A deposit need not accompany each oral bid. If the successful bid is oral, a deposit of $21,812.83 must be presented before the bidding is closed. The deposit is nonrefundable. The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence. This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check. If the Secretary is the highest bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery date of the remainder of the payment and all other costs associated with the transfer of title. At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them. The Secretary may grant an extension of time within which to deliver the remainder of the payment. All extensions will be for a 15-day increments for a fee of $500.00, paid in advance. The extension fee will be in the form of a certified or cashier’s check made payable to the Secretary of HUD. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due. If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the foreclosure commissioner after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder. There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the property will be vacant. FOR THE PROCUREMENT OF: Membrane Filtration System

FOR: Bass Lake Water Company

NOTICE IS HEREBY GIVEN that the Bass Lake Water Company (Owner) invite and will receive sealed proposals (bids) up to the hour of 2:00 p.m. on August 5, 2020, at the office of the Bass Lake Water Company for the furnishing of all transportation, labor, materials, tools, equipment, services, permits, utilities, and other items necessary to provide and supervise the installation of a 1-million gallon per day (MGD) Membrane Filtration System.

Description of Project: The project consists of furnishing a pressure-driven microfiltration membrane system for incorporation into the construction of the Bass Lake Water Company’s (BLWC) proposed new water treatment plant of 1 MGD. The water treatment plant site is located in central California in the community of Bass Lake. The membrane filtration system shall be capable of treating raw water taken from a pipe inlet in Willow Creek upstream of Bass Lake. The membrane filtration system will produce filtered water for BLWC’s existing customers as well as projected development within the service area.

Trade secrets associated with the membrane filtration designs, patented products, and the unique and varying systems that may be proposed as part of submissions to the Owner make it impossible for the Owner to select a bidder solely based on the bid cost. Bids will be evaluated by an evaluation committee appointed by the Owner. Therefore, said work may not be awarded to the lowest “lifecycle” cost bidder. Evaluation criteria will include lifecycle costs, warrantee, pretreatment requirements, ability to meet operating criteria, reliability of critical equipment, availability of replacement parts, building space requirements, responsiveness of field service staff and financial stability of the manufacturer. The Owner will award the bid to the bidder the Owner and Owner’s Representative determines best meets the long-term needs of BLWC.

Following evaluation of the bids, the Owner retains the right to enter into a contract for all or part of the equipment and/or services being proposed by bidders. The Owner also reserves the right to reject any and all bids and to waive any and all irregularities in any bid.

All trade secrets contained in bids must be clearly marked and indicated as such.

Bids shall conform to and be responsive to the Contract Documents for the work. Copies of the Contract Documents are on file and may be examined in the office of AECOM,

Each bid shall be submitted on a form furnished as part of and required in the Contract Documents and must be accompanied by cash, a cashier’s check, a certified check, or a bidder’s bond executed by an admitted surety insurer, or substitute pursuant to Section 995.710 of the Code of Civil Procedure, in an amount not less than 10% of the Total Capital Cost for the 1-MGD plant (Bid Schedule 1a) made payable to the order of or for the benefit of the Owner. The security of unsuccessful bidders will be returned by the Owner no later than sixty (60) days following the date of award. Each bid shall be sealed and delivered to the Owner at the location designated in this notice for the opening of proposals at or before the time in this notice provided. The check or bond or substitute shall be given as security that the bidder will enter into a contract with the Owner and furnish the required payment and performance bonds, or substitutes in lieu thereof, and certificates of insurance and endorsements if awarded the work, and will be declared forfeited if the bidder refuses to timely enter into said contract or furnish the required bonds or substitutes, or certificates of insurance and endorsements if his bid is accepted.

The Owner has obtained from the Director of the California Department of Industrial Relations a determination of the general prevailing rate of per-diem wages and the general prevailing rate for legal holiday and overtime work in the locality in which said work is to be performed for each craft, classification, or type of worker needed. Not less than the determined rates shall be paid to all workers employed in the performance of the contract. Such rates of wages are on file with the Department of Industrial Relations and in the office of the Owner and are available to any interested party upon request.

Pursuant to Public Contract Code Section 22300, equivalent securities may be substituted for monies withheld to ensure performance of the contract. The Owner reserves the right to solely determine the adequacy of the securities being proposed by the Bidder and the value of those securities. The Owner shall also be entitled to charge an administrative fee, as determined by Owner for substituting equivalent securities for retention amounts. The Owner’ decisions with respect to the administration of the provisions of Section 22300 shall be final and shall include, but not be limited to, determinations of what securities are equivalent, the value of the securities, the negotiability of the securities, the costs of administration and the determination of whether or not the administration should be accomplished by an independent agency or by the Owner. The Owner shall be entitled, at any time, to request the deposit of additional securities of a value designated by Owner to satisfy this requirement. If the Owner do not receive satisfactory securities within twelve (12) consecutive days of the date of the written request, Owner shall be entitled to withhold amounts due Bidder until securities of satisfactory value to Owner have been received.

Each bidder is required to sign the attached Noncollusion Affidavit and Discretionary Award Statement and submit it with his bid.

All bidders should ensure that the bid is both complete and accurate. The evaluation committee has been selected by the Owner and the Owner to ensure that all bids are fairly considered. The evaluation committee will make a recommendation to the Owner following the evaluation committee’s review of all Bids and consideration of any additional evidence or data desired by the evaluation committee. The criteria to be used to evaluate the proposal are attached herein. Bidders should refrain from lobbying Owner, any members of the evaluation committee on any aspect of the proposed contract since this will be considered negative in evaluating the bid. If bidders do so, they may be rejected.

All questions, comments, or concerns about the contract or the contract documents must be submitted to the Engineer, who is the only designated representative of the Owner authorized to respond to comments, questions, and concerns regarding this project. The Owner will not respond to comments, questions, or concerns addressed to any person other than the Engineer. If the Owner determines that a particular comment, question of concern necessitates a global response to all bidders, the Owner will issue a clarifying memorandum or addendum.

NOTICE INVITING BIDS

NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, clearing, grubbing, earthwork, grading, crush-rock surfacing, construction of concrete sidewalks, drive approach, well pump equipment, discharge piping, electrical motor, motor control center (MCC), electrical system, PG&E Rule 16 service, chlorination station building, chlorination plumbing and equipment, chain link fencing, fence rolling gate, walk gate, modification of existing irrigation system, and miscellaneous site work. MCC shall be furnished by the City.

A complete listing of bid quantities is contained in the bid proposal form. Bids will be received for the complete work in accordance with the plans and specifications on file with the City Clerk at the Clovis Civic Center, Clovis, CA. Plans and specifications, forms of proposal, contract and special provisions can be downloaded free of charge from the vendor portal of PlanetBids, Inc., which is accessible on the City of Clovis website.

Bids must be filed with the City Clerk at the Clovis Civic Center prior to 2:00 p.m., Tuesday, July 21, 2020, at which time the City Clerk will open said bids. Bids shall be submitted in sealed envelopes and marked:

Bid Proposal: Well 11A Pump and Motor Improvements

No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer. Each bid must be accompanied by a certified or cashier’s check or bidder’s bond, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid. Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract. A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded. Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Clovis. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance. Pursuant to Public Contract Code Section 22300, substitution of securities for any monies withheld by the City of Clovis to ensure performance under the contract shall be permitted. In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done. Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612. A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.

All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form. The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”. Bidders for this project must possess a valid Class A or C34 License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available. Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract. All representations made on the proposal are made under penalty of perjury.

The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.
