the public at least three days prior to the hearing and may be reviewed at www.fowlercity.org.
