The work to be done for the base bid, in general, consists of installing new hardwood laminate flooring and a photovoltaic and battery backup system.

Bids shall be submitted in a sealed envelope addressed to the City of Kingsburg and labeled with the name of the bidder, the name of the project and the statement “Do Not Open Until the Time of Bid Opening.”

Bid security in the amount of then (10) percent of the amount of the bid, and in the form of a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance, cash, cashier’s check or certified check shall accompany the bid. Bid security shall be made in favor of the City of Kingsburg.

No contract will be awarded to a contractor who has not been licensed in accordance with the provisions of the Contractors State License Law, California Business and Professions Code, Division 5, Chapter 9, as amended, or whose bid is not on the proposal form included in the contract document. A valid California Contractor’s License, Class B, General Building, or a combination of license classifications to cover all work involved are required for this project.

The City of Kingsburg hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprise, Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

Minimum wage rates for this project, as predetermined by the Secretary of Labor, are set forth in the special provisions. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates determined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done. Said wage determinations are on file with the City Clerk and are incorporated herein by reference.

The work to be performed under this contract is on a project assisted under a program providing direct Federal financial assistance from the Department of Housing and Urban Development, Community Development Block Grant Program, and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 USC 17O1u. Section 3 requires that to the greatest extent feasible opportunities for training and employment be given to low and moderate income persons residing within the project area and that the contracts for work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project. Regulations for implementing the Section 3 clause are contained in 24 CFR 135, as amended, and as specified in the project specifications.

All pages of the preliminary (Anticipated) Statement of Work Force Needs form, also contained in the project specifications, will be required to be completed and submitted prior to award. All pages of the Final (Completion) Statement of Work Force Needs form shall also be required to be completed and submitted upon completion of construction.

Bids are required for the entire work described herein. Bids will be compared on the basis described in the Bid Proposal.

The successful bidder shall furnish a faithful performance and labor and materials bonds each in the amount of 100 percent of the contract amount. Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Kingsburg. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance and that the City of Kingsburg will not accept a surety company with a Best’s rating of less than B.

Pursuant to Public Contract Code Section 22300, substitution of securities for any moneys withheld by the City of Kingsburg to ensure performance under the contract shall be permitted.

Bids shall be submitted in a sealed envelope addressed to the City of Fowler and labeled with the name of the bidder, the name of the project and the statement “Do Not Open Until the Time of Bid Opening.”

No contract will be awarded to a contractor who has not been licensed in accordance with the provisions of the Contractors State License Law, California Business and Professions Code, Division 5, Chapter 9, as amended, or whose bid is not on the proposal form included in the contract document. A valid California Contractor’s License, Class A, General Engineering, or C-12 Grading and Paving are required for this project.

The City of Fowler hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprise, Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

Bids are required for the entire work described herein. Bids will be compared on the basis described in the Bid Proposal.

The successful bidder shall furnish a faithful performance and labor and materials bonds each in the amount of 100 percent of the contract amount. Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Fowler. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance and that the City of Fowler will not accept a surety company with a Best’s rating of less than B.

Pursuant to Public Contract Code Section 22300, substitution of securities for any moneys withheld by the City of Fowler to ensure performance under the contract shall be permitted.

The City Council reserves the right to reject any or all bids.

CITY OF FOWLER CITY COUNCIL MEETING

Regular Meeting, October 6, 2020

NOTICE IS HEREBY GIVEN that at a regular meeting on Tuesday, October 6, 2020 at 7:00 p.m. or as soon thereafter as the matter can be heard, the Fowler City Council will hold a hearing at the City Hall Council Chamber at 128 S. 5th Street, Fowler, California to consider the following:

1. Zoning Text Amendment No. 20-01 (Various Text Updates) proposing to amend Title 9, Chapter 5, Article 21, Section 5 and Title 9, Chapter 5, Article 7, Section 715 of the Fowler Municipal Code to clarify the height and setback standards relating to accessory structures such as playgrounds and fireplaces in the R-1 zone. The text amendment also proposes to amend Sections 9-5.1003, 9.5.1005, 9-5.1203, 9-5.1705 to permit grocery stores by-right in commercial and form-based zones and to restrict the size of variety stores. The amendment proposes to alter Section 9-5.1402 to permit automobile repair by right in the M-1 zone, and Section 9-5.1503 to clarify that agricultural uses are not permitted in the M-2 zone. The application includes a proposed finding of exemption from the California Environmental Quality Act (CEQA Guidelines Section 15061(b)(3)). These amendments were presented to the Planning Commission at their regular meeting on September 3, 2020 and are recommended by the Commission.

The Council requests your participation and the public is welcome to speak at the hearing on the project or the environmental document. If you challenge any City Council action in court, you may be limited to challenge only those issues raised at the City Council hearing.

This meeting will be conducted pursuant to the provision of Paragraph 11 of the Governor’s Executive Order N-25-20 which suspends certain requirements of the Ralph M. Brown Act, and as a response to mitigating the spread of COVID-19, the meeting will not be open to the public.

FRESNO COUNTY AGRICULTURAL LAND CONSERVATION COMMITTEE

A public meeting will be held by the Agricultural Land Conservation Committee to consider the following:

Review and make recommendation to the Board of Supervisors regarding petition for PARTIAL CANCELLATION OF AGRICULTURAL LAND CONSERVATION CONTRACT NO. 5834 (RLCC NO. 1007) to remove a 3.55-acre portion of a 27.51-acre parcel from the Williamson Act program to allow the 3.55 acres to be created as a separate parcel through a zone variance and a mapping application for future residential use as an alternative use of the 3.55-acre parcel.

The subject parcel is located on the south side of Rainbow Route, between Turney Avenue and Riverbend Avenue, approximately one and a half miles northeast of the nearest city limits of the City of Sanger (Sup. Dist. 5) (APN 333-021-66).

The Agricultural Land Conservation Committee meeting will be held at 1:00 p.m. on Wednesday, October 7, 2020 (or as soon thereafter as possible) in the Fresno County Farm Bureau office located at 1274 West Hedges Avenue, Fresno, California 93728.
