Regular Meeting, June 1, 2023
NOTICE IS HEREBY GIVEN that at a regular meeting on Thursday, June 1, 2023 at 6:30 p.m. or as soon thereafter as the matter can be heard, the Fowler Planning Commission will hold a hearing at the City Hall Council Chamber at 128 S. 5th Street, Fowler, California to consider the following:
Tentative Parcel Map 23-01 is a proposal for the land division of Assessor’s Parcel Number (APN) 345-180-30. APN 345-180-30 is approximately 18.72 acres in size and is generally located at the northwest corner of Manning Avenue and Golden State Boulevard. Approval of the proposed Tentative Parcel Map would divide the existing parcel into 10 smaller parcels.
Lot Line Adjustment 23-09 is a proposal for the merger of APN 343-182-12 and APN 343-182-16. APN 343-182-16 is approximately 0.52 acres in size and contains the existing Fowler Baptist Church. APN 343-182-12 is approximately 0.17 acres in size and currently contains a grass lot that has at times in the past contained a storage shed. LLA 23-09 would result in the merger of each of the two parcels into one parcel of approximately 0.69 acres in size.
Conditional Use Permit Application 23-11 is a proposal for the expansion of the Fowler Baptist Church by approximately 1,440 square feet. The expansion would result in additional kitchen space, an accessible bathroom, and additional floor space for the existing assembly hall. The church is located within the RM-3 zone district and is planned High Density Residential. Churches are allowed conditionally within this zone district. Any expansion of a use allowed conditionally within the RM-3 district requires the approval of a separate conditional use permit.
Revocation of Conditional Use Permit 15-04 (IRE Pallets). On October 8, 2015, the Fowler Planning Commission approved Conditional Use Permit 15-04 for a wooden pallet storage, recycling, and sale operation located at 2369 South Golden State Boulevard. The City has notified the landowner of non-compliance with the conditions of Conditional Use Permit 15-04, including an initial abatement notice from Fowler’s Community Compliance Officer dated March 8, 2022, followed by several follow up notices and site inspections. No action was taken by the landowner to abate the violations, and as a result a Notice of Violation dated September 9, 2022 was provided to the landowner. Section 9-5.417 of the Fowler Municipal Code sets forth the procedures and grounds for revocation of Conditional Use Permits. Section 9-5.417 (B) of the Fowler Municipal Code provides that the Commission shall hold a hearing on a proposed revocation after giving written notice to the permittee at least ten (10) days prior to the hearing. If the Commission finds that any one of the grounds for revocation exists, the Commission may revoke the permit, and order the cessation of any use and may further order the removal of any structure thereof that has been permitted by said permit. The decision of the Commission to revoke a permit may be appealed to the Council.
The Planning Commission invites your participation, and the public is welcome to speak on any of the public hearings that are referenced above. Prospective bidders shall be required to have a valid Class B Contractor’s License.
Bidders are solely responsible for on-time electronic submission of their bid through PlanetBids.
It is the bidder’s sole responsibility to contact State Center Community College District’s online bid management provider, PlanetBids at 818-992-1771, to resolve any technical issues related to electronic bidding, including (but not limited to) registering as a vendor, updating passwords, updating profiles, uploading/downloading documents, submitting an electronic Proposal, and for the stability of their internet service, etc… prior to bid due date/time.
SCCCD will only consider bids that have been transmitted successfully and have been issued an ebid confirmation number (VBID) with a timestamp from the bid management system. Transmission of bids by any other means will not be accepted.
Failure of Bidder to submit an electronic bid shall be the bidder’s sole risk and no relief will be granted. Bidders experiencing technical difficulties shall contact PlanetBids at (818) 992-1771 for technical difficulties or help with the bid submission process.
The successful bidder will be required to furnish a Payment Bond, a Performance Bond, Workers Compensation and General Liability, Insurance as required by the Contract Documents. The successful bidder shall also be required to enter into a written agreement on a form provided by the District.
Bids must be accompanied by a bidder’s bond for at least ten (10%) of the amount of the bid and payable to the District, which shall be given as a guarantee that the bidder will enter into a contract if awarded the work. Said bond will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the District. An electronic copy of bid bond must be submitted and physical copy should be held with vendor and made available to District upon request.
Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”). A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness. Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors. If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.
The Work is subject to payment of Prevailing Wage Rates (PWRs). The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided. Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.
The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Contractor must pay for any labor described or classified in an amount not less than rates specified.
Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.
The Board of Trustees reserves the right to reject any or all proposals, waive any informality in the receiving of bids, and consider quality, convenience, and reasonable qualifications as well as price in making awards.

Notice of Closure for Community Dialysis Center-Clovis
Community Dialysis Center-Clovis will permanently close effective Friday, August 4, 2023. Services that will be ending include hemodialysis. There will be no reduction in personnel due to the closure.
The Dialysis Center Team will help patients determine which new site will work best for them. Patients who wish to continue to be cared for by their Dialysis team have the option of transferring to our sister unit at Community Dialysis Center-Fresno.
