Sealed proposals will be received at the office of the City Clerk of the City of Fowler, 128 South 5th Street, Fowler, CA 93625 until 2:00 p.m. Tuesday, September 17, 2024, at which time they will be publicly opened and read at said office, for construction in accordance with the specifications therefor, to which special reference is made as follows:
SUMNER AVENUE BICYCLE/PEDESTRIAN IMPROVEMENTS

The work to be done, in general, consists of hot mix asphalt, pavement striping, markers and markings, construction of concrete curb and gutter and sidewalk, earthwork, and preparation of subgrade, as specified in the Special Provisions and as directed by the City Engineer.
Plans and specifications applying to this project may be reviewed and purchased at: Peters Engineering Group, 862 Pollasky Avenue, Clovis, California 93612 at the non-refundable price of $40.00 per set. Checks shall be made payable to the City of Fowler. Plans and specifications may also be viewed on the website of the Central California Builders Exchange and the Tulare / Kings County Builders Exchange or downloaded from the City’s website. Bidders are responsible for monitoring the City’s website for any project addendums and submitting the acknowledged addendums with the bid documents. Any bid proposal submitted without all addendums acknowledged will be deemed non-responsive.

Bid security in the amount of then (10) percent of the amount of the bid, and in the form of a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance, cash, cashier’s check or certified check shall accompany the bid. No contract will be awarded to a contractor who has not been licensed in accordance with the provisions of the Contractors State License Law, California Business and Professions Code, Division 5, Chapter 9, as amended, or whose bid is not on the proposal form included in the contract document. A valid California Contractor’s License, Class A, General Engineering is required for this project.
A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded.
The City of Fowler has established a participation goal for Disadvantaged Business Enterprises (DBEs) of 17% for the Sumner Avenue Bicycle/Pedestrian Improvements project.
The City of Fowler hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprise, Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.
Minimum wage rates for this project, as predetermined by the Secretary of Labor, are set forth in the special provisions. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates determined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate.
In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done. Said wage determinations are on file with the City Clerk and are incorporated herein by reference.
The work to be performed under this contract is on a project assisted under a program providing direct Federal financial assistance from the Department of Housing and Urban Development, Community Development Block Grant Program, and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 USC 17O1u. Section 3 requires that to the greatest extent feasible opportunities for training and employment be given to low and moderate income persons residing within the project area and that the contracts for work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project. Regulations for implementing the Section 3 clause are contained in 24 CFR 135, as amended, and as specified in the project specifications.
All pages of the preliminary (Anticipated) Statement of Work Force Needs form, also contained in the project specifications, will be required to be completed and submitted prior to award. All pages of the Final (Completion) Statement of Work Force Needs form shall also be required to be completed and submitted upon completion of construction.
Bids are required for the entire work described herein. Bids will be compared on the basis described in the Bid Proposal.
Bid security in the amount of then (10) percent of the amount of the bid, and in the form of a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance, cash, cashier’s check or certified check shall accompany the bid. Bid security shall be made in favor of the City of Fowler.
The successful bidder shall furnish a faithful performance and labor and materials bonds each in the amount of 100 percent of the contract amount. Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Fowler. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance and that the City of Fowler will not accept a surety company with a Best’s rating of less than B.
Pursuant to Public Contract Code Section 22300, substitution of securities for any moneys withheld by the City of Fowler to ensure performance under the contract shall be permitted.

NOTICE OF PUBLIC SALE: NOTICE IS HEREBY GIVEN that pursuant to California Civil Code Section 798.56a and California Commercial Code Sections 7209 and 7210, noticing having been given to all parties believed to claim an interest and the time specified for payment in the notice having expired, Arabian Villa & Campus Corral (Park) is entitled to a warehouse lien against that certain mobilehome described as 1974 Lakewood mobile home with a Decal Number of ABF9487, Serial Number(s) of 6129U/6129X (HUD Label/Insignia(s) of 132053/132054) consisting of 60’11” in length and 24′ (total) in width, and now stored at 1500 Villa Avenue, Space 27, Clovis, CA 93612. The parties believed to claim an interest in the mobilehome and personal property are Patricia Louise Work and Robert lee Fain Jr (or the estates thereof). The mobilehome and personal property will be sold by the Park (Warehouseman) at public auction to the highest bidder with a minimum bid of $8,563.34 subject to further adjustments. In order to prevent the mobilehome from being sold at the noticed sale the minimum bid amount must be paid by a person claiming a right in the mobilehome, prior to the sale date, AND the mobilehome must then be promptly removed from the park. This amount incl. estimated storage charges, publication charges, attorneys fees, incidental and/or transportation charges, charges incurred by the park in connection with the unit remaining on site, as provided in the Commercial Code, and is subject to further adjustment. The sale is conducted on a cash or certified fund basis only (Cash, cashier’s check, or travelers checks only). Payment is due and payable immediately following the sale. No exceptions. The mobilehome and its contents are sold as is, where is and with no guarantees and without covenant or warranty as to possession, financing, title, or encumbrances. The purchaser of the mobilehome will take it subject to any current or past due real or personal property taxes, registration fees and/or liens incl. H&S § 18116.1. The sale will be held as follows: Date: September 23, 2024 Time: 10:00 a.m. at 1500 Villa Avenue, Space 27, Clovis, CA 93612. PLEASE TAKE FURTHER NOTICE that the mobilehome and contents must be removed from the premises within five (5) days of the date of sale (or be subject to storage fees of $150/day); no occupancy within the home will be allowed. The purchaser shall be responsible for cleanup of the space of all trash, personal property or other belongings on the space or utilized in the removal of the Property. The purchaser shall also be liable for any damages caused during the removal of the Property. The auction will be made for the purpose of satisfying the lien on the Property, together with the cost of the sale. Proper Notice has been sent to the others who have an interest in the Property or who owe money. This notice is published by an attorney to collect debts owed to the warehouse and any information obtained from the debtors will be used for that purpose. The debtor has 30 days after receipt of the debt collection notice to dispute the amount due, or the amount will be presumed to be valid. If the debtors dispute the amount, they may do so in writing. The law does not require waiting the 30 day period to proceed to collect on the debt, but if the debtors despite the amount in writing, all collection activities will be suspended until the debtors are mailed verification of the debt.
