CITY OF CLOVIS SUMMARY OF ORDINANCE 20-10 OF THE CITY COUNCIL OF THE CITY OF CLOVIS AMENDING AND CHANGING THE OFFICIAL ZONE MAP OF THE CITY OF CLOVIS IN ACCORDANCE WITH SECTION 9.08.020 AND 9.86.010 OF THE CLOVIS MUNICIPAL CODE TO RECLASSIFY LAND LOCATED IN THE SOUTHWEST AREA OF TEAGUE AND N. FOWLER AVENUES AND APPROVING A MITIGATED NEGATIVE DECLARATION FOR R2019-007, PURSUANT TO CEQA GUIDELINES

On May 18, 2020, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance amending and changing the official zone map of the City of Clovis in accordance with Sections 9-8.020 and 9-86.010 of the Clovis Municipal Code to reclassify land located in the southwest area of Teague and N. Fowler avenues and approving a mitigated negative declaration for r2019-007, pursuant to California Environmental Quality Act guidelines.  The purpose of the request is to prezone approximately 50.80 acres from the County R-R (Rural Residential) Zone District to the Clovis R-1 (Single-Family Residential) and R-R (Rural Residential) Zone Districts.

NOTICE INVITING BIDS

NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, grinding, asphalt concrete paving, ADA concrete improvements, adjustment of existing manholes, water valves, utility boxes, and vaults to finish grade, installation of new traffic signal loop detectors, new traffic signal cable and new loop amplifiers within the existing traffic signal controller cabinet, removal and replacement of existing traffic signal loops, existing traffic markings and signs to current MUTCD standards.

A complete listing of bid quantities is contained in the bid proposal form.  Bids will be received for the complete work in accordance with the plans and specifications on file with the City Clerk at the Clovis Civic Center, Clovis, CA.  Plans and specifications, forms of proposal, contract and special provisions can be downloaded free of charge from the vendor portal of PlanetBids, Inc., which is accessible on the City of Clovis website.

Bids must be filed with the City Clerk at the Clovis Civic Center prior to 2:00 p.m., Tuesday, June 16, 2020 at which time the City Clerk will open said bids.  Bids shall be submitted in sealed envelopes and marked:

Bid Proposal: Sunnyside Avenue Street Improvements

No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer.  Each bid must be accompanied by a certified or cashier’s check or bidder’s bond, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid.  Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract.  A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded.  Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Clovis.  Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance.  Pursuant to Public Contract Code Section 22300, substitution of securities for any monies withheld by the City of Clovis to ensure performance under the contract shall be permitted.  In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done.  Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612.  A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.

All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form.  The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”.  Bidders for this project must possess a valid Class A or C12   License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available.  Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract.  All representations made on the proposal are made under penalty of perjury.

The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.

Prospective bidders shall be required to have a valid Class B Contractor’s License.

The successful bidder will be required to furnish a Payment Bond, a Performance Bond, Workers Compensation and General Liability Insurance as required by the Contract Documents.  The successful bidder shall also be required to enter into a written agreement on a form provided by the District.

Bids must be accompanied by a bidder’s bond or certified check for at least ten (10%) of the amount of the bid and payable to the District, which shall be given as a guarantee that the bidder will enter into a contract if awarded the work. Said bond or certified check will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the District.

COVID-19 guidelines and procedures for all construction sites and workers at all public works must be implemented at all times.  Each Bidder and all Subcontractors will be required to abide by the California Department of Industrial Relations (DIR) Division of Occupational Safety & Health Publications Unit SAFETY AND HEALTH GUIDANCE COVID-19 INFECTION PREVENTION IN CONSTRUCTION guidelines, as per attached.  Contactors and Subcontractors will be required to stay updated on any changes to the DIR guidelines and to make sure they remain within compliance.

Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”).  A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness.  Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors.  If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.

The Work is subject to payment of Prevailing Wage Rates (PWRs).  The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided.  Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.

The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Contractor must pay for any labor described or classified in an amount not less than rates specified.

Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.

The Board of Trustees reserves the right to reject any or all proposals, waive any informality in the receiving of bids, and consider quality, convenience, and reasonable qualifications as well as price in making awards.
