RESOLUTION  NO. 23-28

A RESOLUTION OF INTENTION TO LEVY AND COLLECT THE ANNUAL ASSESSMENT FOR LANDSCAPE MAINTENANCE DISTRICT NO. 1 FOR THE CITY OF CLOVIS AND SET THE PUBLIC HEARING

WHEREAS, the Clovis City Council has approved one hundred ten (1 1 0) annexations with new improvements to the Landscape Maintenance District No. 1 of the City of Clovis (herein “LMD No. 1”) since the Engineer’s Report dated June 6, 2022; and

WHEREAS, proceedings for the annual assessments for LMD No. 1 for the fiscal year 2023-24 need to be initiated.

NOW, THEREFORE, BE IT RESOLVED AND ORDERED as follows:

1. It is the intention of said Council to order the levy and collection of an assessment for the 2023–24 fiscal year under the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code beginning with Section 22500 of said Code, for Landscape Maintenance District No.1 of the City of Clovis (herein “LMD No. 1”).

2. Said LMD No. 1 is generally described as all properties in subdivisions, Site Plan Review developments, Parcel Map developments, and other miscellaneous property entitlement developments approved since July 1985 within the current boundaries of the City of Clovis.

3. The Engineer has prepared and filed with the Clerk of the City of Clovis a preliminary report labeled Preliminary Engineer’s Report of the City of CIO’ViS LMD No. 1, dated May 1, 2023, to which reference is hereby made for a detailed description of the improvements, the boundaries of the assessment district and any zones therein, and the proposed assessments upon assessable lots and parcels of land within LMD No. 1.

4. The Business Journal, a newspaper circulated in the City of Clovis, is hereby designated as the newspaper in which this Resolution of Intention shall be published, and the Clerk of the City of Clovis is hereby directed to cause this Resolution of Intention to be published once no less than ten (10) days prior to the hearing date set forth below.

NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION

FOR WELLHEAD TREATMENT IMPROVEMENTS AT PUMP STATION 102A

NOTICE IS HEREBY GIVEN that the City of Fresno (City) plans to adopt a Mitigated Negative Declaration for the Wellhead Treatment Improvements at Pump Station (PS) 102A (Project). The public hearing will be held at the City of Fresno, City Council Chambers, located at 2600 Fresno Street, Fresno, CA 93721, on Thursday, June 15, 2023, at 9:00am.   

The City’s Department of Public Utilities proposes to construct wellhead treatment facilities to mitigate 1,2,3-Trichloropropane (TCP) concentrations found at the existing public water supply well, known as Pump Station 102. The treatment facilities will be constructed at the proposed PS 102A located less than 1,000 feet northeast of the existing PS 102.

The Project would construct the following components: tie-in to the existing PS 102 well head piping, approximately 1,400 linear feet (LF) of 12-inch diameter raw water main between the existing PS 102 well site and the proposed treatment site, PS 102A (1,200 gpm flow rate), develop a 175′ by 160′ triangular treatment site with a masonry block wall and metal fencing, frontage improvements, four (4) 12-foot-diameter by 15-foot-tall granulated activated carbon vessels, approximately 450 LF of 18-inch diameter storm drain pipe, drive approach, 20′ wide x 75′ long concrete driveway, 20′ wide metal drive access gate, PG&E transformer, 40′ x 40′ GAC vessel pit, approximately 30′ x 10′ masonry block equipment building with chemical room containing sodium hypochlorite storage tank, chemical metering pump, and chlorine and nitrate analyzers. The Project will also include the future installation of a generator, deaeration tank, manganese filters, booster pump, and groundwater extraction well with manifold piping, (this well may be required in the future due to additional demand in the area or as a replacement of Well 102A).

Pursuant to the California Environmental Quality Act, an Initial Study/Mitigated Negative Declaration has been prepared, describing the degree of potential environmental impacts of the Project. The City has assessed the potential environmental impacts of this Project and has determined that they will be less than significant. Copies of the Initial Study and proposed Negative Declaration are on file and available for public review upon written notice to 2600 Fresno Street, Fresno, CA 93721. The public review period during which the City will receive comments on the proposed Mitigated Negative Declaration will begin on May 5, 2023, and end on June 5, 2023. Contract Time shall be One Hundred and Fifty-Six (156) calendar days, and liquidated damages for delay shall accrue. See Agreement Between Owner and Contractor for more information.

Bids must be sealed and filed in the Business Office of the Owner at 1905 7th Street, Sanger, CA 93657, by May 18, 2023, before 3:00 p.m. on the clock designated by the Owner or its representative as the bid clock, after which time bids will be opened.  No bid will be accepted by Owner after this time. Facsimile (FAX) copies of the bid will not be accepted.

Bids must be accompanied by a bidder’s bond, cashier’s check, or certified check for at least ten percent (10%) of the amount of the base bid and made payable to the Owner.

Pursuant to the Contract Documents, the successful bidder will be required to furnish a Payment (Labor and Material) Bond in the amount of one hundred percent (100%) of the Contract Sum, and a Faithful Performance Bond in the amount of one hundred percent (100%) of the Contract Sum, as set forth in the Contract Documents.

The successful bidder will be allowed to substitute securities or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the Agreement Between Owner and Contractor and General Conditions.

The Owner will not consider or accept any bids from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors.  In accordance with Section 3300 of said Code, the bidder shall have a Class “B” license and shall maintain that license in good standing through Contract completion and all applicable warranty periods.  For all projects over Twenty-five Thousand Dollars ($25,000), bidder shall state the public works contractor registration number on the Designation of Subcontractors form for each subcontractor performing more than one-half of one percent (0.5%) of the bidder’s total bid.

Notice is hereby given that the Fresno Unified School DISTRICT (“DISTRICT”) will receive sealed bids for Bid No. 23-65, ROBINSON ELEMENTARY SCHOOL PORTABLE RELOCATION, to relocate and install two portables.

DISTRICT hereby notifies all bidders that they will affirmatively ensure that in any Contract entered into pursuant to this advertisement, disabled veteran business enterprises (DVBE) will be afforded full opportunity to submit proposals in response to this invitation and will not be discriminated against on the grounds of race, color, creed, sex or national origin in consideration for award. The DVBE goal for the project is as follows:  three percent (3%) of the dollar amount of the Contract.

A Pre-conference call regarding the Request for Qualifications is scheduled Monday, May 8, 2023 at  10:00 AM.  The virtual Pre-conference will be hosted via Teams with options to join in online or over the phone.  Instructions are posted on Procureware.

Proposals will be received prior to 2:01 P.M. on May 17, 2023 on Procureware, the District’s online purchasing portal https://fresnousdpurchasing.procureware.com/home.  Qualifications received later than the designated time and date will not be accepted.  Facsimile (FAX), mailed or e-mailed copies of submittals will not be accepted. Proposals will not be read out loud as it is based on proposal criteria scoring.
