NOTICE OF PUBLIC HEARING 

NOTICE IS HEREBY GIVEN that, on May 25, 2021, the Board of Supervisors of the County of Fresno (the “County”) will conduct a public hearing as required by Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), at which it will hear and consider information concerning the proposed issuance by the California Municipal Finance Authority (the “Authority”) of qualified solid waste disposal facility bonds pursuant to section 142(a)(6) of the Code in an aggregate principal amount not to exceed $703,700,000 (the “Bonds”).  The Bonds will be part of a plan of finance, and may be issued in one or more series from time to time over a period of multiple years.

Proceeds of the Bonds will be used to finance and/or refinance certain capital projects located in 13 different counties in California, including in the territorial limits of the County. A portion of the proceeds of the Bonds, in an amount not expected to exceed $10,300,000, is intended to finance and/or refinance certain capital projects located in the territorial limits of the County at the following locations and currently owned and/or operated by the following affiliates of Republic Services, Inc.: (i) Allied Waste Services of Fresno, 5501 N. Golden State Blvd, Fresno, CA 93722, owned and/or operated by Allied Waste Services of North America, LLC (up to $10,200,000 of Bonds, including up to $5,000,000 of new money Bonds at such location), and (ii) BFI Rice Road TS, 10463 N. Rice Road, Fresno, CA 93730, owned and/or operated by Allied Waste Transfer Services of California, LLC (up to $100,000 of Bonds). The initial owners and/or operators set forth above, and their affiliates, including Republic Services, Inc., are collectively referred to herein as the “Borrower.”

The projects to be financed and/or refinanced at such locations (collectively, the “Project”) include: (a) improvements to existing landfill facilities, including construction of new disposal cells and liners within currently permitted acreage, (b) additions and improvements to the leachate collection and treatment system, including leachate trenching, (c) additions and improvements to the methane gas systems, (d) installation of new liners for intermittent and final closure of completed  sections of  the landfill facilities, (e) site improvements, (f) acquisition of equipment to be used at the landfill facilities, (g) improvements to existing collection (hauling) and transfer station facilities, including but not limited to (i) acquisition of solid waste disposal and recycling trucks and support vehicles, (ii) acquisition of solid waste disposal and recycling containers and related equipment, (iii) acquisition of solid waste sorting and processing and recycling equipment, (iv) site and/or land improvements, (vi) the construction of one or more buildings for supporting operations of the Project and (v) acquisition of other equipment and assets necessary to support the foregoing improvements and place them into service, and (h) acquisition of other equipment and assets necessary to support the foregoing improvements and to place them into service.

The Bonds and the obligation to pay principal of and interest thereon and any redemption premium with respect thereto do not constitute indebtedness or an obligation of the County, the Authority, the State of California or any political subdivision thereof, within the meaning of any constitutional or statutory debt limitation, or a charge against the general credit or taxing powers of any of them.  The Bonds shall be a limited obligation of the Authority, payable solely from certain revenues duly pledged therefor and generally representing amounts paid by the Borrower.

The hearing will commence at 10:00 a.m., or as soon thereafter as the matter can be heard, and will be held at the Fresno County Hall of Records, 2281 Tulare Street, Room 301, Fresno, California.  Interested persons wishing to express their views on the issuance of the Bonds or on the nature and location of the facilities proposed to be financed or refinanced may attend the public hearing or, prior to the time of the hearing, submit written comments.

Regarding 2021-2022 District Budget and Assessment Tax

Notice is hereby given that the Budget Workshop of the Fresno Metropolitan Flood Control District will be held at 6:00 pm, on Wednesday, June 2, 2021.   The Budget Hearing will be held at 6:00 pm, on Wednesday, June 23, 2021.  Per Executive Order N-29-20, which allows local and state legislative bodies to hold meetings via teleconference and to make meetings accessible electronically, the Budget Workshop and Budget Hearing will be held via a webcast.  For information on how to join the webcast, please see the District’s webpage at www.fresnofloodcontrol.org.  Pursuant to this Notice and the Fresno Metropolitan Flood Control Act, including Sections 23, 23.5 and 46 thereof, said Board of Directors intends by resolution to adopt its 2021-2022 Budget, and to establish assessment categories, factors and rates sufficient to fund its annual budget, including costs associated with:

PROPOSED VACATION OF A PUBLIC UTILITY EASEMENT ON LOTS 78 THROUGH 81 OF CAMPUS HOMESITES TRACT NUMBER 1552

Notice is hereby given that the Council of the City of Fresno has adopted Resolution of Intention No. 1140-D to vacate a public utility easement on Lots 78 through 81 of Campus Homesites Tract Number 1552.  The resolution conforms to the provisions of the Public Streets, Highways, and Service Easements Vacation Law, being Sections 8300-8363 of the California Streets and Highways Code. 

Resolution of Intention No. 1140-D sets the hour of 10:00 a.m. on May 13, 2021, in the Council Chambers in the Fresno City Hall, when all persons interested in or objecting to the proposed vacation may appear before the Council and offer evidence in relation thereto. NOTICE OF PUBLIC HEARING TO CONSIDER UPDATING THE CITY OF FOWLER’S DEVELOPMENT IMPACT FEE PROGRAM 

NOTICE IS HEREBY GIVEN that on May 18, 2021, at the City Council Chambers located at 128 South Fifth Street, Fowler, California, the City Council of the City of Fowler will hold a public hearing to consider an update to the City’s Development Impact Fee Program, in accordance with Chapter 5 (commencing with Section 66000) of Division 1 of Title 7 of the Government Code and the Fowler Municipal Code. 

The purpose of the City’s Development Impact Fee Program is to create and establish development impact fees for the City which are used to mitigate adverse impacts to public facilities attributed to new development. The proposal intends to update the applicable fees for general facilities and equipment necessary for the administration of the City, law enforcement facilities and equipment, fire protection and suppression facilities and equipment, storm drainage facilities, water supply facilities, and wastewater facilities. The proposal also intends to add fees for traffic facilities and groundwater recharge facilities. Finally, the proposal intends to update and clarify the fees for park and recreation facilities.

Any interested person may appear at the public hearing and present written testimony or speak in favor or against the proposal. If you challenge the above applications in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council at or prior to the public hearing.

Additional information on the Development Impact Fee Justification Study (the “Nexus Study”) and proposed Development Impact Fees, is available for public review and may be obtained by contacting the City Clerk at 559-834-3113.
