CITY OF CLOVIS SUMMARY OF ORDINANCE 23-05 OF THE CITY COUNCIL OF THE CITY OF CLOVIS AMENDING THE CLOVIS DEVELOPMENT CODE, TITLE 9 OF THE CLOVIS MUNICIPAL CODE AND FINDING THAT THE PROJECT IS NOT SUBJECT TO FURTHER ENVIRONMENTAL REVIEW PURSUANT TO CEQA GUIDELINES SECTION 15162
On July 10, 2023, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance amending sections of Title 9 of the Clovis Municipal Code (“Development Code”) as a semi-annual cleanup to address changes, deletions and content errors as a result of the 2014 Development Code update. Additionally, the semi-annual cleanup will bring the Development Code into compliance with State law related to large child and/or adult day care homes, allowance procedures for vehicle charging stations and development standards for accessory dwelling units (“ADUs”).

NOTICE INVITING SEALED BIDS
NORTH BURNETT ROAD WATER MAIN PROJECT
TIPTON COMMUNITY SERVICES DISTRICT
NOTICE IS HEREBY GIVEN that the Board of Directors of the Tipton Community Services District (District) invites all and will receive sealed Bids at the office of the Engineer, 209 South Locust Street, Visalia, California, up to the hour of 2:00 p.m. on the 27th day of July, 2023, for the construction of domestic water distribution pipelines, valves, service connections and appurtenances (Work).
The award will be made to the lowest responsive, responsible Bidder in accordance with these Contract Documents, but the District reserves the right to reject any and all Bids and waive minor discrepancies in the Bid.
Copies of the Contract Documents are on file and may be examined at the office of the Engineers. Specifications may be obtained from the office of the Engineer, Dennis R. Keller Consulting Civil Engineer, Inc., 209 South Locust Street, Visalia, California, 93291. No charge is required for each set of Plans and Specifications, including shipping. Only contractors obtaining Specifications from the office of the Engineer will be allowed to submit a sealed Bid.
Work to be performed for the North Burnett Road Water Main Project is funded by the County of Tulare utilizing funds made available by the American Rescue Plan Act, identified as Project I.D. #5004.
The successful Bidder shall produce the required Performance and Payment Bonds within fifteen (15) calendar days from the award of the Contract. The successful Bidder will be required to furnish a faithful Performance Bond in an amount equal to one hundred (100) percent of the contract price and a Payment Bond in an amount equal to one hundred (100) percent of the Contract price, said bonds to be obtained from a surety company satisfactory to the District and insurance coverage in defined coverages and amounts.
Attention of Bidders is particularly called to the requirements as to conditions of employment to be observed and minimum prevailing wage rates to be paid under the Contract, said items being contained in the Specifications. In accordance with the provisions of California Labor Code §§ 1770, 1773, 1773.1, 1773.2, 1773.6 and 1773.7, the general prevailing rate of wages and employer payments for health and welfare, pension, vacation, travel time and subsistence pay as provided for in § 1773.8, apprenticeship or other training programs authorized by §3093, and similar purposes applicable to the work to be done in the County of Tulare has been determined by the DIR Director. These wage rates appear in the DIR publication entitled General Prevailing Wage Rates and said wages are on file with the District and Engineer and are incorporated herein by reference. In accordance with California Labor Code §§1771.1 & 1771.4(a)(1), a Contractor or Subcontractor shall not be qualified to bid on, be listed in the Bid proposal (subject to the requirements of §4104 of the Public Contract Code), or engage in the performance of any work under this Contract, unless currently registered and qualified to perform public work pursuant to §1725.5 of the Labor Code. An unregistered Contractor may submit a Bid (as long as the Bid is authorized by §7029.1 of the Business and Professions Code or by §§10164 or 210103.5 of the Public Contract Code), provided the Contractor is registered to perform public work pursuant to §1725.5 of the Labor Code at the time the Contract is awarded. Prior to award of the Bid, the Contractor or Subcontractor shall provide proof of said current registration with the DIR to perform public work to the Tipton Community Services District. This Work is subject to compliance monitoring and enforcement by the DIR.
Contractors and Subcontractors must submit electronic certified payroll records, as provided under Labor Code §1776, to the Labor Commissioner. These records must be submitted on a weekly basis or as required by statute or by the DIR.
A time limit for the final completion of the Work of Sixty (60) calendar days, from confirmation of meter yoke shipment, has been set and liquidated damages shall be assessed according to the Contract Documents for each calendar day thereafter that the Work is not completed.
No pre-Bid conference will be held.
Prospective Bidders shall be licensed Contractors in the State of California and shall be skilled and regularly engaged in the general class or type of work called for under the Contract. In accordance with the provisions of California Public Contract Code §3300, the District has determined that the Contractor shall possess a valid Class A (General Engineering) or a Class C-34 (Pipeline) Contractor’s license. Initial Study No. 7504, General Plan Amendment Application No. 555 and Amendment Application No. 3832 filed by Roger Van Groningen proposing to amend the Land Use Element of the County-adopted Selma Community Plan to redesignate a 18.56-acre parcel and a 9.29-acre parcel from Agriculture to General Industrial; and Change the zoning of the said parcels from the AE-20 (Exclusive Agricultural, 20-acre minimum parcel size) Zone District to the M-3 (c) (Heavy Industrial, Conditional) Zone District to allow limited by-right industrial uses and expansion of an existing rail spur and related freight terminal operations located on an adjacent westerly property. The subject parcels are located on the southwest corner of E. Manning and S. Leonard Avenues approximately 4,025 feet north of the city limits of the City of Selma (APN: 348-050-25S & 29) (8309 E. Manning Avenue and 9073 S. Leonard Avenue, Fowler) (Sup. Dist. 4). Adopt the Mitigated Negative Declaration based on Initial Study No. 7504 and take action on General Plan Amendment Application No. 555 and Amendment Application No. 3832 with Findings and Conditions.
(Hereafter, the “Proposed Project”)
The County of Fresno has determined that it is appropriate to adopt a Mitigated Negative Declaration for the Proposed Project. The purpose of this Notice is to (1) provide notice of the availability of IS No. 7504 and the draft Mitigated Negative Declaration and request written comments thereon; and (2) provide notice of the public hearing regarding the Proposed Project.

Interested persons are invited to appear at the hearing and comment on the Proposed Project and draft Mitigated Negative Declaration.
The item is anticipated to be heard by the Board of Supervisors at a later date should the Commission recommend approval and if the Commission’s action is appealed. A separate notice will be sent confirming the Board of Supervisors’ hearing date

The scope of work includes, but is not limited to: Demolition of the existing building and parking lot at 4343 North Blackstone Avenue. Demolition activities include removing existing building structure, cutting and capping existing utilities (gas, fire, sewer), removing existing AC pavement and landscape islands, removing concrete bollards, curbs, gutters, walkways, loading dock ramps, and equipment slabs, removing existing grease trap structures, and removing existing light poles, signs, and metal railings.
