COMPLAINT FOR DAMAGES FOR VIOLATION OF   THE FRESNO MUNICIPAL CODE

CITY OF FRESNO, a municipal corporation;   and PEOPLE OF THE STATE OF CALIFORNIA,

Plaintiffs City of Fresno and People of the State of California allege:

            1.         Plaintiff, City of Fresno (City) is, and at all times herein mentioned was, a charter municipal corporation, duly organized and existing under and by virtue of the Constitution of the State of California.

            2.         Plaintiff, the People of the State of California (People), is the sovereign power of the State of California as designated by Code of Civil Procedure Section 731, to be the complaining party in a civil law enforcement action brought under this statute.  The People have an interest in ensuring that individuals and entities doing business in this state comply with all applicable laws.  The  People  act  here  through  Douglas T. Sloan, City Attorney  for  the  City  of  Fresno, under the

authority granted to him by Code of Civil Procedure Section 731, and Code of Civil Procedure Section 3479 et seq. to bring this civil enforcement action.

            3.         California Government Code Section 38771 authorizes the Fresno City Council, by ordinance, to declare what constitutes a nuisance.  The Fresno Municipal Code makes it unlawful to own or control a property with a public nuisance.  (FMC §10-605.)  Public nuisances include, but are not limited to rubbish, junk, abandoned cars, weeds, blighted vacant buildings and attractive nuisances.  (Civ. Code §§3479-3481; FMC §§10-605, 10-617.)  When a nuisance exists, the City is permitted to obtain a judgment for damages, enjoin the continuance of the nuisance, or enter upon and correct it.  (CCP §731). 

4.         The Fresno Municipal Code also provides the City with several modalities to collect on unpaid abatement costs incurred by the City or penalties issued by it resulting from an ongoing public nuisance, including obtaining a personal judgment (FMC §1-510.) 

            5.         The allegations in this Complaint, stated on information and belief, have current and substantial evidentiary support.

            6.         City is informed and believes and thereon alleges that defendants Primativo V. Diaz and Fermin A. Diaz; and Does 1 through 50 inclusive (collectively Defendants) are, and at all times mentioned herein were, the record owners and operators of the real property, 5240 N. State Street, Fresno, California, APN 508-110-35S (the Subject Property).

            7.         Defendants Does 1 through 50, inclusive, are sued herein under fictitious names.  Their true names and capacities are unknown to City.  When their true names and capacities are ascertained, City will amend this complaint by inserting their true names and capacities herein.  City is informed and believes and hereon alleges that each of the fictitiously named Defendants are responsible in some manner for the occurrences, conditions and/or violations herein alleged.

            8.         Wherever in this Complaint reference is made to any act of Defendants, such allegations shall be deemed to mean Defendants or their heirs, officers, agents, managers, representatives, employees, who did or authorized such acts while actively engaged in the operation, management, direction or control of the affairs of Defendants while acting within the course and scope of their duties.

9.         The Subject Property has a history of Municipal Code violations, which the Defendants failed to timely and adequately correct.

10.       The Subject Property has been the subject of an open public nuisance abatement action by the City Code Enforcement Division since 2012 and contained the remains of several partially demolished, fire damaged structures.  Despite ample time and multiple deadline extensions, the Defendants failed to complete the demolition of the fire damaged structures on the Subject Property and bring it into compliance with the minimum standards of the Fresno Municipal Code.  Moreover, the Subject Property was an attractive nuisance frequently visited by homeless persons who caused multiple fires on the Subject Property threatening the health and safety of the neighbors and the surrounding properties.

11.       On August 22, 2017, the City determined that the fire damage was severe enough to warrant a public nuisance summary abatement and demolition of the structures on the Subject Property. 

12.        Between August 22 and September 5, 2017, the City hired contractors to conduct a lead based paint/asbestos inspection and then proceeded with abatement of the lead based paint/asbestos, followed by the demolition of the remaining structure.   

13.       Prior to conducting any of the aforementioned abatement, the City served notices on Defendants, requesting that they bring the Subject Property into compliance with the Municipal Code and California Building Codes and informing them of the City’s summary abatement activities.  Defendants failed to respond. 

14.       Following the completion of the summary abatement, the City invoiced Defendants for the abatement expenses incurred by the City.  Defendants have failed to pay these charges.

15.       As of June 12, 2018, the total unpaid amount owed to the City by Defendants for repeatedly securing the property, inspecting for lead paint/asbestos, abating the lead paint/asbestos, demolishing the fire damaged structures, and City administrative time is $42,801.54. Attached hereto as Exhibit A and incorporated herein by reference is a true and correct copy of the June 12, 2018, Demand for Payoff.

            WHEREFORE, Plaintiffs prays as follows:

            1.         That Defendants, and each of them, be ordered to pay the City any and all abatement and administrative costs relating to board up and demolition of the public nuisances on the Subject Property which as of June 12, 2018, totaled $42,801.54.

            2.         That the City recover costs of suit from Defendants and each of them and/or their heirs, successors and assigns, including reasonable attorney fees under California Government Code Section 38773.5 and Fresno Municipal Code Section 1-510;

            3.         For such other and further relief as the court deems proper.

ASHLAN AVENUE OVERLAY – WEST AVENUE TO VALENTINE AVENUE

The scope of work includes, but is not limited to: Asphalt overlay along Ashlan Avenue, as well as the installation of curb ramps, signal loop detectors, signage and striping between Valentine to West Avenues.

The Construction Allocation for this project is $ 1,437,884

Bid Proposals must be filed with the Purchasing Manager prior to the bid opening at 3 p.m. on Tuesday,  May 7, 2019, when the bids will be publicly opened and recorded.

The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code.  The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City.  A copy of the resolution is on file at the Office of the City Clerk.  Actual wage schedules are available at Construction Management Office, 1721 Van Ness Avenue, Fresno, California 93721, (559) 621-5600.

Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager and must be accompanied by a Bid Deposit in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount.  All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected. 

The City of Fresno hereby notifies all Bidders that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation, ethnicity, status as a disabled veteran or veteran of the Vietnam era or on any other basis prohibited by law.

The City will carry out applicable federal requirements in the award and administration of any contract awarded hereunder.  This is a federal project funded with financial assistance from the U.S. Department of Transportation, Federal Highway Administration (FHWA). 

Bidders are advised that, as required by federal law, the State of California has established a statewide overall DBE goal.  City of Fresno federal-aid contracts are considered to be part of the statewide overall DBE goal and the City is required to report to the California Department of Transportation (Caltrans) on DBE participation for all Federal-aid contracts each year so that attainment efforts may be evaluated. 

Bidders are advised that, as required by federal law, the City of Fresno is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE).  The DBE goal for this Project is FOURTEEN PERCENT (14%).  DBE participation shall be calculated on the basis of the Total Net Bid Amount and on all possible combinations of the Base Bid plus Add Alternate(s), if applicable.

Bidders are advised that any award of the Contract will be conditioned on the successful Bidder meeting the good faith efforts to meet the established goal for this project pursuant to 49 CFR 26.53.

A pre-bid conference will be held at 1:30 p.m., on April 26, 2019, in Room 4017, City Hall, 2600 Fresno Street, Fresno, California.  Prospective Bidders are encouraged to attend since City Staff will be present to answer any questions regarding the Specifications, and there may be an inspection tour of the job site(s).

No bid will be considered for award unless the Bidder at the time of bid opening, is licensed with a valid Class “A” Contractor’s License issued by the State of California.
