The Malaga County Water District is soliciting bids for construction of the Malaga Wastewater Treatment Plant Nitrogen Reduction Project. The Malaga County Water District hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award. In general, the Work consists of Demolish of DAF basin equipment, furnish and installation of two recirculation pumps, valves, piping, F&I Anoxic Basin submersible mixers, modify blower room air piping, as shown on the plans. If there is a difference between the minimum wage rates determined by the Secretary of Labor and the prevailing wage rates determined by the Director of California Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate. NOTE: a. State wages on file with the Clerk of the Fresno County Board of Supervisors may be referred to. B. The Labor Code provides that State wage rates may be determined only by the Director of Industrial Relations; not by Local awarding bodies. This project is subject to “Buy America” requirements of the Surface Transportation Assistance Act of 1982 (Section 165), and the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) Sections 1041(a) and 1048(a), Title 23 CFR 635.410, and the regulations adopted pursuant thereto.
This project is also subject to the Cargo Preference Act (CPA) implementing regulations in Title 46 CFR 381, “Cargo Preference – U.S.-Flag Vessels”, for all Federal-aid projects.
