A bill that would expand the authority of the Division of Labor Standards Enforcement to investigate and cite an employer for alleged retaliation is lurking in Sacramento.


AB 2261 was recently ordered to the Senate’s “inactive” file, which means one day’s public notice is all that is needed to put it back on the agenda.

The California Chamber of Commerce opposed the bill, which would allow the state to subject employers to random investigations for alleged employee retaliation even when there are no employee complaints of retaliation.

The bill has the potential to disrupt the workplace and submit employers to harassment and abuse by subjecting them to random investigations.

Let’s hope this bill gets stuck in the inactive file.
